WHEREAS, Harry L. Smith & Sons, Inc. ("Contractor") elllered into a conlract dated
November 22, 1996, with Gary S. Lurie and Sherry Lurie ("Owners") to provide materials and
perfonn labor necessary for the erection and construction of an improvement consisting of two-
story residential dwelling in accordance with the specifications and plans, and in accordance with
any change orders which Owner may hereafter make upon a property known as Lot Number 92
as shown on a Plan entitled Final SubdiviSIOn Plan Phase III and Replot of Lot 31 of Pinehurst
as recorded in Plan Book 70, Page 91. The legal description for said property is anached hereto
as Exhibit "A" and incorporated herein by reference.
It is hereby stipulated and agreed by and between the parties, as part of the November 22,
1996 contracl and for the consideration therein set forth, that neither the contractor, nor any
subcontractor, materialman. or other person furnishing labor or materials to the contractor or
any subcontractor of the contractor under the contract shall file a mechanics' lien claim for work
done or materials furnished in the construction or the improvement of the property or any part
thereof.
This Stipulation is intended to be filed with lhe Prothonotary of Cumberland County prior
to the commencement of work under this contract in accordance with the requirements of the
Me~hanics' Lien Law of 1963.49 P.S, Section 1402.
