O~- }~O~O ~ A~ STIPULATION AGAINST LIENS WHEREAS, the Owners, TRENT K. HYERS and PATRICIA D. MYERS, are about to execute contemporaneously herewith a contract with D & E CONSTRUCTION, on the construction of a single-dwelling home situate on 1316 Indian Peg Road, Monroe Township, Cumberland County, Pennsylvania, as more fully described on the attached EXHIBIT "A", which is incorporated herein by reference. NOW, October 16, 2002, at the time of and immediately before the execution of the principal contract, and before any authority has been given by said Owner to the said Contractor to commence work on the said or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar, to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any sub-contractor, nor by any of the material men or workmen or any other persons for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. WITNESS, our hands and seals Signed, Sealed and Delivered in the presence of the day and year aforesaid. WITNESS D & E CONSTRUCTION EXHIBIT "A" .ALL THAT CERTAIN piece or parcel of land situate in Monroe Township, Cumberland County and State of Pennsylvania, bounded and described as follows, to wit: BEGINNING at a point stone at the corner of lands of the heirs of John Gutshall and of Joseph Bosler, thence South 21 1/2 degrees East, 84 perches to a stone; thence by sundry mountain lots South 69 degrees West, 10 perches to a stone; thence by land of Joseph Bosler North 21 1/2 degrees West 84 2/10 perches to a stone; thence north 69 1/2 degrees East 10 3/10 perches to the place of BEGINNING. CONTAINING Five (5) acres and forty-five (45) perches neat measure.
