payment for the months of Maroh, April, September, ootober,
November Bnd Deoember, 1996. Tho Defendants also failed to
pay the l.ate charge of 'l'wenty ond 00/100 Dolldra (1$20.00) per
month assessed pursuant to the terms of the oral Leaso
Agreement for thoso months in which rent was not puid. Tho
unpaid monthly rental payments, as well as the late charges,

cpinion of the Plaintiff, represents a substantial
violation and material non-complianoe with the
terms of the Defendants' orel Lease Agreement, and
RUles and Regulations of The Meadows Mo~ile Home
Park.
12. On or about September 4/ 1~96, the Defendants were
properly served in accordance with the Pennsylvania Hobile
Home Park Rights Act/ 60 P.S. ~390.3/ by the Plaintiff with a
Firat Notice of Non-Pftyment of Rent which the Defendants
received by certified mail on september II, 1996. ^ true and
oorrect copy of the First Notice of Non-Payment of Rent is
attached hereto, made part her.eof and incorporated by
reference as Plaintiff's Exhibit >>P-1>>. ^ true and correct
copy of the certified mail receipt card evidencing Defendants
receipt of Plaintiff's Notice is attached hereto, made part
hereof and incorporated by reference as Plaintiff's Exhibit
>>P-2>>.
13. On or about October 2, 1996/ the Defendants were
properly served in accordance with the Pennsylvania Hobile
Home Park Rights Act, 60 P.S. ~390.3, by the Plaintiff with a

responsibility to provide a habitable p~emises to the
Defendants and i. of the belief and therefore avers that the
premises being occupied by the Defendants are in such a state
as not to violate the implied warranty of habitability owed by

forfeitul:'e and tQrmination of the oral Leas6 Agreement.
WHEREFORE, Plaintif.f demands entry of judgment in favor
of Plaintiff, BARBCO, INC., and against the Defendants, DAVID
JUMPER and DEBRA JUMPER, on the issues cf other good cause to
terminatfl the oral Lease Agreement and mat',erial non-compliance
with the ter.ms of the oral Lease Agreement, Rules and
Regulations of The Meadows Mobile Home Park, and further
Plaintiff demands it be granted possession of the lot located
at 23 Park streett Mount Holly springs, Cumberland County,
Pennsylvania, together with costs and interest.

COME NOW the Dehndants, David Jumper and Debra Jumper, by
counsel, Philip c. Briganti, Esquire, Legal Services, Inc" and
as their AnsWe~ to Plaintiff's Complaint, state as folloWst
1. Admitted.

4. Admitted in part and denied in part. Defendants admit
that in or abcut September, 1988, they entered into a lease
agreement with Plaintiff to rent the said mobile home lot.
However, Defendal,ts deny that this is a month-to-month lease, but
rather aver that the lea so is perpetual and of indefinite
duration, unless terminated for the grounds and under the
procedllre set forth under the Mobile Home Park Rights Act, G8
P.S. Section 398.1 ~ ~ Moreover, Defendants deny that the
original lease was oral, and aver that it was written.
5. Admitted in part and denied in part. Defendants admit
that they agreed to pay $195.00 per month for lot rent, but deny
that they agreed to pay a $20,00 late fee if the rent was not
paid by the fifth day of each month. Defendants deny that the
parties' agreement with Plaintiff requires that the rent is due
and owing on the first day ot each monthl rather, the part idS
agrQed that the rent is due on tho fifth day of each month.
Defendants deny that they agreed to abide by the torms of any
lease agreement, exoept that they would pay the rent as stated
above, and their monthly water, sower and trash oharges.

their belief and knowledge, Defendants have paid rent tor all
months except April, october and December 1996. Defendants deny
that they owe rent for any other months. They admit that they
have not paid the enumerated late charges, but deny that said
charges are permissible .

that they did not pay the monthly rent for April, October and
Deoember 1996 in a timely manner.. Defendants dony that the rent
payments for. March, September and November, 1996 were not mode in
8 timely manner, as they do not recall whether the payments were
mado in a timely manner, and after reasonable investigation are
unable to determine their timeliness.

10. Defendants repeat and incorporate by reference their
averments set forth above in Paragraphs 1 through 9.
11. Denied. Defendants, after reasonable investigation,
are without sufficient knowledge or information to determine
whether George J, Adams, after a review of Defendants' rental
history, reached a decision to terminate the Defendant's lease
agreement and/or not renew their lease, for the reasons described
in Varaqraphs 111a) through 111f) of Plaintiff/s complaint. The
averments set forth in Paragraphs 111a) through 111f) of
Plaintiff/s complaint oonstitute oonclusions of faot and/or law
to whioh no response is requiredl however, if it is judioially
determined that a response is required/ Defendants speoifioally
deny said averments. Defendants repeat and inoorporate by
reference their averments set forth above in Paragraphs 1 through
10.

Plaintiff has breaohed the implied warranty of habitability by
failing to fill or effectively cordon off several sinkholes
looated within "The Meadows" mobile home park, and by failing to
repair broken windows in a sewage pumping facility located within
the park, which pose safety hazards to Defendants, their
children and other park residents.
17. Denied. The averments set forth in Paragraph 17 of
Plaintiffs Complaint constitute a conclusion of law and/or fact
to which no response is required. If it is judicially determined
that a response is required, Defendants deny these averments.

19. Deni~d. Defendants have paid rent in the past. They
deny that they have failed to pay a late fee of $20.00 per month
for eaoh month rent allegedly was not paid, as no lnte fee was
due. Moreover, ae set forth below in their New Matter,

failed to pay for water, sewer., and trash servioes.

Plaintiff oonstitute an unenforceable penalty for the alleged
late payment of rent, in that they are exceseive and do not bear
a rational relationehip to Plaintiff'e actual or reaeonably
anticipated loeeee from the late payment qf rent.
22. Defendante never agreed to pay late chargee.
23. Any purported park rulee and regulatione whioh
Plaintiff cl~ime Defendante violated are unenforceable, beoBuee
said rules and ragulatione are not posted in a conspicuous and
readily accessible place within "The Meadows" mobile home park,
in violation of 68 P.S. Section 398.4,
24. Plaintiff hae breached the implied warranty of.
habitability by failing, after reaeonable notice, to fill or
effectively cordon off eeveral einkholea located within "The
Meadowe" mobile home park, or repair broken windowe in a eewage
pumping facility located within the park, which poee eafety
hazards to Defendants, their children and other park residents,
thus reducing the value of the rental premises and entitling
Defendants to an offset against any unpaid rent and or other
oharges.
WHEREFORE, Defendants respectfully request that judgment be
