3. Admitted. However, the Equitable Distribution claim in
the Divorce action seeks to equitably distribute the marital
property of the parties, while the Replevin action seeks to recover
the premarital personal property of Plaintiff that has been
wrongfully detained by Defendant.
4. Admitted.
5. Oenied. The allegations of paragraph 5 state a
conclusion of law ~o which no response is necessary and therefore,
the allegations of s~id paragraph are herein denied.
6. Admitted in part and denied in part. It is admitted that
the instant case involves the same parties as the Divorce action,
but it is denied that both actions seek to determine identical
property rights and interests as well as the same relief. In
further answer thereof, the Equitable Distribution claim in the
Divorce action seeks to equitably distribute the marital property
of the parties and accordingly requests the pertinent relief
therefor, while the Replevin action seeks to recover the premarital
personal property of Plaintiff that has been wrongfully detained by
Defendant, and requests the pertinent relief therefor.
7. Denied. The allegations of paragraph 7 are denied in as
much as same merely makes a statement of law to which no response
is necessary. Furthermore, the ca8e cited therein is denied in as
much as same speaks for itself.
