WHEREAS, Craig L. Hench and Sheila M. Hench, of Cumberland County,
Pennsylvania (herein "O "'
wner) ~s about to execute contemporaneously herewith, a
contract, with Steve Kemper Builder, Inc. of Cumberland County, Pennsylvania (herein
Contractor ), for the construction of a building upon Lot No. 26, Enchanted Hills, Silver
Spring Township, Cumberland County, Pennsylvania, more particularly set forth on
Exhibit "A" att~,-~---' ~

NOW, October /¢~¢ 2002, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by said
Owner to the said Contractor to commence work on the said building, or purchase
materials for the same in consideration of the making of the said contract with Owner
and the further consideration of One ($1.00) Dollar in hand paid to Contractor by Owner
it is agreed that no lien shall be filed against the building by the Contractor, or any sub-
contractor, nor by any of the material-men or workmen or any other person for any
labor, or materials purchased, or extra labor or materials purchased for the erection of
said building, the right to file such liens being expressly waived.

EXHIBIT "A"
ALL THAT CERTAIN lot of unimproved land in the Township of
Silver Spring, County of Cumberland and Commonwealth of Pennsylvania, more
particularly bounded and described as follows:
BEGINNING at a point on the southern dedicated right-of-way line
of Keystone Drive, at the dividing line between Lots Nos. 26 and 25 as shown on
the hereinafter mentioned plan of lots; thence along said dividing line between
Lots Nos. 26 and 25, South 5 degrees 14 minutes West, a distance of 262.14
feet to a point at the northern line of Lot No. 1; thence along the dividing line
between Lots Nos. 26 and 1, North 63 degrees 28 minutes East, a distance of
88.03 feet to a point at the dividing line between Lots Nos. 26 and 10 as shown
on said plan of lots; thence along said dividing line between Lots Nos. 26 and 10,
North 78 degrees, 42 minutes East, a distance of 277.74 feet to a point on the
dedicated right-of-way line of Keystone Drive; thence along said dedicated right-
of-way line of Keystone Drive, the following three (3) courses and distances: (a)
North 42 degrees 46 minutes West, a distance of 137.21 feet to a monument; (b)
on a curve to the left in a generally westward direction having a radius of 250
feet, an arc distance of 128.28 feet to a monument; and (c) North 84 degrees 46
minutes West, a distance of 122.04 feet to a point on the same at the dividing
line between Lots Nos. 26 and 25 as shown on said plan of lots, the place of
BEGINNING.
BEING Lot No. 26 as shown on a certain plan of lots entitle "Final
Subdivision of Enchanted Hills" as recorded in the Office of the Recorder of
Deeds in and for Cumberland County, Pennsylvania, in Plan Book 76, Page 37.
BEING THE SAME PREMISES which Greater Keystone
Properties, Inc., a Pennsylvania corporation, by deed dated September 4, 2002
and recorded September 6, 2002 in the Cumberland County Records in Deed
Book 253, Page 2452, granted and conveyed unto Craig L. Hench and Sheila M.
Hench, his wife, in fee.
