plus all future accruing interest until paid in full (Eighty-
Nine Dollars and Ninety-Three Cents ($89.93) per diem), a
reasonable attorneys' commission. together with costB of suit
and all other amounts, fees, and costs incidental to execution
and levy in accordance with the attached certified copies of all

AND NOW comeB the Plaintiff, NICHOLAS 'I'SAUKALIS, by and
through hiB attorney, the LAW OFFICES OF 'l'IMOTHY A.
SHOLLENBERGER, and does respectfully repreBent the
following 1
1. 'I'he Plaintiff, NICHOLAS TSAUl<ALIS, iB an adult
individual who currently reside/J at 1105 Columbus Avenue,
Apartment 7, Lemoyne, Cumberland County, Pennsylvania 17043.
2. The Defendant, William Patrick Duffy, is an adult
individual who currently resideB at 1113 8, Powderhorn Road,
Mechanicsburg, cumberland County, Pennsylvania 17055.
3. The facts and circumstances hereinafter Bet forth
took place on January 6, 1996, at or about 6106 p.m., on
Route 15 South at the 581 Bxit, Cumberland County,
Pennsylvania.
4. At the aforesaid time and place, there were no
adverBe weather conditione.
5. At the aforesaid time and place, the Plaintiff,
NICHOLAS TSAUKALIS, was a right front seat paBBenger in a
1993 Ford Sedan
operated by Lazaros Panayiotou.
6. At the aforesaid time and place, Defendant. WILLIAM
PATRICK DUFFY, was operating a 1991 Honda Civic Sedan.
7. At the aforesaid time and place, the car occupied
by Plaintiff, NICHOLAS TSAUKALIS, was travelling in the
southbound Lane of Route 15 at or near the entrance ramp to
route 581 in East Pennsboro Township, cumberland County,
Pennsylvania.
8, At the above referenced time and place, Defendant,
WILLIAM PATRICK DUFFY, was travelling behind the vehicle in

which Plaintiff was a passenger, when suddenly, and without
any warning, he struck the rear of that vehicle.
9, The aforesaid colliBion was a direct and proximate
rl!lBult of the negligence of Defendant, WILLIAM pA'rIUcl<
DUFFY, in operating hiB vehicle in a careleBs, reckless and
negligent manner aB folluwsl
(a) In failing to h,we hia vehicle under propel:
and adequate cantral,
(b) In fail ing to operate his vehicle at a speed
and in such a manner so as to be able to stop
within the assured clear distance ahead in
violation of Section 3361 of the Pennsylvania
Motor Vehicle Codel
(c) In operating his vehicle in careless
disregard for the lives and property of
others in violation of Section 3714 of the
Pennsylvania Motor Vehicle Codel
(d) In fa.iling to apply his brakes in time to
avoid a collision,

strike and collide with the rear of the
vehicle in which the Plaintiff. was a
pasBengerl
(f) In failing to keep a proper lookout for and
Bee the vehicle J.n which Plaintiff was a
pasBenger prior to the collisionl
(g) In failing to operate his vehicle at a speed
and in such a manner so as to be able to Btop
within the assured clear dJ.stance ahead in
violation of Section 3361 of the Pennsylvania
Motor Vehicle Code I and,

(h) In otherwise operating said vehicle in a
careless, reckless, and negligent manner and
in a manner violating the Motor Vehicle Code
of the Commonwealth of Pennsylvania.
10. As a result of the aforesaid collision, Plaintiff
NICHOLAS TSAUKALIS, haB suffered serious and permanent
injurieB, including by not limited to the following:
(a) Severe strain and sprain of the muscles,
tendon, ligaments and other soft tlssueB at
or about the cervical spinel

(b) Severe strain and sprain of the muscleu,
tendon, ligaments and other soft tissues at
or about the thoracic spinel
(c) Severe strain and sprain of the musclea,
tendon, ligamenta and other soft tissues at
or about the lumbar spine,
(d) Post-concussive syndrome I
(e) Severe shock to the nerves and nervous
system,
(f) Extreme mental and physical anguish with
resultant
hyperviligance and phobic reaction while
travelling in a motor vehicle I and,
(g) Prostatitis and secondary impotence.
11. As a result of the aforesaid injuries, Plaintiff,
NICHOLAS TSAU1<AL!S, has undergone and in the future will
undergo great pain and SUffering for which damages are
claimed.
12. As a further result of the aforesaid injuries,
Plaintiff, NICHOLAS TSAUl<AI,IS, has suffered and may continue
to suffer a loss of earnings and earning capacity for which
damages ar.e claimed.
13. As a further result of the aforesaid injuries,
Plaintiff, NICHOLAS TSAUKALIS, has sustained a permanent
diminution in her ability to enjoy life and life's pleasures
for which damages are claimed,
11. As a further result of this collision, Plaintiff,
NICHOLAS TSAUKALIS, has and may in the future incur
reasonable and necessary medical and rehabilitative costs
and expenses in excess in the amounts paid or payable
pursuant to Subchapter B of the Pennsylvania Motor Vehicle
Pinancial Responsib~lity Law,
Workers' Compensation or any program, group contract, or
other arrangement for payment of benefits as defined in
75 Pa, C.S.A. Section 1719.16,
15. As a further result of the aforesaid injuries,
Plaintiff, NICHOLAS TSAUl<ALIS, has incurred or may

2. Paragraph 2 of the Defendant's New Matter is in the
nature of a conclusion of law and to that extent requires no
answer. To thE extent that an answer is required, the
Plaintiff is, after reasonable investigation, without
suff.icJ.ent Imowledge to form a belief of truth of said
averments. Said averments are therefore denied and strict
proof thereof is demanded at the time of trial.
3, Paragraph 3 of the Defendant's New Matter is in the
