Schneider (or another agreed upon professional) complete a custody evaluation, J, Shortly after. the custody conference, the Father rescheduled his visit with the child from April G to the week of May 18, Ii, Immediately therl!ll(ter Mother scheduled appointments for the parties with PI.', Schneider for purposes of trying to agree \Ipon long term custodial arranqomentll pursuant to the Court Order, 7, On or about Thursday, May 15 Father telephoned Plaintiff to advise her he was cancelling the May 10 visit with the child, The Father haa not visited with the child since January, 1997, 0, Following the cancellation of the scheduled visit, Mother decided to make arrangements with PI.', Schneider's office for a custody evalufltion to be completed prior to the Court hearing and the undersigned advised Attorney Gilroy, 9. In order for PI.', Schneider to complete n custody evaluation, the Father, must coopernte and meet with Pl.'. Schneider, 10, PI.', Schneider'S office has advised the undersigned that Pl.'. NOW THIS AGREEMENT WITNESSETH THAT: WHEREAS, the Father and Mother are the parents of one minor child, namely, Rayvn Marie Barth (age 10 years, born October 17, 1994) (hereinafter referred to as "child"); and, WHEREAS, Mother initiated the instant action in custody by complaint filed on or about November 27, 1996 at the above term and number, and, WHEREAS, the parties wish to enter into a custody agreement relative to Father's ternporaryvisitation and physical custody of the child in WISCOnsin; and, NOW, THEREFORE, in consideration of the mutual covenants, promises and agreements as hereinafter set forth and intending to be legally bOWld, the parties hereto agree as follows: A The Mother shall continue to have legal custody of the minor child. B. The Mother shall have primary physical custody of the child. C. The Father will have, by virtue of this agreernent, a period of visitation with the child, in accordance with the following terms and conditions: 1. Mother shall transfer custody of the child to the paternal grandparents, Robert and Kathleen Barth (hereinafter" Grandparents") on July 30, 2005, in Holiday Gty, Ohio. 2. Mother shall meet Grandparents on the morning of July 30, 2005, where the parties shall spend some time together to enable the child to have some transition while all parties are still present. If the child exhibits anxiety or expresses reluctance to go through with the visit, Mother shall retain custody of the child and return to Pennsylvania. 3. Following the initial transition, if the child exhibits or expresses any anxiety or significant manifestations of homesickness during the course of the visit while traveling to or while in WISconsin, Grandparents shall immediately contact Mother and arrange for the immediate return of the child to the custody of Mother. 4. In the event that no such difficulties as contemplated in paragraphs two or three hereof occur, Grandparents shall return physical custody of the child to Mother on August 5,2005 at the same location in HolidayGty, Ohio. 5. During the time while the child is in the physical custody of Grandparents, Father shall have supervised visitation with the child and shall not be pennitted to exercise unsupervised custody of the child. 6. Moreover, Grandparents shall not relinquish physical custody of the child to any other party without the prior consent of Mother. 7. Based upon the specific medical needs of the child the following provisions are also hereby agreed to and acknowledged: a. During the visitation period, should the child become ill or medical treatment is deemed necessary, Grandparents agree to immediately take the child to the nearest medical facility for treatment. Grandparents shall call Mother at the earliest possible opportunity to inform her of the situation. Should the child require medical treatment, Grandparents agree to pay any required out-of-pocket costs to the medical providers and obtain a receipt for payment from said providers. Mother shall be given the receipt and shall submit the same to her medical insurance provider. Upon Mother's receipt of reimbursement from her insurance carrier, Mother agrees to forward said reimbursement to Grandparents. Nothing contained herein shall be construed to convey the authority to consent to medical treatment, other than the granting of authority to the Grandparents to authorize initial emergency medical treatment for the child. No other medical decisions shall be made by Grandparents or Father without the express consent of Mother wlllch shall be obtained either in writing or by direct telephone communication between the medical provider and Mother. b. Due to the fact that the child has an existing heart condition, a copy of her medical alert card will be provided to Grandparents in the event they should require it for medical treatment during the visitation period. If any emergency dental needs arise, Grandparents acknowledge that the child cannot have treatment without anubiotics being administered one hour (1) prior to said treatment due to her heart condition. Mother shall provide said antibiotics to Grandparents in Ohio, which shall be returned to Mother with the child on August 5,2005. 8. Grandparents and Father hereby acknowledge that said visit is taking place during the period of time which Mother had set aside to obtain new school clothes and supplies for the child, and that the costs of traveling to and from Ohio to accommodate this visit will put an additional financial strain on Mother. Therefore, Grandparents and Father agree that during the period of said visit, they shall take the child shopping for new school clothes and supplies. 9. Because this visitation represents the first time that the child is being released to the custody of Grandparents for a period of time in WISconsin, Grandparents agree to provide Mother with a tentative schedule of activities planned for the visit. Said schedule shall be subject to change but significant changes shall be confirmed with Mother. This schedule shall allow Mother to be informed as to the child's well-being and whereabouts and to avoid disrupting special activities with communications between the child and Mother. 10. The Grandparents, while not parties hereto, have executed the attached acknowledgment and statement subjecting themselves to the authority of this agreement and to the jurisdiction of the Court for enforcement of the foregoing agreement. (A true and correct copy of said agreement is attached hereto and incorporated herein as Exhibit A.) D. Mother shall have reasonable telephone contact with the child while the child is in the custody of Grandparents. In accordance with this provision, Mother shall provide the child with a cellular telephone to be used for the sole purpose of communication between Mother and the child. Mother has provided Grandparents with her home and cellular telephone numbers and Mother has Grandparent's home and cellular telephone numbers. E. In addition to the special provisions provided herein concerning the child's health, the Grandparents and Father shall keep each Mother advised immediately relative to any emergencies concerning the child and shall further take any necessary steps to insure that the health, welfare and well being of the child is protected at all times. F. The parties agree that they shall do nothing that may estrange the child from the other parties or hinder the natural development of the child's love or affection for the other parties. G. In the event of the breach of the agreement of the parties by any party, the nonbreaching party shall have the right to file a petition for contempt of court and to seek specific performance of the terms of the agreement of the parties. All costs, expenses and reasonable attorney fees incurred by the successful party in any litigation to obtain an order of conternpt or specific performance of this agreement shall be recoverable as part of the judgment entered by the court. H While the parties are free to modify the provisions of this stipulation by their mutual and complete agreement, any substantial modification or waiver of any of the provisions of the agreement of the parties shall be effective only if made in writing and only if executed with the same fonnalityof this agreement entered into by the parties. 1. The Court of Common Pleas of Cumberland County has jurisdiction over these issues and shall retain such jurisdiction should circumstances change and any party desire further or require further modification of said Order. VERIFICATION AND CONEIRMATION OF AGREEMENT We do hereby verify that the acts set forth in this stipulation are true and correct. We understand that false statements herein are made subject to the penalties of 18 Pa.C.S. ~ 4904, relating to unsworn falsification to authorities. Furthermore, by the execution of this Confirmation, we do each unequivocally express our mutual and voluntary agreement to the amicable custody arrangement provided above and request that the terms thereof be entered as an Order of Court without the necessity of a custody conciliation, hearing or other proceeding.
