Farabaugh-Auker by their attorneys, Zeigler & Zimmerman, P.c., and
states,
1. The Plaintiffs, Dennis W. Auker & Marian R. Farabaugh-
Auker ate adult individuals residing at 935 Herman Drive,
Heohanioeburg, Pennaylvania 17055.
2. 'l'he Oefendant, Greg'S Nursery/ is a nursery sales and
servioe bUllliness lioensed to do business in the state of
Pennsylvania and looated at 450 Gettysburg Pike, Meohaniosburg,
Pennsylvania 17065.
3. On A~ril 6, 1996, th6 AUkers purohased a 12-15' BoWhill
Red Maple Tree from Greg's Nursery at a oost of $190.78, A oopy of
the sales oontraot between the Aukers and Greg's Nursery is
attaohed as Exhibit >>A>>.
4. At the time of purohase, Greg'a Nursery verbally
warranted the purohase, and several times sinoe the date of
purohase has informed the Auker.s that they have a 9 month warranty
on the tree and that Greg'S Nursery stands behind its stook.
5. At the time of purohase the Aukers were also provided
wit~ a written guarantee tor the trae. A oopy ot thlll written
9uarantee 11 attaohed as "lIx~ibit B".
6. On April 18, 1996, Greg's ~urssry ~lanted t~e purohallled
tree at the Auker's residenoe oharging the Auker. $114.48 for thilll
servioe. A oo~y of the bill tor the tree planting is attaohed as
Exhibit "e".
&. Beginning in approximately late May, 1996, tha tree sold
and planted by Greg's Nuraery to the AUkers began to show brown
spots on the leaves and was dro~ping leaves.
6. The above mentioned trees oonditiQn oontinued to worsen
atter late May, 1996, and as ot approxlmately November 14, 1996,
the tree appeared to be dead.
7. Repeated attempts by the AUkers to contaot Greg carigan,
the President ot Greg's Nursery, have been unsucoesetul and the
Plaintiffs have not been reimbursed for their moneys expended in
purohasing the tree nor have been provided with a new tree.
8. Greg's Nursery has breached it'a oontraot with the Aukers
to provids them with a healthy tree.
9. Greg's Nursery has tailed to correct the problems with the
tree it sold to the Aukers and refuses to do so.
11. Greg's Nursery has tailed to provide the AUkers with
warranty protection for the tree purchased by the AUkers although
the tree was warranted both orally and written.
