~TIPULATION AGAINST LI~NS
The undersigned oontraotor, materialman or other entity or
person furnishing servioes, labor or materials, known as Kinsley
Construotion, Ino., a Pe/1nsylvania oorporation (the "cr,mtraotorT1)
intending to be legally boundt and in oonsideration of the sum of
ON~ AND NO/100 DO~LARS ($1,00/ to it in hand paid by Book-of-the-
Month Club, Ino, ("Owner") the reoeipt whereof is hereby
aoknowledged, for itself and any suboontraotors, materialmen,
laborers or anyone else aoting through or under it, oovenants and
agrees that no meohanios or materialmen's liens or olaims shall
be filed or maintained by it, them or any of them, against the
real estate desoribed in Schedul.e "A", attaohed hereto and made a
part hereof, or against any bUildings or other improvements
thereon (jointly and severally, the "Real ~state"), for or on
acoount of any work to be done or materials furnished under the
prinoipal contraot between Owners and Contraotor, dated
beoemberlJ, 1996 or under any supplemental oontracti verbal or
written, or contraot for extra work or materials re ating to and
work to be done or material furnished under said prinoipal
oontraot. The undersigned, for itself, its subcontractor~,
materialmen, laborers and anyone else acting or claiming through
or under it, hereby waives and relinquishes all right to file a
meohanios' lien, claim or notioe of intention to file any lien or
olaim against the Real mstate,
The undersigned, for itself, its subcontraotors,
materialmen, laborers and anyone else acting under or through it,
herebY irrevocably authorizes and empowers any attorney of any
oourt of competent jurisdiction of the commonwealth of
Pennsylvania, or elsewhere, to appear as attorney for it, them or
any of them, in any such court and, in its or their name or
llames, mark satisf ed of record at the cost and expense of the
undersigned, any and all claims, liens, any pleading or
instrument, or any amendment to any pleading or instrument
previously filed by it or them, to incorporate therein as part of
