dated January 15, 1990, the full-time Master has been appointed
in the above referenoed divorce proceedings.
The motion for appointment of Master appar$ntly has the
oaptioned reversed 1 cindy T. Ceooo is the Plaintiff and Rosario
Ceooo is the Defendant. I am using the oaption from the divorce
oomplaint rather than the caption on the motion for appointment
of Master.
A divoroe complaint was filed on May 21, 1997, raising
grounds for divoroe of irretrievable breakdown of the marriage
and the economio claims of equitable distribution, alimony,
alimony pendente lite, and counsel feos and expenses.
I am going to proceed on the basis that grounds for
divoroe are not an issue and that tho parties will either sign
affidavits of consent or have been separated for a period in
el(oes. of two years, Based on my assumption, I am directing
eaoh oounsel to file a pre-trial statement in aooordance with

AND TO ADJUDICATE DEFENDANT IN CONTEMPT
AND NOW comes the above-named Plaintiff, by his attorney, Samuel L. Andes, and
petitions the Court as follows:
1. The Petitioner herein is the Plaintiff, Rosario Cecco. The Respondent is the
Defendant, Cynthia T. Yerkes, formerly Cynthia T. Cecco.
2. The parties are the parents of three minor children, Nathan Cecco, born 22
May 1988, Casey Cecco, born 1 March 1989, and Heidi Cecco, born 28 August 1990.
Those children are the subject of prior orders of this Court which consist of the
following:
A. An order dated 4 November 1998 which awarded custody and set a
custody schedule. A copy of that order is attached hereto and marked as
Exhibit A.

B. An order dated 28 September 2004 which continued the provisions
of the order of 4 November 1998 and directed the parties to engage in family
counseling if problems with regard to the partial custody schedule
continued. A copy of that order is attached hereto and marked as Exhibit B.
3. Defendant has violated the prior orders entered in this case repeatedly over
the past several months. She has failed to deliver the children to the exchange point set
in the order of 28 September 2004. She has failed to require or encourage the children
adequately to spend the designated times with their father and has permitted the
children to flatly refuse to spend the time with their father required by the order.
4. Defendant has attempted to implement the family counseling directed in the
order of 28 September 2004. On 30 September 2004, by which time problems with the
partial custody schedule had already arisen, his attorney requested counseling from the
Defendant's attorney. The Defendant and her attorney have failed to make any response
to that letter.
5. As a result of the Defendant's non-compliance With and violation of this
Court's order, PLaintiff is being deprived of the times with his children provided by those
orders and his relationship with the children is suffering as a result.

6. The only way that Plaintiff's relationship With his children can continue and
. improve is for this Court to enforce its prior orders so that he may spend time with
them.
WHEREFORE, Plaintiff prays this Court to enforce its prior orders, to order and
require Defendant to transport the children to and from the designated exchange points
at the designated times, and to adjudge Defendant in violation of this Court's prior
orders and award to Plaintiff the counsel fees and expenses he has incurred to enforce
his rights under those orders, and to take such further action as the Court deems
appropriate.

ORDER OF . COURT.
AND NOW, this 4th day of November, 1998, the parties
having entered into the fallowing agreement to resolve their
custody dispute, IT IS ORDERED:
1. Legal custody of Jessica L. Cecco, born october
29, 1984, Nathan A. Cecco, born May 22, 1988, casey L. Cecco,
born March I, 1989, and Heidi E. Cecco, born August 28, 1990,
shall be shared by the father, Rosario Cecco, and the mother,
cynthia T. Cecco.
2. During the school year, the mother shall have
primary physical custody of all four children. The father shall
have temporary physical custody of all four children on
alternating weekends, from Friday at approximately 5:00 p.m.

until Sunday at approximately 5:00 p.m. If the children have
r~gularly scheduled activities during the fatherts weekends of
temporary physical custody during the school year, the father
shall be responsible to either assure the childrents attendance
or participation in those activities or to curtail or forego all
or a portion of his temporary physical custody of the children
involved in the activities so that they can attend. The mother
will not schedule activities on the weekends the father is to
have temporary physical custody without first co~sulting with
the father, although the parties both understand that sports and

other team activities will be scheduled in advance and they will
not have much control over that schedule.
3 . During the summer months when the chi ldren are Orl
school vacation, the parents shall share physical custody of all
four children on the following schedule:
(a) commencing on the first Sunday after the
children are out of school in the spring, the father shall have
temporary physical custody for two weeks and the ~other shall
thereafter have custody for one week, and the parents shall
continue to share physical custody for the balance of the summer
with the father having two consecutive weeks and the mother then
having a week. That schedule shall end on the Sunday before the
children return to school in August or September. In addition,
the mother shall have the option to exchange one week of the
father's time for one of her schedUled weeks so that she may
have the children for two consecutive weeks for purposes of a
vacation.
4. The parents shall share physical custody of the
.
children during any schOOl vacation of four days or longer,
whiCh shell include Thanksgiving, Christmas, Spring vacation
and/or Easter vacation. They shall share such vacations equally
with the mother having the first half of those vacations in even
numbered years and the father having the second half of those
vacations. In odd numbered years, the father shall have the
first half of the vacation and the mother shall have the second
half of the vacation.
5. The parents will share transportation by
exchanging the children for purposes of physical custody and
temporary physical custody at Exit 20 of the Pennsylvania
Turnpike (the Lebanon/Lancaster exit) at either the Mount Hope
Restaurant or the Little Corner of Germany Restaurant.
6. The parents will cooperate in scheduling any
activities for the childre.n by communicating and consulting with
each other prior to scheduling such activities and by trying to
accommodate the needs of the children and of each other by
adjusting their schedule by mutual agreement with as much
advanced notice as possible.

One of the children called him the evening before he was to have them to announced that
they were not going to come. Rosario tried to adjust the schedule so that he would at
least have the children for part of the weekend, but that was not successful.
I understand that your client is not willing to try to force the children to spend time
with their father. I would hope, however, that she would be willing to take a more active
role, as the parent, to encourage them to comply with the order. Hopefully, Rosario will
have the children for some reasonable portion of his next scheduled weekend.
If problems persist, I think we are going to have to try the counseling. I would
expect we could find a counselor somewhere between here and Lancaster that would be
willing to work with everyone and could help them through these problems. I suggest we
use someone at Riegler & Shienvold Associates. Please speak to your client and let me
know if she will agree to use them if counseling becomes necessary.

1. The prior Order of this Court dated September 28, 2004 shall continue in effect.
2. The parties shall make arrangements for the parties and the Children to engage in a course of
therapeutic family counseling with Arnold Shienvold, Ph.D. or other professional selected by
agreement between the parties. The purpose of the counseling shall be to address issues which have
arisen in connection with the Children's adjustment to the custody schedule and other related issues.
Within seven days from the date of the custody conciliation conference, the parties shall contact the
selected counselor to schedule the first counseling session. Each party shall be responsible to pay any
costs which are not covered by insurance for his or her individual sessions with the counselor and the
parties shall equally share any unreimbursed costs of all other sessions.
3. The Mother shall provide the Children's sports schedules to the Father promptly upon receipt
and shall notify the Father of any revisions on an ongoing basis.
4. In the event the Father intends to transfer custody of a Child prior to the end of his regularly
scheduled weekend period of custody to enable the Child to participate in an activity, the Mother shall
cooperate in meeting at the place of exchange at old exit 20 ofthe Pennsylvania Turnpike. However,
the Mother shall not be required to provide transportation for more than two exchanges of custody at
the exchange point during each weekend.
5. The parties agree that Casey shall not be scheduled to work on the Father's weekend periods
of custody unless otherwise agreed.
6. Counsel for either party may contact the conciliator to schedule an additional custody
conciliation conference following the family counseling required by this Order to address any
outstanding issues, if necessary.

7. This Order is entered pursuant to an agreement of the parties at a custody conciliation
conference. The parties may modify the provisions ofthis Order by mutual consent. In the absence of
mutual consent, the terms of this Order shall control.
