1. Plaintiffs, Douglas R. Heineman and Rodney L. Rumberger, are a Partnership
with principal offices 163 North Hanover Street, Carlisle, PA 17013.
2. Douglas Heineman tla B-H Agency Realtors is a business with its principal offices
at 163 North Hanover Street, Carlisle. PA 17013.
3. Art Kuykendall is ~n individual residing at 208 Mill Street. Mount Holly Springs,
PA 17065.
4. Body Tyme, Inc. is a business with its principal business address at 457 Wolfs
Bridge Road. Carlisle, PA 17013.
5. Ricky M. Swords and Cynthia K, Bouder tldlbla Body Tyme is a business with
its offices at 163 North Hanover Street, (rear) Carlisle, PA 17013.

17. As a direct and proximate result of the negligent acts and omissions of ~hls
Defendant, as set forth above, Plaintiffs have sustained damage in that fire, causing extensive
real and personal property loss, as well as a lengthy interruption of Plaintiffs business and the
result of lost profits.
WHEREFORE, Plaintiffs request this Honorable Court a judgment in their favor and
against Defendant in the amount in excess of $25,000.00 together with prejudgment interest,
costs, delay damage, attorney fees and other such relief as the Court may deem appropriate.
COUNT II - EXPRESS AND IMPLIED W ARRANTIE.,S
PLAINTIFFS V. ART KUYKENDALL
18. Plaintiffs incorporate paragraphs 1 through 17 as set forth herein and made a part
hereof as if set forth in full.
19. Defendant, Art Kuykendall, expressly and/or impliedly warranted that the
enclosure of the boiler room and/or the vent pipe perfonned by him would be completed in a
workmanlike manner, and would be fit for its intended use and purpose.
20. Defendant, Art Kuykendall, breached the aforesaid express and implied warranties
because the enclosure of the boiler room and vent pipe was not completed in a workmanlike
manner and the resulting product was not fit for the ordinary purpose for which it was used and
was not fit for its intended manner.

Being liable based upon the status as a possessor of land who intrusted the
work to an independent contractor who is liable to Olhers, including but
not limited to pursuant to Restatement (Second) of Tons ~422;
p.
Liability based upon the failure of Defendant's contractor to provide
safeguards pursuant to the statutes and/or regulations, including but not
limited to based on Restatement (Second) of Tons H24;
35. As a direct and proximate result of the negligent acts and omissions of Defendant,
as set fOM above, Plaintiffs bave sustained damage to its real and personal propeny, as well as
a substantial interruption of their business and result in loss of profit.
WHEREFORE, Plaintiffs request this Honorable Coun a judgment in their favor and
against Defendant in the amount in excess of $25,000.00 together with prejudgment interest,
costs, delay damage. attorney fees and other such relief as the Coun may deem appropriate.
VII . BREACH OF CONTRACT
PLAINTIFFS V. RICKY M. SWORDS
AND CYNTHIA K. BOUDER. t/d/b/n BODY TYME
36, Plaintiffs incorporate paragraphs I through 35 as set fOM herein and made a pan
hereof as if set fOM in full.
37. Based upon infonnation and belief, the lease agreement, attached hereto as '
"Exhibit A," was entered into by Defcndants. Ricky M. Swords and Cynthia K. Bouder. t/d/b/a
Body Tyme, either intended or incidental, of Defendant.
38. Defendants, Ricky M. Swords and Cynthia K. Bouder, t/d/b/a Body Tyme,
breached the express terms of said lease agreement including but not limited to as f("lIows:

41. Based upon information and belief, the lease agreement, attached hereto as
"Exhibit A." was entered into by Defendants, Ricky M. Swords and Cynthia K. Bouder, t/d/b/a
Body Tyme.
42. Pursuant to the terms of the lea3e agreement. Defendants, Ricky M. Swords and
Cynthia K. Bouder. tld/b/a Body Tyme, are liable for indemnification of Plaintiffs including but
not limited to pursuant to ~9{c) and/or U3.
43. Pursuant to the terms of the contract. Defendants, Ricky M. Swords and Cynthia
K. Bouder, tld/b/a Body Tyme, are liable for indemnification for the damage to real and
personal property as well as business interruption and result of loss profits of Plaintiffs.
WHEREFORE, Plaintiffs request this Honorable Court a judgment in their favor and
against Defendant in the amount in excess of $25,000.00 together with prejudgment interest.

45. The damage to Plaintiffs property as referred to above was caused by the
negligence. carelessness, and/or recklessness of Defendant, Ricky M. Swords and Cynthia K.

50. As a direct and proximate result of the aforesaid breach of contract, Defendant
caused Plaintiffs substantial real and personal property loss, as well as substantial interruption
of Plaintiff's business and the result of lost profits.

against Defendant in the amount in excess of $25,000.00 IOgether with prejudgment interest,

6. Ricky M. Swords is an individual with his principal address at 457 Wolrs Bridge
Road, Carlisle, PA 17013.
7. Cynthia K. Bouder is an adult individual with her primary address at 457 Wolfs
Bridge Road, Carlisle, PA 17013.
8. On or about March 20, 1992, Plaintiff, Heineman & Rumberger, a Partnership,
entered into a lease agreement with Ricky M. Swords and Cynthia K. Bouder, individually and
trading and doing business as Body Tyme, a copy of which is attached hereto and made a part
hereof as "Exhibit A. "
9. Based on infonnation and belief, Ricky M. Swords and Cynthia K. Bouder,
tldlbla Body Tyme became incorporated as Body Tyme, Inc. which was the beneficiary of the
lease agreement set forth in "Exhibit A."
10. Defendants hired Art Kuykendall to do various repairs and construction on the
premises, including but not limited to enclosing the furnace and boiler and specifically including
the flue from the boiler and furnace.
11. The leased premises was at all times relevant owned by Heineman and
Rumberger, a Partnership.
12. At all times relevant, Douglas Heineman tla B-H Agency Realtors also had its
principal offices in the building rented to Defendants by Heineman and Rumberger, a
Partnership.

17. As a direct and proximate result of the negligent acts and omissions of this
Defendant, as set forth above, Plaintiffs have sustained damage in that fire, causing extensive
real and personal propeny loss, as well as a lengthy interruption of Plaintiffs business and the
result of lost profits.
WHEREFORE, Plaintiffs request this Honorable Court a judgment in their favor and
against Defendant in the amount in excess of $25,000.00 together with prejudgment interest,
costs, delay damage, attorney fees and other such relief as the Court may deem appropriate.
COUNT II - EXPRESS AND IMPLIED WARRANTIES
PLAINTIFFS V. ART KUYKENDALL
18. Plaintiffs incorporate paragraphs 1 through 17 as set forth herein and made a part
hereof as if set forth in full.
19. Defendant, An Kuykendall, expressly and/or impliedly warranted that the
enclosure of the boiler room and/or the vent pipe performed by him would be completed in a
workmanlike maMer, and would be fit for its intended use and purpose.
20. Defendant, Art Kuykendall, breached the aforesaid express and implied warranties
because the enclosure of the boiler room and vent pipe was not completed in a workmanlike
manner and the resulting product was not fit for the ordinary purpose for which it was used and
was not fit for its intended manner.

i. Violating the provisions of the applicable national standard with respect
to the planning, design, manufacture, construction, and/or erection of the
boiler room enclosure and/or vent pipe;
e. Failing to warn Plaintiffs of the aforesaid dangerous conditions;
f. Failing to design or adopt a safe plan or design for the construction of the
enclosure of the boiler room and/or the vent pipe;
g. Failure to adequately inspect, observe, and correct such unreasonable and
dangerous conditions as performed by Defendant's agents, employees, or
subcontractors;
h. Failing to consult with an engineer or other professional with regard to the
plan, design, construction or erection of the enclosure of the boiler room
and/or the vent pipe;
j. Failure to properly supervise the planning, design, construction and
erection of the enclosure of the boiler room and/or vent pipe;
k. Failing to provide an engineer for review and/or analysis to determine the
structural and safety integrity of the enclosure of the boiler room and/or
the vent pipe;
I. Failing to comply with the local and state statutory and/or administrative
regulations with regard to the planning, designing, construction, and
erection of the boiler room enclosure and the vent pipe;
m. Negligently selecting the contractor, including but not limited to, in
violation of Restatement (Second) of Tons ~411;
n. Failure to inspect the work of a contractor after completion of the work
including but not limited to in violation of Restatement (Second) of Tons
~412;
o. Being liable based upon the status as a possessor of land who entrusted the
work to an independent contractor who is liable to others, including but
not limited to pursuant to Restatement (Second) of Tons ~422;

p. Liability based upon the failure of Defendant's contractor to provide
safeguards pursuant to the statutes and/or regulations. including but not
limited to ba5ed on Restatement (Second) of Torts ~424;
24. As a direct and proximate result of the negligent acts and omissions of Defendant,
as set forth above, Plaintiffs have sustained damage to its real and personal property, as well as
a substantial interruption of their business and result in loss of profit.
WHEREFORE, Plaintiffs request this Honorable Court a judgment in their favor and
against Defendant in the amount in excess of $25,000.00 together with prejudgment interest,
costs, delay damage, attorney fees and other such relief as the Court may deem appropriate.
COUNT IV . BREACH OF CONTRACT
PLAINTIFFS V. BODY TYME. INC.
25. Plaintiffs incorporate paragraphs 1 through 24 as set forth herein and made a part
hereof as if set forth in full.
26. Based upon infonnation and belief, the lease agreement. attached hereto as
"Exhibit A," was entered into for the benefit, either intended or incidental, of Defendant. Body
Tyme, Inc. and/or as the predece~sor thereof.
27. Body Tyme, Inc. breached the express tenns of said lease agreement including
but not limited to as follows:
a. Failing to keep the premises in good repair pursuant to ~8(b);
b. Failing to promptly repair damage to the premises at its expense and to
the satisfaction of Plaintiffs as set forth in ~7(b);

41. Based upon information and belief, the lease agreement, attached hereto as
"Exhibit A," was entered into by Defendants, Ricky M. Swords and Cynthia K. Bouder, tld/b/a
Body Tyme.
42. Pursuant to the terms of the lease agreement, Defendants, Ricky M. Swords and
Cynthia K. Bouder, t/d/b/a Body Tyme, are liable for indemnification of Plaintiffs including but
not limited to pursuant to ~9(c) and/or ~13.
43. Pursuant to the terms of the contract, Defendants, Ricky M. Swords and Cynthia
K. Bouder, tld/b/a Body Tyme, are liable for indemnification for the damage to real and
personal propeny as well as business interruption and result of loss profits of Plaintiffs.
WHEREFORE, Plaintiffs request this Honorable Court a judgment in their favor and
against Defendant in the amount in excess of $25,000.00 together with prejudgment interest,
costs, delay damage, attorney fees and other such relief as the Court may deem appropriate.
COUNT IX . NEGLIGENCE
PLAINTIFFS V. RICKY M, SWORDS
AND CYNTHIA K. BOUDER, INDIVIDUALLY
44. Plaintiffs incorporate pal'agraphs I through 43 as set forth herein and made a part
hereof as if set forth in full.
45. The damage to Plaintiffs property as referred to above was caused by the
negligence, carelessness, and/or recklessness of Defendant, Ricky M. Swords and Cynthia K.

Bouder, individl:ally, their agents, servants, andlor employees within the scope of their agency
or employment as follows:
a. Failure to exercise reasonable care in the construction of the enclosure of
the boiler room andlor the vent pipe;
b. Failing to take reasonable preventative measures that would have
substantially limited the scope of the damage to the property of Plaintiffs;
c. Failure to install proper and necessary alanns or warnings of fire that
would have reduced or limited the extent of the damage to the property of
Plaintiffs;
d. Constructing the enclosure of the boiler room andlor the vent in a manner
in which it knew, or should have known, subjected the property of
Plaintiffs to an unreasonable risk of harm;
e. Failing to warn Plaintiffs of the aforesaid dangerous conditions;
f. Failing to design or adopt a safe plan or design for the construction of the
enclosure of the boiler room andlor the vent pipe;
g. Failure to adequately inspect, observe, and correct such unreasonable and
dangerous conditions as perfonned by Defendant's agents, employees, or
subcontractors;
h. Failing to consult with an engineer or other professional with regard to the
plan, design, construction or erection of the enclosure of the boiler room
andlor the vent pipe;
i. Violating the provisions of the applicable national standard with respect
to the planning, design, manufacture, construction, andlor erection of the

caused Plaintiffs substantial real and personal property loss, as well as substantial interruption

information upon which to form a belief as to the truth or falsity
of the averments contained in paragraph 1 of plaintiffs' Complaint
and they are, therefore, denied and strict proof thereof is hereby
demanded at the time of trial.

information upon which to form a belief as to the truth or falsity
of the averments contained in paragraph 3 of plaintiffs' complaint
and they are, therefore, denied and strict proof thereof is hereby
demanded at the time of trial.
4. Denied insofar as the correct addresS for Body Tyme, Inc.
is 20 E. North street, Carlisle, pennsylvania 17013.
5. Denied. RickY M. swords and cynthia K. Bouder t/d/b/a
Body Tyme is not a business. By way of further answer, cynthia K.
Bouder did trade and do business as Body Tyme with offices at 20 E.
North street, Carlisle, pennsylvania, until such time, Body Tyme,
Inc. was incorporated on october 20, 1992.
6. Admitted in part; denied in part. It is admitted that
RickY M. swords is an individual. It is denied that his principal
addresS is 457 Wolf'S Bridge Road, carlisle, pennsylvania 17013.
7. Admitted.
B. Denied insofar as the lease agreement attached as Exhibit
\ "A" speaks for itself.

cynthia K. Bouder t/d/b/a Body Tyme became incorporated as Body
Tyme, Inc. It is denied that Ricky M. Swords became incorporated

nonetheless denied.
10. Admitted that Body Tyme, Inc. hired Art Kuykendall to do
various repairs and construction on the premises, including to but
not limited enclosing the furnace and boiler and specifically
lincluding the flue from the boiler and furnace. It is specifically
denied that Ricky M. Swords and Cynthia K. Bouder, individually or
t/d/b/a Body Tyme hired Art Kuykendall.
11. Denied. After reasonable investigation, defendants B~dy
Tyme, Inc. and Ricky M. Swords and Cynthia K. Bouder, individually
and t/d/b/a Body Tyme are without sufficient knowledge or
information upon which to form a belief as to the truth or falsity
of the averments contained in paragraph 11 of plaintiffs' Complaint

64. Pennsylvania Rule of civil Procedure 238, as amended or
adopted by the Pennsylvania Supreme Court, on its face and as
applied, is violative of the Pennsylvania Constitution, the United
states Constitution and the civil Rights Act as it imposes a
chilling effect upon defendants' exercise of their constitutional
rights.
65. If there is a judicial determination that the application
of Rule 2JB in the within action is constitutional, then liability
for any damages imposed by said Rule shall exclude the period of
time the plaintiffs failed to convey a reasonable settlement
demand, delayed in responding to any of the defendants' discovery
requests, violated any discovery Rules or caused the delay of trial
or Arbitration.
66. If there is a judicial determination that the application
of Rule 2JB in the within action is constitution, then liability
for any damages imposed by said Rule shall be suspended during the

period of time that there is any delay occasioned by the failure of
