MIKESELL, III, born october 13, 19a4; BREANN K. MIKESELL, born May 12, 1987; and MICHAEL THOMAS MIKESELL, born April 23, 1989, with the physical custody to be as follows; 1. Mother shall have primary physical custody of the parties minor children subject to Father/s periods of shared physical custody as hereinafter setforth. 2. Father shall have liberal visitation rights and in so doing shall have the option of having temporary physical custody of the minor children at his residence as follows; ~ a. The parties ....ecognize that there may be circumstances from time to time which may prevent the exercise of physical custody at the agreed date and times, Whe....efore, the parties agree that, absent eme....gency situations, each will give timely and reasonable notice to the other of the existence of such ci....cumstances. The parties further ag....ee that an equal amount of makeup physical custody time will be granted for any physical custody time which does not take place at the time or times agreed upon as set fo....th in this Consent Order. 4. MOTHER and FATHER shall consult with each other as often as may be necensary regarding matte....s pertaining to the CHILDREN which shall include, but are not limited to the followingt a. FATHER shall have the following ....ights with rospect to the CHILDREN t 1) reasonable telephone privileges, the CHILDREN shall be permitted to call their FATHER at least one time per -J- month. FA'l'Ill>H shall be permitted to contaot the ClllLOHEN by phone at reasonable hours during the munth. 2) nccese to roport cnrds and other relevnnt information concerning the progress of the CIIILIJHEN in schooll J) approval or oxtrnordinary mediclll/dental treatm~nt provided that such approval ahull not be unroasonubly withholdl 4) approval or summ~r camp and schools provided that such approval shall not be unroasonably withheld. b. In all matters relating to Michael T. Mikesell/s health and welfaro, it is expressly agreed and understood that WIFE will notify l'A'l'lIEH within twentY-l:our hours (24) of arranging for any medical appointment or consultation related to treatment, surgical procedures, treatment programs, application of a prosthesis device, therapy cr exercise rehabilitation or training programs designed to improve or assist in the use and funotion of the foot in connection with Michael's congenital birth defects otherwise known to both parties as (1) Macrodactyly of the first and second digits of the right foot and (2) a functional heart mummer. It is expressly agreed and understood that FA'I.'HER shall have an equal voice in granting or withholding upproval for any such procedures related thereto. Neithor party will unreasonably withhold approval. c. On all other matters relating to the CHILDREN'S heulth, education and welfare, MO'rtfW shall have the duty to confer with FATHER with a view to adopting a harmonious policy calculated to promote the best interests of the CIlILDHEN. This duty shall include the requirement that MOTIIER shall advise and discusB with FATHER all important Qvents in the CIlILDHEN'S life, inclUding, by -4- way of example, but not limited tOI school meetings, travol plans, medical conditions, oducational progress and plans, summer camp arrangements, oxtracurricular activities, vacations plans, eto. d. The residonce addross and telephone numbers where the CHILDREN may be reached shall, at all times, including vaoations, be known to the parties and each party shall immodiately notify the other by telephone, if possible, by telegrum if not, of any illness or other emergency that may arise while the CHILD or CHILDREN is/are in his or her custody. During such illness or other emerg~ncy, each party shall have the right to visit the affocted CHILD or CHILDREN as often us ho or she desires. The word "illness" as used herein shall mean any disability which confines the CHILD or CHILDREN to bed under the direction of a licensed physician for a period in excess of forty-eight hours or any serious injury to the CHILD or CHILDREN. e. Tho parties have negotiated the custody and partial custody portions of this Consent Order based upon the existing oircumstances, and in particular, based on the current residences of FATHER and MOTHER. If MOTHER or FATHER desire to establish residence elsewhere than the current residence, he or she shall give the other party at least sixty (60) days written notice in advance of his or her proposed move, in order to give the parties the opportunity to confer, prior. to his or her removal, and to establish a mutually satisfactory arrangement as to custody and visitation in light of the changed circumstances. Said not~ce shall not be considered vulid if it fails to give a firm moving date and proposed new address, In the event the parties are not -5- -, able to reaoh an agreement, they agree that the COURT OF COMMON PLEAS of Cumberland county, Pennsylvania shall have jurisdiction over them to fashion an appropriate oustody order eKoept BS provided herein. In the event MOTHER moves outside the Commonwealth of Pennsylvania, then the parties agrOQ that the court of common Pleus of the Pennsylvania county where FA'l'HER resides shall havo jurisdiction over them to fashion and appropriate custody order. f. The w~lfare and convenience of the CHILDREN shall have prime consideration of the parties in the application of the provisions of this Consent Order. g. Nothing in this Consent Order shall be construed as having any bearing us to the relative fitnoss of either party to be the primary custodial parent of the CHILDREN. 5. MO'l'HER and FA'rfIER shall Bhare equally any health insurance premiums, I If either FATHER or MOTHERS employer offers health insurance coverage, then the best policy available shall be maintained, If MOTHER's employer will only provide health insurance for the CHILDREN ut an additional cost to MOTHER, FA'l'HER will have the option to pay one halt tho additional cost for the CHILDREN under MOTHER'S employers plan or to maintain insurance for CHILDREN under his plan. 6. The parties agree and acknowledge that it is in the best interest of their CHILDREN that the parties share legal custody within the meaning and intent of the DOMESTIC RELATIONS CODE OF PENNSYLVANIA, 23 Pa.C.S, section 101 et seq. Tho parties hereto agree that in the evont thllt a child (or the children) wishes to chango his or her primary residence, the parties hereto shall thereafter file a modification to this Cnnsent Order with the appropriate Court. B. If either party breaches any provision of this Consent Order, the other party shall have the right, at his or her election, to sue for damage for such breach, or seek such other remedies or relief as may bp Ilvailable to him or her, and the party breaching this contruct shall be responsible for payment of legal fees and costs incurred by the other in enforcing their rights undor th is Consent Order.
