Rlohard Wagner, and present for the Defendant, Callahan, ls I\ttorney Hubert X. allroy. 1\ divoroe oomplaint was filed on Deoember 23, 19915, raising grounds for divoroe of irretrievable brel1kdown of the marriage. Counssl have advised that the parties will sign and file affidavits of oonsent and waivers of notice of intention to rsqUest entry of divorce dsores so that thu divoroe oon bs oonoludsd under Section 3301(0) of the Divoroe Code. The oomplaint also raised the economic claims of equitaple distripution, alimony, allmony pendente lite, oounsel fees and costs. With respect to the alimony Claim, oounsel for husband is going to see it hls client will stipUlate that he was having an extra-marital affair. It not, then Mr. allroy will advise the Master and Mr. Wagner that he needs to have some time to take testimony and offer witnesses on the marital misconduot issue, if wife persists in her olaim that husband was having a relationshlp with another woman whlle the parties were married and llving together. The parties were marrled on May 21, 1991, and separated November 21, 1986. They are the natural parsnts of two ohildren James E. callahan, III, porn I\pril 24, 1986, and Janeile Elaine Callahan, porn January 9, 1991. The childrsn are in the custody ot wife. Wite is 41 years ot age and resides at 1885 Rachel Drive, Carlisle, Pennsylvania, where she lives with the two children. She is a high school graduate and currently works part time aa a teacher'S aid at the Carlisle School . Distriot, netting $242.00 every two weeks. ~ooording to Hr. Wagner sne will nave medioal insuranoe ooverage available to her tnrougn ner employment, but sns most likely will nave to pay tne oosts ot ooverage, Mr. Wagner is going to determine wnat tnat oost will be. Wite suttered a knee iniury about a year ago and is ourrently walking witn some impediment, but tne injury does not prevent ner from doing ner job. wite is ourrently reoieving $671.00 per montn in onild support, and $433.00 per montn in spousal support. Husband is 39 years of age and resides at 645 Park Ridge Drive, Meonaniosburg, Pennsylvania where wife believes he lives witn a female triend. Husband's attorney is not oertain wnether or not he is living alone or living with anotner person. Husband is a high sohool graduate, and is the manager at tne Best Western motel in Middlesex Township. His annual inoome is reported at $55,000.00. Husband is direoted to file an inoome and expense statement providing pay stups within the next eight weeks. Mr. Wagner suggests that huspand may have additional inoome as a result of oommissions tnat he earns from vendors tnat have pusiness at the hotel. This issue was not raised when the support order was entered put wife apparently pelieves tnat husband had other inoome as indioated, and Mr. Wagner wanted to put us on notice that that may be an issue. Huspand nas not raiRed any health issues, The parties own real estate at lBB~ Racnel Drive, carlisle, Pennsylvania. The house was appraised by Wolfe and Shearer and oounsel will stipuilatA tnat the appraisal plaoed the market value at $109,000.00. Huspand indioated tnat the mortgagee is Meridian Bank, wnioh is now First Union with a payment of $600.00 per montn. Wife indioated the mortgagee is Harris savings Bank with a mortgage payment ot $705.00 per month. Counsel shOUld pe aple to obtain the aoourate information with regard to the mortgagee and payment by the hearing date. Mr. Gilroy has also raised a question of rental value put it may pe that the payments that wife is making for the mortgage, taxes and insurance are nearly equal to the rental value. The parties each have a vehicle which neither party identified as to year. Wife han a Saturn and husband has a Ford Explorer, lluspand'n counsel indicatod that after he determinen the year of the vehicles, he may llOVO tho vehicles apprained. Mr. Gilroy indioated that he ie going to talk to his client to determine if he wanta to have the property nppraiued. The pre-trial statementa liot marital debt and husband has boen assumming the debt and making the payments. So huaband oan rocoivo oredit for payment or debt we ahould have verification ot the date ot separation balanoes on the various oharges. The main iasue in this oase is how we oan dnvise distribution ot the major marital asset, whioh is the real estate, since wife is living the~e with the ohildren and has no means to buyout husband's interest, and sinoe there are no ott setting assests which husband can receive. One of the suggestions was that wife should waive her olaim for alimony in return tor the husband relinquiShing his interest in the real estate, but the Master indicated that that did not seem possible upon roview or the factors of the oodol furthermore, without alimony, wif,e would not bo abie to make the payments to maintain the property, Based on disoussions with counsel, it was suggested that a distribution of husband's equity in the house b~ deferred for a period of time to allow wife to remain there with the children. It was suggested that perhaps a oompromise might be to wait until the older child is graduated from high SCllool, As the Master has noted above, he does not belisve he is able, under the oode and looking at the factors that he can offset wife's claim for alimony against a marital asset. Under the circumstanoes that the Master is aware Of, with respect to the differenoe of income of the parties wire's custody of dependent minor children, and the ability to acquire assests in the future, wife would be entitled to alimony. Callahan, Jr. (hereinafter "Father"), Defendant in the above- captioned custody action. 2. Respondent is Joyce E. Callahan (hereinafter "Mother"), Plaintiff in the above- captioned custody action. 3. The parties hereto are the natural parents of one (I) minor child, namely: Janelle E. Callahan, born January 9, 1991. 4. The minor child and the parties' emancipated son, James E. Callahan, III (age 19), are the subject ofa Custody Order dated February 18, 1998 in the Court of Common Pleas of Cumberland County, Peunsylvania. Said Order vests primary physical custody of the minor child in Mother subject to Father's periods of partial physical custody on alternating weekends and one 1:\Kris\Callahan Petition to Mod Cust Ord.wpd August I, 2005 night per week. A true and correct copy of said Order is attached hereto, made a part hereof and marked Exhibit "A." 5. Father believes that it is in the best interest of the child to modify the current custody schedule for the following reasons: (a) Father and the minor child have an extremely close and nurturing relationship; (b) The minor child would benefit greatly from spending more time with Father; (c) The minor child has continually expressedl her desire to spend more time with Father; (d) The minor child has a contentious and volatile relationship with Mother; (e) Mother forces the minor child to participate in activities in which she is not interested and which conflict with her scheduled time with Father; (f) The minor child is punished by Mother for contacting or attempting to contact Father during his non-custodial time. The child is not allowed to email, text message or phone Father whiJt: in Mother's custody and is not allowed to speak with Father at school fWlctions or activities; (g) The minor child is currently in therapy to help learn to deal with her issues regarding getting along with Mother; (h) The minor child, with the assistance ofhe:r therapist, has written the parties a letter asking both to allow for shared physical custody. The best interest and permanent welfare of the minor child will be served by granting Father shared physical custody of the minor child. 7. Each parent whose parental rights to the child have not been terminated, and the person who has physical custody ofthe child has been named as a party to this action. 8.
