situation, 1 had spoken to John within the laRt week regarding
the sale ot my boat and turther had aent II signed brokerage
agreement to hil11 approximately two (2) weeks ago, Untortunately,
prior to that I was under thll imprllssion that you had been
marketing tho boat since it has bOlln at your t1lcility tor the
past Beven (1) months,
Additionally, throughout thll tllll and winter, I had
been advised by Jim L'arlllY that the invoicing we had beon
receiving would be addrllssed and taken care ot by Mr, Farley
because ot an ongoing busineslI relationship with you, I am not
in the habit ot ignoring any invoiclllI directed to me, but I was
assured they would be addressed, As to those invoicea, I have
now boen appt'ised that my port engine ill seizllld, when the boat
lett my home the port engine wall not seized as it ran, but r.an
very rough and had ditticulty maintaining consiBtent operation,
Consequently, deBpite receiving cont1J.cting stories obout the
condition ot the engine, I now am tinally told that it is seized,
I have no idea when that occurred or why, but I would 1 i)(e to
diacuBa this with you,
My only desire at this pol.nt is to Bell my boat and

This l.tter will confirm my telephone converslltion with
you o~ tcday during which you refused to permit my boot to leevG
your preMioG~ without payment for service~ which I never
authorined or directed you to perform,
I had authorized you to perform work on the hoot to
solve the J."unning problem in tho summer of 1996 up to a maximum
amount of Three Hundr~d ($3CO,OO) Dollars, I was later notified
that it took your trained technicians sevon (7) hours to
determine that the lower unit was defective. Ue~pite the
abourdity of your trained technicillns taking that much time to
perform thie monumental task, I agreed to pay that amount,
However, at the sarno timo I advised carol that r had never .
authorized you to do anything on my boat, Anything you did on or
with the boat was not at my direction. If you performed services
it W~s at the request of someone olae.
Upon receLpt of your b~nk wire coordinatos, I will wire

Jurlsdlotlon. The following oan be gleaned from the pleadings, Plalnllff Is a
resident of Cumberland County, Pennsylvania and Defendant Is a oorporatlon
conduollng business In Avalon, New Jersey, In Ihe Spring of 1996, Plalnllff put his
boat In Defendanl's possession after contraotlng wllh the Defendant for the
purpose of brokerlng Ihe boat for sale, Plaintiff authorized DefendAnlto conduot
repairs not to excaed $300,00, Without Plalnllff's consent, Defendant performed
service and repairs In exceaa of that amount, Defendant haa refused to release
Plaintiffs boat untlltha bill Is paid, (Plalnllff's Complaint I 12106/96,)
