A. Defendante were to pay Plaintiffe ae rent the sum of Three
Thousand six Hundred Forty and 00/100 ($3,640.001 on or before the
sixth day of eaoh and every month and if not so paid, a five per
cent (5\) penalty wae due and owing.
B. Paragraph 10 of the Lease Agreement provided that Defendants
were to pay all expenses and oosts including utilities, real estate
tUIII, inlurenoe, interior and eltterior repair, janitorial
.erville., tralh removlll, alterationl, Itruotural repaire, and
maintenanoe arilillg out of the operation of any ~ulinell looated on
the premieel.
c. Paragraph 12(Al .peoifioally provided that Pefendante were to
onoe each leaee term paint the exterior of the building on the
premieee.
D. l'aragraph 12(131 IIpl!oifionlly provided that Pefendnnte were to
return the premiaea to Plaintiffe Ilt the expiration of thl! term in
the lIame oondition ae of the oOllunenoement of the lea Ie tQrm,
ordinary wear and tear excepted.

evente oonetituted IIn event of defllult by Pefendante, which

inuurunoe coverage.

G. Defendants have failed to uurrender the premiueu in the uame
condition au of the commencement of the lease term and have further
failed to paint the exterior of the premiueu.
H. Defendantu have oauued extenuive damage to the exterior and
