G, At the aforementioned t.ime /lnd place, the Defendant
pulled her vehicle to the right berm of the roadway and then
immediately made 11 left hand turn in front of the vehicle of the
Plaintiff, Edward L, Shaffer, Jr. causing her vehicle to viol~ntly
collide with the vehicle of the Plaintiff,
7. 'rhe aforementioned violent collision Was the dl.rect
result of the Defendant's negligent and careless operation of her
motor vehicle in that the Defendant I
a) failed to observe the Plaintiff's vehicle before
colliding with itl
b) failed to signal her turn before making the turn in
front of the Plaintiff's vehiclel
c) nmking a left hand turn in front of the vehicle of
the Plaintiff colliding with the vehiclel
d) failing to observe Plaintiff's vehicle before
COlliding with itl
e) failing to apply her breaks so as to avoid a
collision with Plaintiff's vehicle I
f) in driving her vehicle into the vehicle of the
Plaintiffl
g) in viol at ing the provis ions of the Motor Vehicle
Code as it relates to turning movement~ and
required signals in that she made a left hand turn
from the right hand berm lane without aignalling
her action,
h) in ateering her vehicle into the path of the
Plaintiff I and
i) In failing to yield the right of way of the
southbound Route 114 to the Plaintiff's vehicle
which was lawfully within the travel portion of the
roadway and otherwise violating the provisions of
the Motor Vehicle Code.
8. As a result of the aforementioned collisioll, plaLntiff
suffered injuries which include but are not limited to the
following I
a) severe trauma to the nervous system,
b) trauma to the right elbow areal
c) bruising and severe shock to the right elbow areal
9, As a result of the aforementioned injuries, Plaintiff,
Edward L, Shaffer, Jr" did sustain great pain and SUffering and in
the future will undergo great pain and suffering,
10. As a result of the aforementioned injuries, Plaintiff,
Edward L, Shaffer, Jr" hall sustained a loss of life's pleallures
and continue to undergo a loss of life's pleasures,
11, As a result of the aforemention~d injuries, Plaintiff,
Edward L, Shaffer, Jr" sustained a loss of life's pleasures and
sustained inconvenience and will in the future will undergo same,
12, All a result of the aforementioned injuries, Plaintiff in
the future will undergo medical treatment and significant
discomf.ort .
WHEREFORE, I?laintif f prays this Court t.o nt'Bnt judgment
against the Defendant for the Plaintiff ie an amount in ~xceos of
$20,000.
COUNT II VIRONICA S. SHArraR v. BRIN K. HOOB~I~
13, paragraphs 1 through 12 are incot'poratfld herein and made
a part hereof by reference.
14, As 11 result of the Defendant's negligence, carelessness,
and recklessness as described above, plaintiff, Veronica S,
Shaffer, has been depdved of the companionship, affection,
assistance, services and consortium of her husband, Edwal:d L,
Shaffer, Jr" all of which has been to her great emotional and
financial damage and detriment,
WHEREFORE, Veronica S, Shaf fer prays the Court to gt'ant
jUdgment against the Defendant and in favor of the plaintiff in an
amount in excess of $20,000,00.

6. Denied. It in denied that the accident was caused
solely by the Plaintiff's improper pass of the Defendant's
vehiole.
7. Denied. It is denied that the collision between the two
vehioles was a direot result of the Plaintiff's negligent and
careless operation, and it is further denied thatl
(a) he attempted to improperly pass,
(b) he tailed to apply his brakes to avoid a oollision,
(0) he operated his vehicle into the path of the vehiole
operated by the Defendant,
(d) he tailed to operate his vehiole in a safe manner,
(e) he failed to assure that he could keep his vehicle in
such control as to be able to stop within the assured
clear distanoe ahead, and it is further denied that he
steered his vehicle into the path of the vehicle
operated by the Defendant,
(f) he failed to yield to the right of way to the
Defendant's vehicle.
8. Denied. It is denied that the accident was solely
caused by the negligence and carelessness of the Plaintiff,
EDWARD L. SHAFFER, JR.
9. Denied. It is denied that the Plaintiff was negligent
or careless and that the compsrative Negligence Act applies.
