1. The partills hereto mutuelly oovenant and agree that the real Ejstate they own
Jointly, as tenants by the entireties, and being known and numbllred as 23 Chestnut OrlvEl,
Cl;lrllslll, Pllnnsylvania, shall be sold for the highest obtolnable fair market price therefor. To
accomplish such sale, the partlea hereto repreaent that they have IIstlld such real estate for
lIale with a reeltor SlIleoted by them, and that they will, eech of them, cooperate with said
realtor and any other peraon Showing or vlllwlng sold property, to effectuate the prompt
aale of the property for the highest reasonably obtainable sale price. The parties agree that
the proceeda of the sale of said real estate, aftor the payment of the expenses of sold sale, ,
to Include a reasonable realtor's commlaslon, shall be applied to pay the mortgege on the
property and to pay any and all other liens or llncumbranoes of record 110 as to give and
deliver a good and marketeble title at the tlma of settlement. The net proceeds of sale of
such settlement after the payment of the expenses of the aale and of ellllena and
l)ncumbrances on sold property, shall be divided equolly between the partlea. The properw
ehall remain listed twealter until such time aa It la sold and the partie a shall cooperate In
good felth In accomplishing the sale.
The parties further agree that they shall each asaume liability lor his or her respective
share of any Federal Capital Gains Texes which may be assessed hereafter as the rosult of
the sale of the Jointly owned real estote, and it Is agreed between the parties that they shall
satisfy their respective liabilities, at tholr respective options, by qualifying for an exemption
or by paying any taxes due,

3. Wife does hereby grant, convey, transfer, assign, and deliver and set-over unto
Huabond the followlno assets, which said assets shall be end remain ihe sole and separato
property of Husband hereafter, f,oe of any clelm by or interest of Wife, regardless of
whether such assets were deemed by either of the parties to be marital property or non-
marital property before:
A. Husband's 401 (k) plan, profit-sherlng plan and/or pension or
retirement plan with his present or past employer(s):
B. The balance In the Artlaan Mutual Fund. In the event that suoh
fund Is held In lolnt nomos, Wife sholl make, execute, acknowledge and deliver

4. The parties hereto mutually llgree that they have effected a satisfactory division
of the furniture, hOUSllhold furnishings, appliances, and other household and personal
property between them end they mutually agree that each party shall, from and alter the
date hereof, be the sole and separate owner of all such tangible persQnal property presently
In his or her possession, whether said property was heretofore owned jointly or Individually
by the partlea hereto, and this agreement shall have the effect of an assignment or receipt
from each party to the other f<;lr such property as may be In the Individual posse!!slons of
each of the parties hereto, the effective date of said bill of sale to be contemporaneous
with the date of the execution of thla Agreement.
6. The parties acknowledge that they are aware of the Income, education, income
potential, and assets and holdings of the other or have had full and ample opportunity to
become familiar with such Items. Both parties acknowledge that thay are able to support
and maintain themselvas comfortably, without contribution from the othe.r except as

dated April 4, 1997, the full-time Master has been appointeq in
the above referenoed divoroe prooeedings.
A divoroe oomplaint was filed on Deoember 311, 1996,
raising grounds for divoroe of irretrievable breakdown of the
marriage. No eoonomio olaims were raised in the oomplaint.
On Maroh 24, 1997, an'answer and oQUnterolaim were filed
in response to the oomplaint. The oounterolaim raised the
eoonomio issu~ of equitable distribution.
I am going to prooeed on the basis that grounds for
divoroe are not an issue and that the parties will sign and file
affidavits of oonsent so that the divoroe oan be oonoluded under
Seotion 3301(0) of ~he Domestio Relations Code. Based on that
assumption, I am direoting eaoh to oounsel in aooordanoe with
