STIPULATION AGAINST LIENS

THIS AGREEMENT made thill day of .I~";J..",,-IL, 1996, by
and between D. Cully, Inc. a Pennsylvania Corporation. trading and
doing business as C&C Construction, hereinafter referred to all
Contractor,
AND
Dwayne L. Sword and Denise E. Sword, husband and wife, hereinafter
referred to as Owners, whereby the contractor undertook and agreed
to erected and construct a dwelling on the certain lot of ground
situate in South Middleton Township, CUmberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot
#10 Middlesex Road, Carlisle, PA.
tlOW THEREFORE, THIS AGREEMENT WITNESSETH I That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic'S liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and c;onstruction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themsel ves, its, his or their subcontractors and others under them,
hereby expresllly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

EXHIBIT A
ALL THAT CERTAIN tract of land situate in the Township of South
Middleton, County of Cumberland, and Commonwealth of Pennsylvania,
being more particularly bounded and described as follows, to wit:
BEGINNING at a point in the cartway of Middlesex Road (T-684), said
point marking the common point of adjoiner of Lots #9 and #10 on
the herei~after mentioned plan of subdivision with said roadway;
thence departing from the cartway of Middlesex Road and extending
along Lot *9, North sixty-three (63) degrees twenty-five (25)
minutes forty-nine (49) seconds West, through a steel pin set on
the westernmost dedicated right-of-way line of Middlesex Road a
distance of forty-four and seven~y-three hundredths (44.73) feet
from the origin of this call, for a total distance of five hundred
seventy-four and seventeen hundredths (574.17) feet to a steel pin
at Lot *lli thence extending along Lot *11, North five (5) degrees
twenty-five (25) minutes thirty-eight (36) seconds East, for a
distance of two hundred fifteen and seventy-three hundredths
(215.73) feet to a pipe; thence extending South sixty-three (63)
degrees twenty-five (25) minutes forty-nine (49) seconds East,
through an iron pin set on the westernmost dedicated right-of-way
line of Middlesex Road, a distance of forty-seven and ninety-six
hundredths (47.96) feet from the terminus of this call, for a total
distance of five hundred twelve and eighty hundredths (512.60) feet
to a point near the eastern side of the cartway of Middlesex Roadi
thence extending in and through the cartway of Middlesex Road,
South eight(B) degrees six (6) minutes seven (7) seconds East, for
a distance of two hundred forty-four and sixty-five hundredths
(244.65) feet to a point in the cartway of Middlesex Road at Lot
#9, said point marking the place of BEGINNING.
CONTAINING 2.2964 acres to the dedicated right-of-way, and 2.5104
acres to the property line, and being designated as Lot #10 en the
final plan of subdivision of Liberty Estates prepared by Stanley
Jarmolenko, Registered Surveyor, dated October 27, 1992, and
rec:orded in the Office of the Recorder of Deeds in and for
Cumberland County, Pennsylvania in Plan Book 67, at page 126.
BEING the same premises which Harry H. Fox, Jr. and Ann G. Fox,
husband and wife, and John H. Fox and Cinda L. Fox, husband and
wife, by deed dated December 12, 1994 and recorded in the Office of
the Recorder of Deeds in and for Cumberland County in Deed Book 116
Page235 , granted and conveyed to Dwayne L. Sword and Denise E.
Sword, husband and wife, Borrowers herein.
