moved to 1366 Frylown Road at Ihe end of Augusl, t996,
Frylown Road Is a Township road measuring seven,lenlhs 01 a mile belween
the Intersections of Grahnms Woods Road and Potato Road. Frylown Road Is
stoned, graded and unpaved except lor one,half of one-tenlh 01 a mile from the
Intersection of Grahams Woods Road. There Is a ditch on one side of Ihe road Bnd
on embankment with treElS on the olher. The condition 01 Frytowl1 Road has been

Flewelling starts WOl'k at 3:00 a.m. Bnd hill wife slarts at 6:00 8,m, Plalnllffs now take
the ohlldren to a relative/babysitter Irom wllose resldenoe Jamie and sylvia take
buses te) school. Plaintiff Galen Flewelling testified that Fry town Road Is hazardous
lor the ohlldren to walk from his residence to and from the school bus stops because
(1) there have been two Incidents of a vehicle running off tl10 road at the Intersection
01 potato Road Elnd Frytown Road; (2) there are skid marks on the road at the
Grahams Woods Road bus stop; (3) a stop sign on which there was grafflll was
Imocked down at the Intersection 01 Grahams Woods Road; (4) an old cabin and a
larm building on Fry town Road have been vandalized; (5) there 15 grafflll sprayed on

Potato Road about 100 leet from the bus stop; (6) trash has been dumped on
Fry town Fload near Grahams Woods l=lond; (7) he caught two young people who
were smoking dope In a car 1118t was tltopped on I=rytown Road; (0) although the
surrounding fields are posted, somB hunters used those fllllds during this deer
season; and (9) he 11as found deer carcasses near the road out of dear season which
he aUrtbutes to poaohers.
Following plelnlltls' requel'it to the School IJlstrlctto provide bus sllNloe at their
resldenoe, the Assistant Superintendent, the District's private school bus contraotor,
and three school directors eXllmlned the scene at Fry town Road. The bus Iltops at
the IntllrSl3<lllons 01 Grahams Woods l=load and Potato Road are boththrell and one-
half tenths 01 a mile Irom plaintiffs' residence and do not violate the walking distance
requirements In Secllon 6642.1 or the District's transportallon regulallons as to Jamie,
who attends elementary school (maximum flve.tenths 01 a mile), and Sylvlril, who
aUends junior high school (maximum one mile). Fry town Road Is approximately
sixteen leel wide, and at Its widest point Is approximately twenty leetln Iront 01
plalnlllfs' residence. The School Board believes that II would be difficult lor a school
bus to turn around In the driveway 01 plaintiffs' residence, although plalntllfs maintain
that It can be done. The Board concluded that a school bus entering Fry town Road
Irom either Grahams Wooda Road or Potato Road to pick up a child at plalntllfs'
residence would have to continue to the nextlntersecllon to turn around, The Board

whloh could not be compensated by damnges; second, Ihat grealer

We will deny plaintiffs ttllllr reqlJest for a preliminary Injuncllon because we IInd
that the right they claim Is not clear; that Is, plolnlllfs have not satisfied IJS that the 81g
Spring School Board has 50 transcended Ihe IIl11l1s of Its legal discretion that It 15
amenable to the Issuance of a preliminary Injunction. The School Board Is not willing
to accommodate plaintiffs despite the fact Ihat their reoldence Is on an Isolated
unpaved Towl1shlp Road, Several representatives of tha School District have
eKamlned the scene. The Board has the facts necessary for an Intelligent judgment.
That judgment, allhough reasonable people might well disagree, Is not based on a
misconception of the law nor 15 It arbitrary or capricious. Accordingly, th~ following
