(2) The proceedings have terminated In favor of the person
against whom they are brought.
Appellants first claim that because their supersedeas bond was In

them, In support of their position, Appellants cite to Scllaffer v. stewart,
473 A,2d 1017 (Po, Supcr, 1984) w\1ereln this court held that a voluntary
dhlmlssal of on action satisfied tile favorable termination requirement of 42
Pa,C.S,A, ~ 8351(a), Unlike the sltuotlon In Sellaeffer, however, this cose
Involves the voluntary withdrawal of a writ of execution, Appellees did not
permanently withdraw their clalrn against Appellants, They could seel(
relssuance of the writ at any time, Pa,H,C.p, 3106, Therefore, we hold the
trial court did not err In Iloldlng that Appellees' staying of the writ of
execution did not satisfy tile favorable termination requirement of 42
Pa,C.S,A, ~ 8351(a),
Appellants' remaining claim regarding Appellees' alleged abuse of
process was fully addressed by the trial court. Accordingly, we adopt the
trial court's reasoning as It relates to this claim,
Order affirmed,
