I A hearing was held on Drtcember 30, 1996, for which husband was provided notice and did not appear. (6) A nonjury trial Is scheduled In the divorce case In Bay County, Florida, for January 16, 19~7. FACTS (1) In late May, 1994, the mother with Arlel and Christian, moved from Bay County, Florida, to the home of her parents, Gene and Ellie McDermond, at 62 East Main Street, Walnut Bottom, Cumberland County, Pennsylvania. (2) The mother and the two children continue to reside at that residence as they have continuously since late May, 1994. (3) Arlel Is a second grader at Oak Flat Elementary School In the Big Spring School Dlstrfctln Newville, Cumberland County. Christian ettends a Head Start Program In Shlppensburg, Cumberland County. (4) The divorce action flied In the State of Florida Is the only divorce action filed between the parties. (6) There is no custody order regarding the parties' children. There Is no written agreement between the parties regarding the custody of Arlel and Christian. (6) Husband has not seen, or attempted to see, his two children since they moved to Cumberland COLlnty, Pennsylvania In late May, 1994. 1, In Florida, at West's F.SA ~~ 61.1302 to 61.1346.m.2. 96.6274 CIVIl. DISCUSSION Based upon the children living conllnuously In Cumberland County since May, 1994, and the fact that virtually all evidence regarding their best welfare Is located In Cumbertand County, It appears, pursuant to tha Uniform Child Custody Jurisdiction Act at 23 Pa.C.S. Secllon 5344, that lI,is court is tha proper court of Jurisdiction to proceed on the mother's claim for an award of custody, However, Secllon 5347 of the Act provides: (a) General rule.--A court of this Commonwealth shall not exercise Its Jurisdiction under this subchapter If, at the time of filing the petition, a proceeding concerning the custody of the child was pendlnq In a court of another state exercising Jurisdiction substantially In conformity with this subchapter, unless the proceeding Is stayed by the court of the other state because this Commonwealth is a more appropriate forum or for other reas.:ms. Husband's claim for custody was Inlllated In conjuncllon with his divorce action In Bay County, Florida on August 7, 1996, prior to wife's filing for custody In this court on November 14, 1996. Accordingly, all proceedings will be stayed and the conclllallon conference scheduled for January 3, 1997, will be cancelled. Carpenter v. Carpenter, 326 Pa. Super. 570 (1984). First, I am ftquesting a 30-day extension of the deadline to me a more formal answer with the court so that I may obtain legal counsel in Florida. Currently, I live In Pennsylvania, and I am unemployed and on public I1.'lsistance. My husbwld, St.eve, is more Ulan $18,000 in arrears in paying court-ordered child support payments. I am on public assistance and do not have the funds with which to hire an attorney and need more time to find someone to lake my ca.~ on a pro bono basis. I had conl.1ctcd the Fanlily L'lW Clinic at TIle Dickinson School of Law in Carlisle, Pennsylvl1l1ia to file for divorce in Pennsylvania prior 10 being served with the papers for the action in Florida and was on a waiting list for more than a year. I finally had my first appointment on September 10, 1996. TIle Family Law Clinic is a Legal Services type of organlz.ation which provides frce legal services to indigent persons in domestic matters, After learning that I had bccn sued for divorce 111 Florida, the Family Law Clinic attempted to conl.1ct Legal Services of Northern Florida on severnl occasions, but Uleir office was closed and their voice-mail box was full so no message could be left. Second, I do not believe that r.his court has jurisdiction to resolve the matters of child custody and support. I do not believe the Florida court has jurisdiction based on the Uniform Child Custody lurisdiction Act. Pennsylvania has been the children's home for two years now, and they have significant connections WiUI Pennsylvwlia. For the last several YC<lrs Steve has not tried 10 talk 10 the children, remember their birthdays, or oUlerwise act as a father. Pennsylvwlia is already the jurisdiction of the existing Child Support Order.
