HAINTENANCE, REPAIR AND REPLACEHENT OF A
SANITARY SEWERAGE SYSTEM, AND AUTHORIZING THE
FILING of A DECLARATION OR DECLARATIONS OF
TARING AND ALL NECESSARY ACTION FOR THE
ACQUISITION THEREOF
WHEREAS, SILVER SPRING TOWNSHIP AUTHORITY (hereinafter
oalled >>Authority>>) has proposed the oonetruotion of oertain
additions to its sanitary sewerage system in Silver Spring
Township, cumberland county, Pennsylvania (hereinafter oalled
>>Township"), and
WHEREAS, it is neoessary that the Authority aoquire and
seoure oertain easements and rights-of-way in, over, aoross,
under and through various lands in said Township, cumberland
county, Pennsylvania, for the purpose of presently oonstruoting,
installing, operating, maintaining, repairing and Ultimately
replaoing said sanitary sewerage system, and
WHEREAS, said Authority has developed a plan (>>Plan>>) of
neoessary lands, easements and rights-ot-way whioh will
aooommodate said aanitary sewerage system within the land being
the sUbjeot hereof, whioh Plan is embodied in oertain
documentation as made by Akens Engineering Associates, Ino"

have done nothing to advanoe th_ir alleged right to present
evidence, For 36 days they aat on their hands and did nothinq to

In faot, the condemneus' brief improperly assumes that
Condemnor is seeking some relief in the preliminar.y objeotion
stage, They say the condemnor's "relief requested , . , should
be denied," No "relief" has been sought, so none can be denied,
The entire preliminary objeotion prooess under seotion 406
of the ~minent oomain Code oontemplates a speedy resolutionl

'fo give any oredenoe to the substance of Condemnees' brief would
be to ignore the mandate of prompt resolution. One must believe
that if condemnees were serious about the seourity for
oompensation that they would have sought the evidentiary record
contemporaneously with the filing of their objeotions. Having
elected to not do so, they must be held to some standard as
stated in Milford, supra,

re/illaoe and maintain said sanitary Sewer faoility and
appurtenanoes, together with the free and uninterrupted
rights of. ingress, egress and regress in, to, over,
upon, through, a long and trom said land, neoessary or
convenient tor full and complete use by the Grantee of
the said rights and privileges to lay, oonetruot,
replace, renew, repair and maintain eaid Sanitary Sewer
raoility and appurtenanoes.
The dimensions, location width and length ot laid
right-Of-way and easement above mentioned are shown on
Exhibit "A" (attaohed hereto) dated FEB. 3,1997
and as further described by metes and bOUnds in Exhibit
"B". Exhibits "All and "1111 are attaohed hereto and made a
part hereof.
To hAve and to hold the aaid perpetual right-ot-way and
eAsement unto Grantoe, ita sUoceasors and assigns, to
and for its and their use, as specified herein, forever.
Grantee shall rea tore the surfaoe of the land to as
nearly as practioable to its contour and oondition as
