COMPLAINT
AND NOW, TO WIT/ comes the Plaint~ff Nathaniel Stanley
by his attorneys, Oratic & l'ortko, upon a cause of aotion
of whioh the following is a statement:
1. Piaintiff/ Nathaniel Stanley/ is an adult indiv~duftl
residing at 300 Ridge Road, Lot 84, ~tterll/ ~A 1731~.
2. Defendants, George F, Sullenberger, Jr. and Ellen M.
Sullenberger, are adult individuals, husqand and wife,
residing at es Millers Gap Road, Enola, Cumberland County/
Pennsylvania 17025,
3. Defendants are owners of certain real e~tate located
at 481 Sample Bridge Road, Enola, Cumberland County,
Pennsylvania.
4. The aforesaid real estate is improved with a
rellidenoe and isoooupied by Defendant's father, George F.
Sullenberger, Sr., who was the previous record owner and who
has resided there to date since at least 1983.
5, On or about June of 1995, Defendant's father, George
F. Sullenberger, Sr., contacted the Plaintiff and requested
Plaintiff to excavate, grade and pave the driveway and
parking area on the premises located at 481 Sample Dridge
~qad/ ~nola, ~Qnnsylvaijia,

Plaintiff agreed tq perform the aforesaid servioes fqr the
cqntract price of ~ight Thousand Dollars ($6,000,00). A tr\.le
and cqrreot cqpy of the propqsal is marked Exhibit "~"/
attaohed hereto and inoorporated by reference herein.
6. Plaintiff believes and therefqre avers, that
sometimQ durin~ the performance of the work at 461 ~ample
Bridge ROad, Defendant George F. Sullenberuer, Jr. inspected
the ~ork, approved and/or ratified the contract entered intq
by his father and promiijed his father to pay the cqntract
price,
9, At no time did the Defendants or Georue f.
Sullenberger, Sr. make any objection of whatever form to
Plaintiff in regards to the correotness and completeness 'If
the work performed or the contents of Exhibit "A", with the
exoeption that George F, Sullenberger, Sr. unjustly demanded
that Plaintiff perform additional work not included in the
parties' agreement for the price quoted,
10. Plaintiff performed the work required by the
agreement in a good and workmanlike manner and performed all
other oonditions precedent to George F. Sullenberger's (Sr.)
obligation to pay for the work performed.

persistently and w~llfully refused tq ~ay/ and nqw cla~ms
that h~s son Defcndant Qeorqe F. Sullenberqer, ~r'l who is
the owner of the premises, should pay.
12. At no time priqr to completion of the work
did Geqrge F, Sullenberger, Sr, inform Pla~ntiff that his
son, Defendant George F, Sullenberger, ~r., was the actual
owner of the property.
COUNT I - UNJUST ENRICHMENT
13. Pla~ntiff incorporates the allegations of paragraphs
1 thru 13 inclusive as if fully set forth at le09th.
14. The labor and materials supplied by Plaintiff were
incorporated into a property belonging solely to Defendants
George F, Sullenberger, Jr. and rellen M. Sullenberger anQ has
improved the value of Defendants proper,ty in the amount of
Eight Thousand ($6,000.00) Dollars.
15. 'The improvements to the Defendants' property,
consisting of a paved driveway and parking area, could not
have been completed wi~hout the labor and materials suppli~d
by Plaintiff.
16, Defendants knew or should have known that .George F.,
Sullenberger, Sr, entered into a contraot with Plaintiff for
the excavation, gradin9 and paving of the property and that
improvement to their real estate in the Bum of $6,000.00 was

17, As a re~ult of tho Plaintiff's labor and materials,
Defendants have become un~ustly enriohed at Plaintiff's
ex~ense by the amount set forth in Plaintiff's invoioe.
16. Oefendants permitted qeqrqe ~. Sijllenberger, Sr. to
improve their premises located at 461 Sample n1:'idqe Road/ for
their joint benefit.
19. By reason of the failure of George F. Sullenberger,
Sr, to pay to Plaintiff the sum which Plaintiff has demanded,
a sum equal to the fair market value of the goods and
servioes/ Defendants have been and oqntioue tq be unjustly
enriched to the extent of suoh unpaid amount, plus lawful
intereijt upon such amount,
WHEREFORE, Plaintiff demands judgment against
Defendants, individually, jointly an~ severally, in the
amount of Eight Thousand Dollars ($6,000.00), plus oosts and
interest as provided by law,

21. Plaintiff, being unaware that George F,
Sullenberger~ Sr, was not the owner of the premises, filed
suit against George F. Sullenberger, Sr. in the Court of
Common Pleas of Cumberland County, filed to No. 95-6161 Civil
Term, to collect the contract price of $6,000,

a property claim/ thereby halting the exeoution prooess.
25. The Sheriff of Cumberland County entered a prqperty
claim determination in favor of George F. Sullenberg~r/ ~r.
on May 8, 1996,
26. On May 17, 19~e Plaintiff timely filed an objection
to the aforesaid Sheriff's property olaim determination and
the matter was submitted to the court for a hearing on the
sheriff's interpleader action,
27. At a hearing pefore the Honorable J, Wesley Oler
Jr., on Decembsr 2, 1996, at which hearing George F.
Sullenberger, Jr. failed to appear, an judgment was entered in
favor of Plaintiff sustaining Plaintiff's objection to George
F. Sullenberger's (Jr.) property claim and awarding Plaintiff
attorney's fees as part of the costs.
28. Defendant George F, Sullenberger, Jr, has
deliberately engaged in a course of conduct to prevent
Plaintiff from oollecting the usual and reasonable market
prioe of the improvements made to Defendants property and,
further, from such action can pe inferred an intent to use
Plaintiff filed a Praecipe for Exeoutiqn on April

P.laintiff that Qeorge F. Sullen~erger, Sr. was nqt the qwo~r
'If tho property and that he did not have sufficient asaets to
pay the work performed by Plaintiff in the amount 'If
$6,000.00.
30. As a result of Defendant's conduct/ Plaintiff haa
wasted valuable tim~ and resources in the pursuit of h~s
claim for damages while Defendant and Defendant's father have
enjoyed the benefit and use of the improvements made to
Defendants' property all to the detriment and loss of
Plaintiff,
WHEREFORE, Plaintiff respectfully requests that this
Honorable Court enter judgment in nis favor and againat
Defendant George F. Sullenberger, Jr~ for punitive damages/
in an amount to be set by the court, together with
reasonable attorney's fees, interest and oosts of suit.
