J~ IiIHORANDUH OPINION /UtD ORDER or COURT Plaintiff filed a meohanic' Ii lien claim on November lB, 1996, and on December 5, 1996, filed a Complaint for enforoement of the olaim. Defendant initially filed preliminary objeotion. (Jl\ Deoember 29, 1996, and lIubllequently withdrew them. Defendant then filed an Anllwer and Counterclaim on April 3, 1997. On April 7, 1997, the Honorable George E. Hoffer granted defendant's Petition for Interpleader of I C Contracting Group adding I C to the reoord all a party plaintiff. Thill order was vaoated on April 15, 1997, to allow plaintiff to file an Bnllwer to the petition. Plaintiff filed a preliminary objection in the nature of a demurrer to defendant.'e Counterclaim on April 11, 1997, and filsd an Answer to Def.endant'lI Petition for Interpleader with New Hatter on April 22, 1997. Argument was to be held on Hay 2B, 1997, with regard to plaintiff'lI preliminary objeotion to defendant's Counterolaim. On that date, defendant praeoiped to have the Counterclaim and Petition for Interpleader (milltakenly referred to in the praecipe a. Complaint in Interpleader) withdrawn.
