Smith. Shissler & Hall, to file the within Complaint based upon the following facts:
COUNT I
ACTION IN REPLEVIN
1. General Motors Acceptance Corporation, (hcreaftcr "GMAC") is a New York
Corporation having offices throughout the United States and having a mailing address of P. O.
Box 107S. Baltimore, Maryland 21203.
2. Defendants. Ronald J. Jones and Tammy M. Jones (hereinafter "Defendants")
are adult individuals presently residing at P. O. Box 27. Mount Union. Pennsylvdllia 17066.
3. On May 13, 1996, Defendants. entered into an Agreement of Lease with Forbes
Chevrolet. Inc.. Camp Hill, Cumbcrland County. Pennsylvania. for a 1996 Chevrolet S I 0
Pickup Truck, bearing Vehicle Identilication Number IGCCSI940T81745S0 (hereinafter the

Agreement of Lease is referred to as "Lease"). A copy of the Lease is marked as Exhibit "A".

attached hereto and its contents are incorporated herein by reference. For good and valuable

consideration, the Lease was assigned 10 General Motors Acceptance Corporation (hereafter

"GMAC"), Under the terms of the Lease, all lease rcntal payments were to be made to

GMAC.

4. Defendwlts, pursuant to the aforesaid Lease. agreed. Inter a/la, to make thirty-six
(36) monthly lease payments in an amount ofTwo Hundred Ten and 59/100 Dollars ($210.59).

each commencing on May 13. 1996. payablc on the same day of each successive month
thereafter.
5. Under the terms of the Lease and assignment. GMAC obtained title to the
vehicle. A copy of the Certificate of Title is marked as Exhibit "B", attached hereto and made
. a part hereof by reference.
6. Defendants. pursuant to the aforesaid Lease. allreed that in the event of default
of any payment due under the Lease, or the failure to comply with any term or condition
thereof. that GMAC may take immediate possession of said property. includinll any equipment
or accessories thereto. and for this purpose. GMAC may. in any lawful manner. enter upon the
premises where the said property may be and remove same.

7. Defendants have breached the said Contract in that Defendants have failed to

make the agreed-upon installment payments due lor the months of June, July, August.
September, October, tlnd November. The present outstanding balance due GMAC from
Defendants is in the amount of Seven Thousand Three Hundred Seventy and 65/100 Dollars
($7.370.65), plus late charges in the amount of Filly-Seven and 96/100 ($57.96). for a total
arrearages in thc amount of Seven Thousand. Four Hundred Twenty-Eight and 61/100
($7.428.61).
8. Defendants, undcr the terms of the af"resaid Lease. agreed that in the event they
defaulted in any paymcnt due thereundcr. or failed to comply with any of the terms or
conditions of the Lease, and in thc evcnt it became necessary for the Lessor or its assignees
to institute a suit in replevin for the vehiclc, Defendants agreed to pay all costs of suit and
reasonable attorncy' s fecs.
9. GMAC has made repeated demands that Defendants make the agreed upon
payments. all to no avail.

10. The aforesaid vehicle is presently in the control and custody of Ronald J. and
Tammy M. Jones, P. O. Box 27, Mount Union. Pennsylvania 17066. Vehicles of this model
and class have an average value of Fourteen Thousand Seventy-Five and 00/100 Dollars
($14,075,00).

WHEREFORE, GMAC prays that this Honorable Court enter judgment In favor of
GMAC and aguinst Defendants for:
a. Possession of the 1996 Chevrolet S10 Pickup Truck. bearing Vehicle
Identification Numbcr I GCCS I 940T8I 745S0. or the altemative. the
market value of the car in the amount of Fourteen Thousand Seventy-
Five and 00/100 Dollars ($14,075.00); and
b, Attorney's lees and legal expenses in the amount of One Thousand Eight
Hundred and 00/100 ($I.SOO.OO) Dollars incurred by reason of the
institution of this action in replevin to reposscss the aforementioned
vchicle; all as agreed to in the Lease dated May 13, 1996.
COUNT II
ACTION FOR DEBTS OWED BY DEFENDANTS TO GMAC
11. Paragraphs I through 5 and 7 through 9 are incorporatcd herein by reference.
12, The Defendants arc indebted to GMAC for the following amounts:
(a) LellSe rental payments at the monthly rate of $210.59. commencing June.
1996. until the vehicle is returned to GMAC's possession;
(b) All monies due GMAC under Section 29 of the Lease "Early
Termination";
(c). Reasonable attorney fees and court costs incurred in recovering the fwtds
due GMAC under Section 24 of the Lease "Default".
