2. Defendant ill Kenneth E. IHumanstock who resides at
125 Elm Street, Carlisle, Cumberland County, Pennsylvania.
3. Pl.aintiff and defendant have been bona fide
reaidents in the Commonwealth of Pennsylvania for at least
six (6) months immediately previous to the filing of this
complaint.
4. The plaintiff and defendant were married February
14, 1976 in Carlisle, PennBylvania.
5. There have been no prior actions of divorce or for
annulment between the parties.
6. Plaintiff avers that the grounds on which the
action is nased is that the marriage is irretrievably
brokon.

Two children were born of the marriage, l(endra J.
lllumanstock, born July ;;lO, 1976 and Tara M. Blumanstock,
born August 8, 1900.
'I'he parties separated October 27, 1996, whan J<enneth E.
Blumanstock left the marital premises.
The madtal residence was sold on June 26, 1997 for
$90,000.
The net cash to the seller was $7,446.82.
That
amount plus some additional deposits from sale of household
items and a tax escrow refund in the amount of $648.33 are
in the IOLTA escrow account of Frances n. Pel Puca for a
total of $8,195.15.
'I'he Domestic Relations Section determined that as of
April 30, 1997, Michele A. Blumanstock had a monthly net
income of $1299 and defendant, Kenneth E. Blumanstock had a
monthly net income of $1,602.

This was date that we set for B pro-hearing conferenoe to review
the pre-trial statements filed by counsel in tho above
referenoed divorce prooeedings. However, after discusaion and
review of the information provided in the pre-trial statements,
counsel have been able to work out the issue of equitable
distribution which ia before the Manter,
Mr. Blumnnstock appeared today with his counsel at
the initial meeting Bnd then MrS. Blumanstock appeared
subsequently to confirm the understanding that we have reached
with respect to the settlement.
Present in the hearing room are the plaintiff,
Michele A. Blumanstock and her counnel Frances It. Del Puca, and
the Defendant, Kenneth E, Blumanstock, and his counsel Robert J.
MUlderlg.
We ore going to place on the rocord, in the
presenoe of the partie~, the agreement which has bsen worked out
with respect to the economic claim of equitable distribution.
That agreement will be stated on the record in tho presence of
the parties and will be considered the substantive agreement of
the parties not subjeot to any ohanges or modifioations exoept
tor oorreotion ot typographical errors which may be made during
the transoription. The parties are advised that upon the
reoitation of the agreement on the record, there will be no
opportunity for any changes of dny substantive nature with
respeot to the agreement and when they leuve here today, the
agreement as stated on the record will be the agreement that
will be oonfirmed by the Court oven though there is no signing
of the agreement by way of affirmation of the terms atated,
The Master will then be able to pr~paro an ordor to
the Court vacating hia appointment and counsel will then prepare
a praeoipe transmitting the record to the Court along with the
affidavits of consent and waivers of notice of intention to
request entry of divorce decree SO that the divorce can be
oonoluded under Section 3301(C) of the Domestic Relations Code,
This action waa commenced by a divorce complaint
filed on November 20, 1996. The complaint was served on Mr,
Blumanstock and he has prepared an acceptance of service
indicating that he received the complaint personally on November
25, 1996.
The complaint raised the grounds for divorce of
irretrievable breakdown of the marriage and as indicated, the
parties have signed the appropriate documents to allow the
divoroe to proceed under Section 3301(c) of the Domestic
Relations Code. The complaint also raised the economic claim of

equitable distribution. No other eoonomio issues haVE been
rai.ed in the prooeedings.
'rhe parties wore marr.ied 011 l'ebrulll:"Y 14, 1976, and
separated Ootober 26, 1996. They Bra the natural parents of two
ohildren, one ohild, I<endra, is emanoipated, alld the child, 'l'ara
will be a senior in high school, Mr. MUlderig,
MR. MULD~:JnGI 'l'he parties have agreed to the
tollowing distribution of the assets I
1. The parties have divided their household goods to their
mutual satisfaction and the parties agree that the
household gooda curr.ently in possession of each party
ahall be the solo property of the party who has
possession with no claims by the other party on said
propel:"ty.
2. There exists an escrow account in tho possession of
Frances II. Del Ducil, Attorney at La 'II , from the sale of
the marital homo. Tho parties agree that the hUsband
shall receivo $2,000,00 froln said escrow account and wife
shall rocoive the romaining $6,195,15,
3. Wife shall be tho solo and exclusivo owner of her
pensions with Giant Food corporation, the husband shall
be the sole and oxclusivo owner of his pension plan with
Lsar Industries.
4. There are two cemetary plots with Cumborland Valley
Memorial Gardens which shall be the sole and exclusive
property of the wife and husband will sign any documents
neoessary to transfer title to said plots.
6. Wife shall have the sole and exclusive ownership of a
1985 Dodge Caravan and husband shall sign any documents
necessary to transfer title to said vehicle to wife.
6. Wife shall become the sole and exclusive owner of the
Harris chocking account, the Harris Savings account, and
the Member's 1st account.
Huaband shall become the Bole and exclusive owner of the
United Telephone credit: Union acoount.
7. Husband shall aocept responsibility tor the dobts owed
to Burkholder, Kay Joweler's, citgo, and American Ueneral
..inanoe.
Wite shall accept responsibility tor the dobts owed to
Carlisle Hoapital and Arnold/s Fuol company.
E,oh party agrees to indemnity and hold the other
sate trom Bny liability on these dobts or any other dobts
that either party may have incurred in their name since
BBparation.
8. Exoept as heroin otherwiae provided, each party may
dispose of his or her property ill any way and each party
hereby waiveB and relinquishes any and all rights he or
she may now have or hereafter acquire under the preBent
or future laws ot any jurisdiction to share in the
property O~ the estate ot tha other 6S a result ot the
marital relationship including without limitation,
statutory allowance, widow/s allowance, right ot
intestacy, right to take against the will ot the other,
and right to act as adminiatrator or executor in the
other's estate. Each will at the request of the other
exeoute/ acknowledge, and deliver any and all instruments
which may be necessary or advisable to carry into effect
this mutual waiver and relinquishment of all such
interests, rights, and claims.
