Minor Plaintiff Brian Varner has selected Petitioners Deborah 1<. Felix and Gregory A. Varner, as his guardians to represent his interests in this Petition. 5. Defendant Charles Richard I<utz, is an adult individual residing at B71 Mount Rock Road, Carlisle, Cumbel:'land County, pennsylvania. 6. Defendant Clouse Trucking, Inc., is a Pennsylvania corporation with its principal place of business at 2075 Ritner Highway, Carlisle, Cumberland County, Pennsylvania. 7. On April 14, 1996, Brian Varner was operating a 19B8 Plymouth Sundance automobile owned by his mother Deborah Felix and insured by Erie Insurance Company. 8. On the aforesaid date at approximately 5:25 a.m., Brian Varner was proceeding west on state Route 641, Newville Road, in West pennsboro Township, Cumberland county, pennsylvania. 9. At the aforesaid date and time, Defendant Charles Richard Kutz was operating a milk truck owned by Defendant Clouse Trucking, Inc. and was baCking into a private driveway across the westbound lane. 10. At the aforesaid date and time, the vehicle operated by Brian Varner struck the trailer being backed in by Defendant I<utz. A copy of the police accident report is attached hereto as Exhibit "A" and incorporated herein by reference, 11. Following the collision, Brian Varner was airlifted to Hershey Mfldical Center ("HMC") where he was admitted with a -2- diagnosi8 ot multi-trauma, closed head injury and scalp lacerations. 12. At HMC, Brian Varner was examined, received approximately twelve stitches to his scalp and was given x-rays. 13. The x-rays ot Brian Varner's cervical spine, chest, pelvis and head were all negative. 14. While at HMC, Brian Varner was observed tor a concussion but exhibited no neurological ditficulties. 1~. Brian Varner was discharged from HMC on April 16, 1996, two days later, and was instructed to follow up for suture removal on April 19, 1996, which was completed. 16. On May 1, 1996, Brian Varner received his second and last follow up appointment at HMC at which time he had no SUbjective complaints, his lacerations were well healed and he was discharged from the clinic. 17. On May 1, 1996, Brian Varner's physician writes that since his accident he has "done well." "He is having no problems with cognition, behavior, emotional status, sleep pattern or school performance." The treating physician further writes that" [hJ is scalp lacerations are nicely healed. His neurologic exam is unremarkable and grossly eymmetric and normal." In addition, the physician states that "[wJe will release him from activity restrictions." A copy of the medical records for the HMC treatment reterenced in the preceding paragraphs are attached hereto as Exhibit "B" and incorporated herein by reference. -3- 18. Both Brian Varner and his parents feel that he has made a full recovery and will not require any further medical attention. 19. Brian Varner's medical bills as a result of the accident have been paid by his mother's automobile first party benef i t coverage with Erie Insurance Company who has no right of subrogation under Pennsylvania law. 20. Petitioners' and Brian Varner's property damage as a result of the accident has already been fully paid by Defendants' insurance carrier. 21. Brian Varner's income loss claim as a result of the accident amounts to no more than $200. 22. Also, the Erie Insurance Company policy covering the automobill\l which Brian Varner was operating at the time of the accident is subject to a limited tort election and, therefore, may affect the likelihood of Brian Varner collecting certain damages for pain and sUffering. 23. The Petitioners also sought legal advice regarding the injuries suftered by Brian Varner from the accident and have decided not to retain counsel to represent them on these matters. 24. The Defendants have also raised the question of comparative negligence on the part of Brian Varner because of possible speeding and therefore liability is disputed. 25. Brian Varner and his parents contend that the injuries he sustained were caused by the negligence of Defendant Kutz and/or his employer Clouse TrUCking, Inc. -4- 26. The insurance carrier for Defendants has offered to pay $5,000.00, plus the filing fees for the writ and Petition, to Brian Varner through his parents and natural guardians Deborah K. Felix and Gregory A. Varner in an effort to amicably resolve this claim. 27. Petitioners believe that this settlement offer is fair, equal to or greater than that which may be obtained should the matter be fully litigated and reasonable for the reasons set forth above and in the best interests of the minor Plaintiff Brian Varner. 28. Peti tioners request that this Court approve the compromise settlement of this claim in the foregoing amount. 29. The Petitioners realize and acknowledge that the approval of this compromise settlement will terminate any right they or the minor Plaintiff Brian Varner have for any recovery against Defendants for any future medical expenses, income losses or any other injuries/damages. 30. The Petitioners will discontinue the action filed against Defendants and execute a General Release if this settlement is approved by the Court. 31. The Petitioners propose to place their son's settlement proceeds in a federally insured account at a bank or savings and loan association organized and existing under the law of the Commonwealth of Pennsylvania in the name of the minor Plaintiff. 32. Closed head injury. 3. Scalp lacerations. OPERATIONS OR PROCEDURES: Repair of scalp lacerations. BRIEF HISTORY: The patient is a 16-year-old white male involved in a motor vehicle accident on the a.m. of July 14, 1996. Report has the patient driving a small car which ran into and was slightly underneath a semi-trailer. There was extensive damage to the car. The patient does not remember the accident. Upon admission, ABC's were intact, initial blood pressure 158/97, pulse 88, 0, sat 100\. The patient was alert. Glasgow coma scale 15. A Foley catheter was placed. Secondary examination revealed 3 lacerations, 1 just where the pinna comes into the scalp on the left and 2 left occipital scalp lacerations. Otherwise, his examination, other than a few abrasions was normal, Initial x-rays including C-spine, chest, and pelvis were negative. c'r scan of the head was also negative. The patient was admitted for observation for a concussion. A Philadelphia collar was removed the first day. The patient remained with stable vital signs throughout and no neurological changes. On the first day after admission, his Foley catheter was removed and a diet was started. He did have some complaints of right shoulder, hands, and arm tingling and weakness. Also, he has a minimal amount of swelling in that arm. The IV was removed from that arm. His IV fluids were thltn KVO'd throughout the day as he began tolerating his diet. Again, he had no neurological changes. His laboratory exams on the first day came back with a slightly elevated bilirubin level of 2.4. The decision was made to continue to observe the patient following abdominal exams and repeat bilirubin in the a.m. Today, 4/16, abdominal exam remained stable. The patient again without neurological difficulties. His right arm, shoulder, and hand are completely symptom frelt. Bilirubin today is 1. 5.
