Since the entry of said Order, there has been a significant change in circumstances in that:
a. Mother has been acting in an unstable behavior while the child is in her custody
the child has stated that Mother frequently abuses alcohol, Mother has several different
people spend the night at Mother's house on a daily basis, Mother participates and holds
late night party's until 3:00 or 4:00 o'clock a.m., and when Mother is not home partying
she is out partying leaving the child home alone, then when she return's home continues

I. The Plaintiff Is DAVID E. MELLOTT, hereafter referred to as the natural
father, residing at 72 Spring Garden Estates, Carlisle, Cumberland County,
Pennsylvania, 17013.
It. The Petendant is STSPHANIX M. MELLOTT, hereafter referred to as the
natural mother, remlding at 806 Highland court, carlisle, Cumberland
county, Pennsylvania 17013 .
III, The parents agree that this Stipulation shall pe entered as an order and
Court and filed in the Cumberland county court of common Pleas under
Docket No. 96-6912. Accordingly, the parents acknowledge and understand
that this Stipulation shall have the full force and effect of a Court
order and a breaching party may be subject to contempt penalties and/or
criminal prosecution for interference with custody of Children. Further,
a breaching party shall pay any and all costs, expenses and counsel teem
incurred by the other party in endeavoring to protect and enforce him or
her rights under this Agreement. The parents acknowledge and agree that
a breach by one party shall not justify or excuse a breach by the other.

The appropriate remedy for enforcement of this Agreement shall be through
the court and the parents shall not use self-help or with hold the child
from the other parent in violation of this Agreement.
IV, The parents, DAVID 8, MALLOTT and ATKPNANIK M. MELLOTT agree to the
following custody terms regarding custody of LAKIRANA MKI,rLOTT, and
request the terms be entered as an order of courts
V. The parents shall have joint, shared legal and physical, custody of the
Child,
A,1. The parents agree that effective 11130 p.m. each Saturday, the
child shall go from the custody of one parent to the custody of
the other parent which shall alternate weekly thereafter. on
Tuesdays and Thursday evenings each week, the parent who does not
have custody of the child shall have partial custody from 6s00
p?m* to 8s00 p.m., picking up and returning the child to the
custodial parent.
A.Z. (a)) The parents agree that the times not forth in sections A.Z,
A,b, shall have precedence over those of Paragraph A,l,
aboves the parents agree they shall alternate annually

0. The parents shall notify each other in a timely fashion, if it is
necessary, due to an emergency or unforeseen circumstance for him or her
to be delayed at any of the times not out herein. It is intended,
however, that time be of the essence, and that the parents as strictly
as possible comply with the times set forth herein.

1. Each notify the other parent when a child is away from the
child's primary residence for more than two consecutive
nights and will provide an address and phone number where
the child can be reached.
2, (a)) Both parents shall promptly advise each other of the
names, addresses and phone numbers of any babysitters

forts to use the some baby-sitter or day care provider
whenever possible.

and address of any school the child are enrolled in and the
name of their teachers and leaders for any activity in which

4? The parents agree that the out of custody parent, wherever
passible, shall provide child care wheii the other parent in
not available to personally care for the child. Whenever
possiblef the parents agree to contact each other to provide
care for the child if the then custodial parent is unable to
do no for more than 3 hours at a timer neither parent shall
be required to provide such child care but a third-party
shall not be used to provide child care if such instances
without first seeing if the then non-custodial parent is
willing to provide ouch care. This is not to be interpreted
to mean that the non-custodial parent may then have a third-
party provide child care.
1}. The parties will notify and consult with the other party immedi-
ately in cases of medical emergencies that occur while the child
is in their custody.
R? Both parties agree to assure the child attend activities scheduled
for the child during their periods of shared custody, such as but

not limited to school events, activities and outings, swimming and
other much lessons, birthday and other parties to which the child
is invited by friends. The parties agree to keep each other
timely advised as to these events and activities.
/. Neither parent shall do anything which may estrange the child
from the other parent or injure the opinion of the child as to the
other parent, or which may hamper the free and natural development
of the child's love or affection for the other parent.
4? Husband and wife acknowledge that it is in the best interests of
the child to have reasonable and liberal contact with both parents
so as to maintain a normal parent-child relationship with both
parents.
H. The portion agree that in making thi¦ Agreement, there has been no
fraud, concealment, overreaching, coercion, or other unfair
dealing on the part of the other.
I. Any modification or waiver of any of the provimlons of this
Agreement shall be effective only if made in writing and only if
executed with the same formality as this Agreement.
J? The parties agree they shall consult each other regarding any
elective medical or dental procedures which it may be necessary
for a child to undergo, and that each is entitled to receive
copism of and to consult with teachers, physicians, or any other
person involved in caring for, educating, treating or consulting
with one or both of the children. Neither parent may prevent the
other from such access to information about the children.
K. The parties agree each parent shall be responsible for support and
for meeting the child's needs during each parents period of

AND NOW, this N ` day of May, 2011, upon consideration of the attached Custody
Conciliation Report, it is ordered and directed that this Court's prior Order of March 24, 1998 is
vacated and replaced with the following Order:
1. The father, David E. Mellott, and the mother, Stephanie (Mellott) Ayers, shall enjoy
shared legal and shared physical custody of Lakiesha Mellott, born November 30,
1993.
2. Physical custody shall be handled as follows:
A. For three weekends out of four each four week cycle, mother shall have
custody from Thursday at approximately 5:00 p.m. until Sunday at
approximately 5:00 p.m. The weekend that father has custody, mother shall
have custody the Thursday night prior to that weekend from after school until
when the child needs to go to school on Friday. Father shall have physical
custody on the other days not specified to apply to mother.
B. The parties may modify this custody schedule as the parties agree, and the
parties are directed to be flexible with each other and the minor child with
respect to modifications on the schedule.
C. The schedule set forth in subparagraph A above shall apply during the school
year with the parties reverting to a week on/week off schedule during the
summer months.
3. Legal counsel for the parties shall conduct a telephone conference with the Custody
Conciliator on Thursday, June 23, 2011, at 8:00 a.m. At that time and in the event
the parties are dissatisfied with this Order, the parties may proceed to a hearing or
otherwise have another custody conciliation. In the event the above schedule is
satisfactory to the parties, legal counsel for the parties shall contact the conciliator
and cancel the telephone call.
