A. It will be lawful for each party at all times hereafter to live separate and apart from lhe

Wife each represent and warrant to the other that he or she has made a full and complete disclosure
tq the other of all assets of any nature whatsoever In which such party has an Interest, qt'the sl)urces

the subject matter of this Agreement. Wife acknowledges that she was represented by Kathieen

Wife hereby agrees to CQnvey all his ril!ht, title and Interest In said property to Husband. Wifll
agrees tq execute a deed Qr other instrument of conveyancinl! necessary to effectuate this transfer at
tho timo of tho OKecution of this document.
Tho parties acknowledl!ll'that there is an eKlstlnl! mortgage agall15t this property in the amount
ofapproKlmately $39,000.00. Husband agrees to obtain financing such that he shall either satisfy sald
mqrtgsge in total or shall assume total liability for Ihe mortgal!e eliminating Wife's liability for this
obligation within SiKty (60) days of the date of this agreement. In the event that Husband is unable
to obtaln such Ilnanclng he will list the house for sale and sell the house so as to satisfy the liability

The parties believe and asree, and have been so advised by their respective atlQmeys. that the
division Qfproperty heretofore made by this Agreement is a nqn.taxable division of property between
co-owners rather than a taxable sale or exchange qfsuch property. Each party promises nQt tQ take
any JlQsltion with respect to the adjusted basis of the property assigned to him or her or with respect

A. CUSTODY AND VISITATION. The partie$ shall sharo legal custody qfthe child
born Qflhl$lnarrlage. The chUd shall reside with his Mother who shall have primary phyail,1al cuslQdy.
Wife ~hall provide Husl)and with InfQlmation l,1Qncerning his health, education and welfare qn a
regular basis and shall encourage Husband to jQin In the decision making process as to the child's
sChQQllng, medical care and olher ImpQrtant issues assQclaled with hl$lIfe.
Husband shall be 'alfQrded partial custody under Ihe follQwing schedule:
1. Every Qlher weekend Ihe child shall be with his father from Friday at
6:3() P.M. unlil Sunday at 6:30 P.M. Wife shall drqp olfMichael at the hQme of the
paternal grandparents. Husband shall dmp Qlf Michael at Wife's residence at the
conclusiQn oClhe visit.

Oecember 2(jlh. In 1999, Wife will dr()p Michael ()lfat ti:30 P.M. Christmas Eve and Hus~and
will dr()p him ()ft'at2:00 P.M, Christmas Day.
These p~rlods will alternate every year with Ihe Choslmas Eve perl()d being
. the Wife's In even numbered years and the Hus~and's in ()dd numbered years.
(8) Easler. The Easter h()liday shall be designated as Ihe perl()d from 6:30
P.M. Friday unlll Sunday al 6:30 P.M. In 1998, Michael shall spend the Easter h()liday with
his M()lher. In 1999, Michael shall spend the Easter h()liday with his Father. Thereafter the
parties shall alternate Ihe Easter holiday every year.
(C) Husband shall be enlitled to have Michael alternate h()lidays, the
holidays being Mem()rlal Day,luly 4th, Labor Day, Thanksgiving and New Year's Day,
with Michael being in the custody of Wife ()n the flrst holiday, Memorial Day.

B. MAKE.UP TIME - The parties recognize thallhere may be clrcumstlllces from time
