Plaintiff, Dauphin Deposit Bank and Tl:"ust Company (hereinafter "Dauphin"), is a Pennsylvania banking corporation organized and existing under the banking laws of the Commonwealth of Pennsylvania with a principal office located at 213 Market Street, Harrisburq, Dauphin County, Pennsylvania l7l05. 2. The Defendants, Pin-Hui Kuo and Kuei Ying Kuo, a/k/a Ying Kuei Kuo, a/k/a Wang Kuei Ying, are adult individuals, and husband and wife, whose last known address is 319 Hivner Road, Harrisbul:"g, Dauphin County, Pennsylvania l7l1l, 3. On or about April 24, 19B7, Def,ndants bOl:"rowed from and agreed to repay to Dauphin the !lum of Thirty-Eight Thousand and 00/l.00 Dollar's ($3B,OOO.00) ("Loan"). As security for the Loan, Defendants gave Dauphin a mortgage ("Mortgage") on that tract of land located in East Pennsboro Township, Cumberland County, Pennsylvania known as 840 Erford Road, Cumberland County. Pennsylvania ("Property"). At all times relevant hereto, Defendanta were and reml\ln thl.l liole ownera of the Property. 1\ daucrifJtion of tlla Property ltj attachad horl.lto, mlldo II pllrt 11llreof and marked Exhibit "A". On April 24, 19U7, the Mortgage WIIS recorded in the Office of the Recorder of DO'llds of CUlllberland County in Mortgage Book 661, Pllge 573. The Mortgage, os it ill contllined in the public records, is incorporllted herein by reference. 5. The Mortgllge WIIS never IIssigned by Dlluphin IInd is still held by it liS a valid and SUbsisting obligation of Defendanto. 6. Dlluphin believes and, therefore avers, thllt Defendants are the only party in interest with rospect to the Property. 7. Under the terms and conditions of the Mortgage and Note, Defelldllnts agreed to IIIl1ke monthly pllYlllcmts to Dlluphin in the amount of Four Hundred Two IInd 56/100 Dollars ($402.56) beginning June 1, 1987, IInd paYllble on the firat day of ellch succeBsive month thereafter. a. Defendants hllve breached the terms and conditions of the Mortgsge and Note and is in default under such terms and conditions becausa they have failed to make the required monthly payments in accordance with the terms thereof since November l, 1995. 9. Defendants are presently indebted to Dauphin in the amount of 'rwenty-Six Thousancl 'rhree Hundred Sixteen and 74/100 Dollarll ($26,3l6.74) itemized as followsl Principal Balllnce Interest to and including November l2, 1996 $21,469.33 $ 3,773.94 AttornBY 1reBs $-LJl.1L.i1. Dsfsndants also agreed under ths terms of ths Mortqage that in the svsnt of default thereunder thsy would pay, in addition to the charges lioted in paragraph 9 above, costs incurred by Dauphin as a result of the institution of these legal proceedings. 11. 'l'ho obligation owed by Defendants to Dauphin continues to accrUe thereon at the rate of $5.6l per day beginning November l3, 1996, through the datil of payment, including on and after the entry of judgment on this Complaint. l2, A Notice of Acceleration of Indebtedness was forwardl3d to Defendants on May lO, 1996, by certified mail, return receipt requested. A copy of the said Notice is attached hereto and marked as Exhibit "C". Defendants received said Notice on May 11, 1996. Postal Form 3811, ev idenc ing raceipt of the Notice, is attached hereto as Exhibit "D". l3. As set forth ebove, Deuphin hos made demand upon Defendants herein to cure the default under the aforesaid Mortgage and Note. However, Defendents have refused and failed and continue to refuse and fail to cure this default.
