I\t all timell relevant to thill CQmplaint, Defendant ~Q~ert MqJnroy, M.P. maintained an Qffice and re9ular plaoe Qf ~usiness in Camp HU I, Cum~erland county, Pennsylvania. 8. At aU times relevant tQ this CQmplaint / Defendant Rol)ert MeJnroy, M.P. oeld himself Qut to the publio as a specialist in internal medicine. , 9. Hr. Moyer had a medical history of a oerebral vasoular accident in 1994 which had peen eharaoterized by an aoute Qnset of vertigQ, diseqUilibrium, and left partial hemiparesis, frQm which he reo overed well. 10. On tOe morning of July 9/ 1995, Mr, Moyer again developed an acute onset of yertigo, unsteady gait, weakness of the left hand and slurred speeoh. , 11. On July 9/ 1995/ Mr. Moyer reported to the emergency room of lIoly Spirit Hospital with oomplaints of dizziness, slurred speech, diaphoresis, and pronounced tingling of his left arm. 12. Mr. Moyer was subsequently admitted to the Holy Spirit Hospital ()n the same date under thE\ service of Defendant Robert McInroy, M,D. :;! 3 ~:j. pefenelant Jo1olnroy' e dhe:,\lQst~e imprese~Qns at the Ume of Hr. HQyer's hQspit~l admissiQn were acute posterior foesa Qere~ral vase\lJar aeoident, recurrent I insulin~dependent diapetel'l meUth with retinopathy and nephropathy, and hypertensive vascular diseaee. 14. WhHe a patient at the Holy /Iol'lpital, Hr. Moyer was found to have fluctuating ~lQQd sugar levels. 15. On Qr apollt July 11, 1995, at apprQx!mately 6 p.m., a memper Qf the HQly Spirit nursine:, staff found Mr. Moyer lying on the floor near his peel. 16. Mr. Moyer had fallen while getting out of bed to use the bathroom. 17. Despite Mr. Moyer's reports of vertigo, unsteady gait, and left eided weakness, despite Mr. MQyer's fluctuating blood sugars, and despite Mr. Moyer'S diagnosis of reourrent cerebral vascular accident, only two of the four rails of Mr. Moyer'S bed were up at the time of the aeoident. 18. When found lying on the floor, Mr. Moyer complained of left leg pain. 19. Mr. Moyer was subsequently diagnosed as having suffersd a left intertrochanteric fracture during the fall. 20. On July 12, 1995, Mr. Hoyer underwent open reduotion and internal fixation of the left intertroohanterio fraoture. 21, FQUQwinl1 the aforeea$.d fiI~rl1ery, Mr. MQy~r l1el1an tQ QQm~lain Qf left heel pain. 22. I)ur!nq his postoperative course at the Holy Elpirit UQspital, Mr, Moyer developed an lllcer on hi13 left heel. 23. Despite their knowledqe Qf the fact that Mr. Moyer suffered h'om diabetes, Defendants failed to take measures to prevent, treat or halt the further formatiQn of heel ulcers. 24. On .ruly 20, 199!i, Mr. Moyer was transferred from the HQly Spirit UQspital tQ the POlyclinic Medical Center. 2!i. At the time of his admission to the Polyclinic Medical Center, Mr. Moyer was noted to have a staqe H or staqe UI ulcer of the left heel. 26. Mr. Moyer had also developed an uloer on his right heel. 27. Despite protracted and intensive treatment of the heel ulcers, they ultimately progressed to the point where skin grafting was neoessary. 28. The injury to Mr. Moyer's left hip, as well as the heel ulcers, were a direct and proximate result qf the negligenoe of Defendants Holy Spirit IIQspital and Robert MCInroy, M.D. 4 gm,zHT-l p~~B JQQI~ij A. AecQrdinqly, Defendant UQly Spirit Uospital is liable to the Plaintiff fQr the negliqent acts Qf its agents, apparent agents, servants, and/or employees as set forth in para'Jraphs 34 through 44 below. 32. Plaintiff's injuries as alleged herein were a direct and proximate result of the negligenqe of the agents, apparent agents, servants and/or employees of Defendant Holy Spirit Hospital as set forth in paragraphs 34 through 44 below. 33. Said agents, apparent a~ents, servants and/or employees failed to respond to Mr. Moyer's oalls for assistanoe to go to the pa throom . , I ~7. Said a~ents, apparent agents, servants and/or employees tailed to seo to it that all of Mr. Moyer'S ped rails were placed up 60 as to prevent him getting out Of and/or falling out of bed. 39. Said aQents/ apparent a~ents, servants and/or empIQyees tailed, following Mr. Moyer's Qpen ~eduotiQn and internal fixation surgery, tQ preseribe/ ~eoommend and/or utilize foam rUbber booties or similar devices for Mr. Moyer in order tQ prevent/ to reduce the likelihood of the development of and/or to halt the spread of, diabetic fQot ulcers. 43. Said agents, apparent a~ents, servants and/or employees tailed, at the time that they did notioe, or should have notioed, that Mr. Moyer's had developed a blister on his left heel/ to institute antibiotio therapy to treat and/or prevent the further deVelopment of such ulcer. 44. As a direct and proximate result of the aforesaid injuries, Mr. Moyer incurred liability for medical and rehabilitative expenses, and a claim is made therefor. 47. As a direct and proximate result of the aforesaid injuries, Mr. MQyer underwent great physical and mental pain and sUffering, great inconvenience in carrying out his daily activities, and a loss of life's pleasures and enjoyment, and a claim is made therefor. 48. As a direct and proximate result of the aforesaid injuries, Mr. Moyer euffered great humiliation and embarrassment, and a olaim is made therefor. 49. As a direct result of the aforesaid injuries, Mr. Moyer suffered a loss of earnings, and a olaim is more therefor. 50. Accordingly, Defendant Robert McInroy, M.D. was'lIt al~ times responsilJle for the care that Mr. Moyer received while he was the Holy Spirit Hospitlll and for the ooordination and supervision Qf such care. 64. Defendant Ropert McInroy, M.D. failed, at the time that he aia notice, or ~houla have noticed, that Mr. Moyer haa developijd a blister on his left heel, tQ institute antibiotio therapy to treat and/or prevent the further dllvelopment Qf suah ulcer. , 65. Defendant Robert MeJnroy, M.O, faUea to reeognhe that the blister that had developea on Mr, Moyer's left heel was a diabetic foot uloer and to treat it as such. 66.
