JOHNSON, Defendant COMPLAINT IN REPLEVIN AND NOW, comes plaintiff, Donald C. Johnson, by and through his attorneys, Law Offices of Craig A. Diehl, and files this Complaint in Replevin, respectfully stating in support thereof the following: 1. Plaintiff is Donald C. Johnson, and adult individual who currently resides at 826 North College Street, Carlisle, Cumberland County, PennsylvanJ.a. 2. Defendant is Cynthia D. Johnson, an adult individual who currently resides at 165 East High Street, Apartment 1, Carlisle, Cumberland County, Pennsylvania. 3. Plaintiff and Oefendant resided together as husband and wife at 165 East High Street until June 18, 1996. 4. Plaintiff owns and is entitled to the possession of certain premarital personal property more specifically listed in Exhibit "A" which is attached hereto and incorporated herein as if fully set forth. Said property has an estimated value of FIFTEEN THOUSAND EIGHT HUNDRED FIFTY SEVEN DOLLARS ($15,857.00). 5. Said personal property is owned by Plaintiff as same is personal property that was owned by plaintiff prior to his marriage to Defendant and was brought to the residence located at 165 East High Street, Carlisle, Pennsylvania by Plaintiff at the time he moved into the apartment with Defendant. 6. On or about June 1B, 1996, Defendant filed a Request for Protection from Abuse Order. Said temporary Order was entered on or about June 18, 1996, to Cumberland County Oocket No. 96-3341. 7. Said temporary protective Order was vacated and the Petition for Protection from Abuse was dismissed on or about June 24,1996. 8. During the hearing on said petition for Protection from Abuse which took place on or about June 24, 1996, Judge Hoffer instructed legal counsel representing the parties at that time to make arrangements for the property of Plaintiff, Donald C. Johnson, to be removed from the marital residence located at 165 East High Street, Carlisle, Pennsylvania, since Mr. Johnson indicated that he did not intend to return to said residence. 9. To date, Defendant has refused to return Plaintiff's premarital personal property to him and has continued to wrongfully detain Plaintiff's said personal property. 10. On or about September 1B, 1996, a written letter of demand for the return of said items was forwarded to Defendant's attorney, Marcus McKnight, III, Esquire by Anne Shepard, Esquire who was acting as Plaintiff's legal counsel at that time. A copy of said letter is attached hereto as Exhibit "B", and is incorporated herein by referenced as if fully set forth. 11. To date, there has been no response to said demand letter from Defendant nor Defendant's counsel. 12. Defendant's continuing wrongful detention of said property has prevented Plaintiff from using same, all to Plaintiff's damage in an amount equal to Two Hundred Dollars ($200.00). On July 8, 1996, Donald C. Johnson instituted an action in Divorce against Cynthia D. Johnson in the Court of Common Pleas of Cumberland County at docket number 96- 3959. The Divorce complaint contains a count for Equitable Distribution. Attached is a true and correct copy of the Divorce complaint. 2. On October 231 1996 Donald C. Johnson instituled an action in Replevin againsl Cynthia D. Johnson in Ihe Court of Common Pleas of Cumberland County at the above docket number. 3. The Equitable Distribution claim in the Divorce action and the Replevin aclion both seek 10 determine property rights and interests belween Donald C. Johnson and Cynthia Johnson. 4. The Divorce action with Ihe Equitable Distribution claim has not been dismissed or disconlinued. 5. An action is subject to dismissal where there is a prior pending action and the pending action involves the same parties, pursues Identical rights and seeks the same relief. Lowenschuss v. In the instant casel the Divorce action and Ihe Replevin action involve the same parties, they both seek to determine identical property rights and interests and both seek Ihe same relief. 7. Addilionally, it has been held "that once a divorce action has been filed under The 1980 Divorce Code, replevin no longer lies against a spouse, even for the possession of allegedly separate property'. Kramer v. Kramer. 110 Mont. Co. L.R. 130. 138 (\982), WHEREFORE, Petitioner, Cynthia D. Johnson, respectfully requests this Honorable Court dismiss Ihe Replevin complaint filed by Donald C. It is admitted that the instant case involves the same parties as the Divorce action, but it is denied that both actions seek to determine identical property rights and interests as well as the same relief. In further answer thereof, the Equitable Distribution claim in the Divorce action seeks to equitably distribute the marital property of the parties and accordingly requests the pertinent relief therefor, while the Replevin action seeks to recover the premarital personal property of Plaintiff that has been wrongfully detained by Defendant, and requests the pertinent relief therefor. 7.
