complaint., averring as followal
1. Plaintiff, Dennia Petrina, ia an adult individual, who
resides at 6311 Ann Street, Harrisburg, Dauphin County,
Pennsylvania, 17111.
2, Defendant, Pinnacle Health Foundat ion, ia a
Pennaylvania non-profit corporation, with a regiatered office at
17 S, Market Square, Harrisburg, Dauphin County, Pennsylvania and
which t/d/b/a seidle Memorlal Hospital at a busineas address of
120 S, Filbert Street, Mechanicaburg, Cumberland County,
Pennsylvania, 17055,
3, On or about September 3D, 1996, Plaintiff accompanied
his son, Frank Petrina, to Seidle Memorial Hoapital for aaid
Frank Pet.rina's previously scheduled appointment with Morton L,
Rubin, M,O,
4, The said Dr, Rubin maintains an office on the second
floor of Seidle Memorial Hospital,
5, Upon leaving Dr, /lubin's office, Plllintiff and hi/J son
walked down au uncarpeted tile hallway to an e!avator, intending
to proceed to the first floor and to eKit the building,
6, A rug measuring approximately 3 feet long by 3 feet
wide was placed on the floor directly outside the elevator door,
7, The tile floor had just been waKed, although Plaintiff
wa/J at that time, unaware of this fact..
a, There were no warning signs or cones to alert
individuals using said hallway that it had just been waKed,
9, When the elevator doors opened, an unknown male
individual was in the elevator and stepped off it, so that
Plaintiff was obliged to step back to allow said individual to
pass.
10, plaintiff then attempted to enter the elevator, at
which time, because of the slick condition of the highly waKed
floor, Plaintiff slipped on the rug and fell,
11, Plaintiff sustained serious injudes as further set.

12, The accident was caused eKclusively and solely by the
Defendant's negligence, carelessness and recklessness in thatl
A, Defendant failed to properly maintain the hallway
and its rug, so as to provide a safe means of. egress,
B, Defendant failed to give warning of t.he dangerous
conditions posed by the highly waxed hallway and rug, and
likewise failed to take any other safety precautions to prevent
injuries to the Plaintiff and other business visitors,
C, P~fendant [ailed to provide cones or warning signs
indicating that this hallway had been waxed,
p, Pefendant failed to put appropriate nOIl"skid
devices on the carpet on which Plaintiff fell.
m, Defendant knew ~r should have known, by virtue of
operatin9 a hospi.tal and building in which doctors maintain
offices, that business invitees like Plaintiff would be in a
weakened condition and therefore unable to negotiate or control
their reactions as quickly as business invitees in a different
type facility,
13, Plaintiff was a business invitee of Pefendant and is
therefore owed the highest duty of care,
14. Solely as the result of Defendant's negligence,
carelessness, and recklessness, the Plalntiff sustained injuries
as follows I
A. A lumbosacral contusion,
B. Severe low back pain,
C, Low back muscle spasms,
D, Severe limitation in lumbar range of motion,
E, Aggravation of pre-existing low back problems,
F, Right knee sprain,
G, Exacerbation of pre-exlst.ing right knee problems,
ij, Bilateral knee pain,
I, Severe bllateral hamstring tightness,
J, Right leg pain,
K, A minimal central disc protrusion at L5-S1??
L, Depression and anxiety,
15, As a result of the injuries listed in paragraph 14
above herein, Plaintiff has undergone the following treatm~nt and
medical procedures I
A, An emergency room visit on the day of the
accident,
B, A 16 day inpatient admission at the Rehab Hospital
in Mechanicsburg,
C, Numerous diagnostic tests, inclUding a low back
MRI and X-rays of the low back and right knee,
D, At least one lumbar epidural steroid injection,
E:, Upper back trigger point inj ect ions,
F, Treatment with numerous medicatlons, including
Hydrocodone, Cyclobenzaprine, Trazodone, and extra strength
Vicodin,
Q, Nine sessions of outpatient physical therapy,
16, Solely as a result of Defendant's negligence,
carelessness, and recklessness, Plaintiff has been and will in
the future be obliged to expend monies for medicine and medical
care in order to treat and help cure his injuries,
17, As a further result of the Defendant's negligence,
Plaintiff has suffered injuries reBulting in a diminution of his
ability to enjoy life and life's pleasures,
18, As a result of Plaintiff's injuries, Plaintiff's
medical insurance carrier, Blue Cross/Blue Shield/Major Medical,
has expended payments for medical bills on Plaintiff's behalf in
an amount in excess of $20,052,05, which sum is entirely subject
to subrogation,

The Plaintiff/ Pennie Petrina, by his undersigned
oounsel, hereby moves this Oourt to enter an order, pursuant to
Pa. R.C.P. No. 4019(a) (1) (viii), direoting Defendant, Pinnaole
Health Foundation, a Pennsylvania non-prpfit oorporation, t/d/b/a
Seidle Memorial Hospital, to produoe etatements in response to
Plaintiff'S written request made pursuant to Pa. R.C.P. No.
4003.4, or suffer sanotions, and in eupport thereof avers as
follows I
1. The aotion was instituted by Writ of Summone on
Deoember 20, 1996.
2. On Maroh 20, 1997, Plaintiff, by way of written
request of oounsel, pursuant to Pa. R'c,p, 4003.4, did seek copy
of any statements whether written or recorded previOUSlY made by
the Defendant, any other party, or by any person who was a
witness to any of the events surrounding Plaintiff's injury,
inclUding but not ~imited to a certain written report prepared by
Rim Roppenhaver, believed to bs head of security at Seidle
Memorial Hospital. A oopy of said Maroh 20/ 1997 oorrsspondsnos
is attaohed hereto, and marked as Exhibit "A".
3. The written requeet of the Plaintiff dated Maroh
20, 1997, did allow tor a response within thirty (30) days of the
wfitten request, and did plaoe the Defendant on notiue that if no
response was forthooming, Plaintiff would move this Honorable
Oourt for an order oompelling produotion.
4. A period of greater than forty-five (46) daye hae
elapsed eince the written request was made by the P13intiff to
t~e Defendant, and no response has peen provided, other than an
ongoing refusal to produce by way ot oounsel for Defendant.
6. For the foregoing reaeons, the Plaintiff believes
and avers that pefendant will not properly respond to Plaintiff's
wr~tten request, whioh was made pursuant to Rule 4003.4, absent a
court order pursuant to Pa, R.C.P. 4019(a) (1) (viii).
WHEREFORE, the Plaintiff requests that the cou~t enter
~n order directing the Pefendant tQ serve on the Plaintiff a
photostatic copy, or like reproduction, of all statements
ooncerning the action, or its subject matter, previously made by

this Motion to consolidate Disoovery Arguments, and in su~port
thereof/ avers as folloWSI
1. on or about Deoember 20, 1996, the Plaintiff tiled
a Writ of Summons to the a~ove-referenced dooket number,
2. on or about January 17, 1997, the Defendant s.~ved
the 'laintift with Interr09atories and Request for Produotion of
Doouments.
3, Immediately following reoeipt of Defendant's
dieoovery request, oounsel for Plaintiff, Richard S, Friedman/
lequire, did oontact oounsel for Defendant, and did request a
copy of a report believed to ~8 in the possession of Defendant
reqardin9 an inspection of the site of the Slip and tall, and the
ciroumetancee surrOUnding the Slip and fall.
4. On the date of the initial disoussion between
coun.el (.hortly after reoeipt of Defendant'e discovery reque.t) ,
it was explained to oounsel for Defendant, by oounsel for

Plaintitt, that a response to Defendant/s discovery request WQuld
be postponed pending reoeipt fro~ Defendant of the requested
report. Attorne~ tor Defendant, Mr, Blaok/ did agree with Mr.
Friedman/ attorney for Plaintiff, that the report would be
produoed voluntarily, provided the report is not proteoted, and
that the Plaintiff need not respond to the disoovery r.quests
produoed by Defendant pending that produQtion.
6. By way of correspondenoe dated Harch 20, 1997,
pursuant to Pa. R.C.P. 4003.4, counsAl tor Plaintiff did make a
tor~al request in writing upon oounsel for Defendant for the
written .tatement prepared by one ~im Koppenhaver. A oopy of
.aid oorr.espondenoe is attached hereto, marked Exhibit "A", and
incorporated herein by referenoe,
6. By way of oorrespondenoe dated April 30, 1997,
oounsel for Defendant did request filing of a complaint. A oopy
of .aid oorrespondenoe is attllohed hereto, marked f:jthibit "B",
and inoorporated herein by referenoe.
7. ^ complaint was filed on or about Hay 6, 1997.
8. On or about May 9, 1997, the Plaintiff filed a
Motion for Sanctions against Defendant for Defendant's tailure to
produce statement, said Motion seeking to compel prOduction, with
a RUle to ShoW Cause, which RUle was issued on May 13, 1997,
returnable twenty (20) days lifter servioe.
9. On or about Hay 12, 1997, oounsel for Dsfendant

complaint report which is dated September 30, 19~6. It was
produced to Ille by counsel for Defendant.

16. Hegardill9 my ri9ht I<nee, r injured it in a slip and
fall accident at McDonalds in 1980. I injurod it in a fall
outside the Candlelight Lounge on 2/10/89. I fractured it in a
fall on 12/1/89. I underwent arthroscopy with Hicha~d H,
Hallock, M.D., at Ha~risbu~g Hospital on 12/11/89, The
arthrollcopy showed numerous loose bodiea throughout the knee, At
the lateral femoral condyle there was a large area of chondral
fracture. In the area of the J.nter condylat' notch, there was a
large piece of articular cartiladge. At the patello femoral
joint, the bone under the chondral fracture Willi abraded, as wall
the bone of the lateral femoral condyle under the chondral
fracture. r underwent a aecond arthroscopy with Hichard H.
Hallock M.D, at Harrisbu~g Hospital on 11/19/90. I had
chondromalacia of the patella and the medial and late~al femoral
condyles. My patella was debrided. I had a bone scan on 9/16/91
which showed degenerative joint disease of the right knee. I
underwent a third arthroscopy of the right knee with Dr. Richard
Hallock at Harrisburg Hospital on 12/~6/95, I underwent an
inpatient admission at the Hehab Hospital of Mechanicsburg from
2/15/96 to 2/24/96 which was in pa~t caused by right knee
problems. I underwent an MRI of the dght knee on 2/28/96. It
found num~rous defects, inclUding signal changes involving the
bod.y and lateral aspect of the posterJ.or ho~n of the lateral
meniscus, consiatent with tearing, post-operative change, or a
combination, a large osteochondral defect along the lateral
aspect of the lateral-femoral condyle, a small effusion,
extensive articular degone~ative changes, particularly of the
lateral compartment, and to a lesser extent, at th~ medial and
patello-femoral compartments, and mild degenerative changea of
the medial meniscus. I underwent a fourth arthroscopy wJ.th Dr.
Rioha~d Hallock at Harrisburg Hospital on 3/11/96, It found
numerous defects within the knee, including osteophytes along the
femoral condyles along the intercondylar notch, some attenuation
of the ACL, Grade III Chondromalacia of the articular cartilage
of the lateral femoral condyle and lateral tibial plateau, some
degenerative fraying of the late~al meniscus, and periarticular
osteophyte along the lateral femoral condyle. My knee was
debrided again that time, I unde~went a second rehab admission
at the Rehab Hospital of Mechanicsbu~g from 3/26/96 to 4/11/96,
in pa~t caused by the right knee problems, including an early
flexion cont~acture of my right knee. In addition, at least
during the period from 6/95 to 9/30/96, I underwent nume~ous
inj ections to my left knee by D~, Richard Hallock. I inj ured my
right knee again in an auto accident on 11/26/96. The names and
addressee of Dr. Hallock, and the other nledical providers listed
above have been provided in the Answer to Interrogatory number 4,
With regard to my low back, I injured my low back in 4
separate ca>: accidents between 1976 and 1980. I J.njured my low
back in at least one workers comp accident which occurred In 1980
or 1981. On UnO/68, I underwent a lumbar MRI which showt!d a
small central disc herniation at L5-81. I injured my low ~~k in
the fall outsid~ the Candlelight Lounge on 2/10/89. I injured my
