Plaintift contacted aarrick and Stewart to deliver the load and at 3110 a.m. on July 10, 1996, Tim Barrick signed tor the load at Pefendant's place of business in Chambersbur.g, Pennsylva- nia. 14. plaintiff and/or his agent, representative or employee, Tim aarrick of Barrick and Stewart, was given directions to the location at Saint Samuel's Church parldng lot in Oliver Township, Perry County, where PennPOT had directed the tanker to be placed. 15 . The placement of the tanl<er. trailer was made in a negligent manner by Plaintiff's agent, representative or em9loyee in that the dollies were not placed on blacl<top or any other hard surface but rather on 60ft dirt and the trailer was parked parallel with a downward slope toward ,10 unnamed tributary to the Big BUffalo Creek. 17. By 6 I 00 a. m. on July 10, 1996, the tanker traller had upset and part of the load spilled onto the ground and into the unnamed tributary to Big BUffalo Creek. 18. As a result of the spill of the asphalt emulsifier, Defendant obtained services of others and supplied labor for the mitigation and remediation of the apill. 19. Part of Plaintiff's claim is for transportation costs for hauling a load of asphalt emulsif ler from Defendant's place of business in Chambersburg to a location in Perry County, Pennsylvania, on July 10, 1996. 5. Prior t'l July 10, 1996, Defendant contacted Pla inti f f to deliver a tanker load of asphalt emulsifier (E-3M) to Perry Coullty, - 1 - Pennsylvania, tor use by the Pennsylvania Department of 'l'ransportat ion. 6. Plaintiff contacted Additional Defendant, aarrick and Stewart, to deliver the load and at 3110 A,M. on July 10, 1996, Tim aarrick signed for the load at Defendant's place of business in Chanwersburg, Pennsylvania. 7. Additional Defendant was given directions to the location at Saint Samuel's Church pat'king lot in Olivel." Township, Perry County, where PennPO'l' had directed the tanker to be placed. 6. Additional Defendant parlted the trailer at approximately 5100 A.M. in the parking lot. 9. The placement of the tanlter trailer was made in a negligent manner by Additional Defendant in that the dollies were not placed on blacktop or allY otner hard surface but rather 011 soft dirt and, the trailer was parked parallel w~th a downward slope toward an unnamed tributary to the Big BUffalo Creek. 10. By 6 I 00 A. M. on July 10, 1996, the tanker trailer had upset and part of the load spilled onto the ground and into the unnamed tributary to aig Buffalo Creek. 11. As a result of the spill of the asphalt emulsifier, Defendant obtained services of others an~ supplied labor for the mitigation and remediation of the spill. 12. Defendant also incurred costs to recover the damaged tanker trailer and had to pay a penalty to the Pennsylvania Fish and Boat Commission. - 2 - 13.
