At a pretrial conference held Wednesday, August
26, 1998, before Edward 8. Guido, J., present f~r the Plaintiff
was W. Scott Sandusky, Esquire, and present for the Defendant
was C. William Shilling, Esquire.
The D~fendant has admitted liability. The issues
will be limited to damages only. The parties estimate this case
will take 2 to 2 1/2 days to try.
Defense counsel is unavailable on Thursday,
September 17, 199B, and Friday, September 1B, 199B. Therefore,
thie case must begin on Monday, September 14, 199B. Defenee
counsel has also alerted the Court that he is beginning a
federal trial the prior week, which should finish. If it does
not finish by Monday, this case will have to be postponed to the
November term of court. Both counsel will be deemed to be
attached to this Court from 1100 p.m. on Tuesday, November 10,
199B, for the balance of that week if that occurs.
The Defendant has indicated that he will be
calling a witness not listed in his pretrial memorandum. That
witness is Mark Lucas, a vocational expert. The Defendant shall
provide a copy of that witness's report to Plaintif.f's counsel
not later than September B, 199B.
This does not appear to be a complicated case
