7. The allegations conlained in Ihis paragraph are denied in accordance with
Pennsylvania Rules of Civil Procedure l029(e).

WHEREFORE, Answering Defendant denies that Plaintiffs are entitled to the relief
claim or any relief whatsoever demands a judgment be entered in its favor together with
attorneys' fees.
NEW MATfER
1. There is no legal entity known as "Thomas Construction" as averred in this
Complaint.
2. There is no privity of contract between Thomas Conslruction Associates and Dae
W. Lee and Sung S. Lee, Plaintiffs.
3. If it is determined that Thomas Construction Associates improperly styled
"Thomas Conslruction" built the deck alleged to be involved in this Complaint. the Defendant
raises the following defenses:
(a) Statute of Limitations
(b) No privity of contract
(c) Plaintiffs' failure to maintain the deck
(d) Plaintiffs' failure to maintain the fasteners on the deck
(e) Plaintiffs' failure to remove the ice and snow from the deck in a timely
(ashion Ihus causing or contributing to the failure of said deck;

4. In the alternative, the Defendant pleads that Ihe collapse of the deck was caused
by an act of God.
5. The Plaintiffs claims may be barred b)' the Statute of Limitations.
6. Plaintiffs were negligent in their failure to maintain the deck In question and to
timely remove accumulated ice and snow.
WHEREFORE, Answering Defendanl denies that Plaintiffs are entitled to the relief
claim or any relief whatsoever demands a judgment be entered in its favor together with
attorneys' fees.
