writing shall be attached to the pleading,

that it fails to stste whether the express warrsnties
allegedly breached by the Defendants were oral or written,
2) if the express warranties allegedly breached were
written, Pa.R.C.P. No. 1019(h) is further violated in that no
copy of the written express warranties was attachedl
b. Pa.R.C.P. No. 1019(f) requires that items of special
damages be specifically stated I
1) paragraph 9 of the complaint alleges Plaintiffs
have suffered financial loss, including consequential damages,
as a result of the Defendants' conduct,
2) paragraph 9 of the Complaint fails to state
specifically what consequential damages Plaintiffs have
sustained as a result of Defendant Gutshall's alleged conduct.
WHEREFORE, Defendant Hobert GutshaU respectfully request/il, in

5. Plaintiffs' Complaint avers that the silo unloader
"has failed to work", without further detailing the manner in which
the silo unloader has allegedly failed to work.
6. Plaintiffs' Complaint avers that they attempted to
have the silo unloader "problems" corrected, but that these
"problems" have not been correct, again, the alleged "problems"
have not been detailed.
7, Plaintiffs' Complaint avers that, as a result of
saJ.d "problems", Plaintiffs have suffered" financial loss", as well
as "consequential damages" I however, the alleged "losses" and
"damages" have not been detailed, nor has Plaintiff sought recovery
of a specific dollar amount.
8. As a matter of law, Plaintiffs' Complaint ml'at state
the material facts upon which its cause of action is based in a
concise and summary form. See Pa.R.C.P. 1019(a) ,
9. As a matter of law, Plaintiffs must plead averments
as to time, place and items of special damage, with specificity.
See Pa.R.C.P. 1019(f),
10. Plaintiffs aver in th~ir Complaint that Defendants
have violated o'ixpress and impl ied warranties, but have not
indicated the nature of the warranties, or the facts supporting the
exiatence of warranties or the facts supporting a breach of such
warranties.

to said warranty allegations is also a violation of the
aforementioned rules of court.

13, If any aspect of Plaintiffs' claim is based upon a
writing or other documents, such writing or documents must be

1.'1. Plaintiifs' Complaint seeks entry of judgment
against two Defendants.
15. Pa.R.C.P, 1020(a) and (b) specifically require that
causes of action against separate Defendants be plead in separate
counts, and that each cause of action against the same Defendant be
plead in the same count.
16. Plaintiffs have not alleged the factual basis for a
cause of action against Defendant, Freeman Farm Systems.
WHEREFORE, Defendant, Freeman Farm systems, respectfully
requests your Honorable Court to require Plaintiffs to file a more
specific pleading.

17. The averments of paragraphs 1 through 16 are
incorporated herein by reference as if textually set forth at

purohased the aforementioned silo unloader from Defendant, Robert

You are hereby notified to file a written response to the
enclosed New Matter within twenty (20) days from service hereof or
judgment may be entered against you.

(20) days from service hereof or judgment may be entered against

6. DENIED. It is speoifically denied that the silo unloader
faile-d to work. To the contrary, the oilo un loader performed
properly when installed by Defendant Gutshall. Any subsequent
problem with the operation of the un loader waf! the result of
Plaintiffs use of an improperly sized motor to power the unloader
in contravention of the specifications set forth in the April 20,
1994 contract.
7. DENIED. It is specifically denied that Defendant Gutshall
failed to correct "the problems." To the contrary, Defendant
Gutshall provided Plaintiffs with repair. service and replacement
parts when requested. Responsibility for matters arising out of the
design and manufacture of the un loader rest solely with the
manufacturer, Defendant Freeman Farm Systems.
e. DENIED. It is specifically denied that Defendant Gutshall
breached any implied warranty of merchante.bility or. any express
warranty. To the contrary, Plaintiffs use of an improperly sized
motor to power the unloader, in contravention of the specifications
set forth in the April 20, 1994 contract, negates any warranty,
express or implied, arising from the sale of the unloader. By way
of further answer, Defendant Gutshall made no express warranties to
Plaintiffs. All express warranties were in writing and were made
solely by the manufacturer of the unloader, Defendant Freeman Farm
Systems.

9. DENIED. It is specifically denied that Defendant Gutshall's
conduct cllused plaintiffs to suffer direct financial 101919 or
consequential damages. To the contrary, any direct financial loss
or consequential damages suffered by Plaintiffs arose from their
use of. an improperly sized motor to power the unloader, in
contravention of the specifications set forth in the April 20/ 1994
contr.act.
Count I - Breach of Contract - Blaser v. GutshaLl
10. The answers of Defendant Gutshall to paragraphs 1 through
9 are incorporated by reference as if fully set forth herein.
WHEREFORE, Robert Gutshall respectfully requests This
Honorable Court enter judgment in favor of Robert Gutshall and
against Plaintiffs.
Count I (sic) - Breach of Contract - Bloser v. FreemAn-
10 (sic). This count applies solely to Plaintiffs' cause Is) of
action against Defendant. Freeman Farm Systems I no response is
required of Defendant Gutshall.
~ MATTER
ADDRESSED TO PLAINTIFFS
12. The silo unloader operated without failure when first
installed by Defendant Gutshall.

13. Defendant Gutshall believee, and therefore avere, that he
had no oomplaints or eervice calls from Plaintiffs for the first
three (3) or four (Ii) months after installation of the silo
unloader.
14. The contract formed on April 20, 1994 betwaen Plaintiffs
and Defendant Gutshall specified that Plaintiffs were to furnish a
five (5) horsepower motor to provide power to operate the silo
unloader. A true and correct copy of said contract is attached
hareto as Exhibit A.
15. Defendant Gutshall believes, and therefore avers, that
Plaintiffs used a seven-and-one-half (7.5) horsepower motor to
provide the power to operate the silo unloader instead of the five
(5) horsepower motor specified in the contract.
16. Defendant Gutshall believes, and therefore avers, that
Plaintiffs' use of a aeven-and-one-half (7,5) horsepower motor,
instead of the five (5) horsepower motor specified in the contract,
caused the problems with the silo unloader of which Plaintiffs
complain.
17. Defendant Gutshall believes, and therefore avers, that
Plaintiffs' use of the sevon-and-one-half 17.5) horsepower motor to
power the silo unloader caused the unloader to operate at speeds in
excess of its designed capacity, causing wear and tear in excess of
that normally expected and premature destruction of components.

18, Defendant Gutshall believes, and therefor avers, that
Plaintiffs only contacted him three (3) times concerning problems
with the silo unloader.
19, When requested, Defendant Gutshall provided Plaintiffs
with repair services and additional parts, such as chains, to
replace parts damaged due to the excessive wear and tear caused by
plaintiffs' use of the improperly sized motor.
20, Plaintiffs' use of a seven-and-one-half 17.5) horsepower
motor, instead of the five (5) horsepower motor set forth
in the contract, to provide power to operate the silo unloader,
negates any implied warranty of merchantability or fitness for a
particular purpose which would otherwise arise as a result of the
sale of the Freeman Farm Systems silo unloader to Plaintiffs,
21. Defendant Gutshall made no express warranty to Plaintiffs
regarding the operation of the silo unloader.
22. All express warranties made to Plaintiffs regarding the
operation of the silo unloader were in written form, prepared by
Defendant Freeman Farm Systemo and given to Plaintiffs at the time
of the installation of the silo unloader on July 20, 1994.
WHEREFORE, Defendant Robert Gutshall respectfully requests
this Honorable Court enter judgment in his favor and against
Plaintiffs.

Robert. Gul:ahall v, Freeman Farm Systems
Robert Gutshall, asserts this New Matter pursuant to Pa, R, C. P,
No. 2252(d) and joins Defendant Freeman Farm Systems as an
additional defendant in this action on the following basisl
23, If Plaintiffs establish that tbey suffered the damages
alleged in tbeir complaint, which allegations Robert Gutshall
denies, such damages are solely the responsibility of Freeman Farm
Systems in thatl
a. Freeman Farm Systems designed and manufactured the silo
unloader sold to Plaintiffs,
b. Freeman Fann Systems provided express written warranties
regarding the operaticn of the unloader,
c. Freeman Farm Systems failed to render technical assistance
and support when Plaintiffs and Robert Gutshall both requested
assistance to correct various alleged operating problems with the
unloader.
24. In the alternative, if, as a result of the matters alleged
in Plaintiffs' Amended Complaint, Robert Gutshall is held liable to
Plaintiffs for all or part of the damages they may have sustained,
Freeman Farm Systems is the party primarily liable for such damages
and is liable over to Robert Gutshall by way of contributi~n and/or

indemnifioation for all such damagell which Robert Gutshall may be
required to pay Plaintiffs.
25. In the alternative, if as a result of the matters alleged
in Plaintiffs' Amended Complaint, Robert Gutshall is held liable
for all or part of the damages Plaintiff may have sustained,
Freeman Farm Systems is jointly and/or severably liable to
Plaintiffs based upon the foregoing allegations and liable over to
Robert Gutshall by way of contribution for all such damages Robert
Gutshall maybe required to pay Plaintiffs.
WHEREFORE,
Robert Gutshall respectfully requests this
Honorable Court enter judgment that, if there is any liability to
plaintiffs, Freeman Farm Systems is solely liable to Plaintiffs, In
the event a verdict is recovered by Plaintiffs against Robert
Gutshall, then Robert Gutshall may have judgment over against
Freeman Farm Systems by way of indemnification and/or contribution
for the amount recovered by Plaintiffs together with costs.

it ia a result of Plaintiffs utilizing the silo unloader in an

with the silo unloader. However, if it is demonstrated that there

FREEMAN.
