(Complaint ~~ ],2-14). B. ALLEGED SUPPORTING FACT~ 1. In support of her claims for breach of implied contract of employment, Plaintiff allegea she was employed by the Company on February 13, 1996 aa Ita Center Director. (Complaint ~ 4). The Company evidenced its intent to create a contract of employment bas(~d on a memorandum which appointed Plaintiff alld six other individuals to the Harrisburg Global Vision ExecutIve Advisory Board for "one year renewable terms", (Complaint ~ 5 and Exhibit A to Complaint) . 2, Plaintiff provided additional consideration to support this implied contract by using an office in her home, a personal computer, home telephone, and utilities to conduct business on behalf of the Company, (Complaint ~~ 6 and 7) , 3. Plain",iff received positive performance reviews (Complaint ~ B) and was terminated from employment on May 24, 1996 without just cause. (Complaint ~~ Band 9 (c)), The implied contract contains a "just cause" termination provision, (Complaint , 10). Specifically, Plaintiff haa failed to allege facta aufficient to identify or establiah a contract between herself and the Company to serve as the Center Director. plaintiff haa also failed to allege additional consideration to support the implied contract of employment. or defeat the preaumpt ion of at -wi 11 employment aB the consideration alleged did not afford the employer anything other than the services which the Plaintiff was hired to perform. 4. Plaintiff's claims against the Company must, accordingly, be dismissed for failure to state a cause of action under Pa. R.C.p. No. 1028(a) (4). WHEREFORE the Defendant, Global SJ,ght (Pennsylvania), Inc., respectfully requests that this Court enter an Order sustaining its preliminary objection to Plaintiff's Complaint for legal insufficiency pursuant to Pa.
