the Court of Common Pleas of Cumberland County, by Decree dated May 15. 1996, and docketed

4. I'rlor to the Decree in Divorce, the parties entered into a Marital Settlement
Agreement date~ April 26, 1996 (hllreinaftllr "Agreement"), A tme and a correct copy of that is

5. In the negotiation IInd exeC\ltion of said Agreement, both parties were represented
by IndepenrJent counsel who ftllly advised with respect thereto,
6, Prior to the divorce, the Jlllrties were owners as tenants by the entireties of a certain
undeveloped building lot situated In South Middleton Township, as more ftdly described in (he deed
indexed In the Recorder of Deeds of Cumberland Cm/nty in Plan llook 65, Page 13, A tnlc and
correct copy ofsaid Deed Is lIttached hereto a/ld mllrked Exhibit "C."

8, The parties hereto entered into an Agreement of Sale for said lot and selllement
occurred on December 20. 1996, A copy of Ihe selllement sheet is allached hereto and marked a~
Exhibit "0",
9, The net proceeds paid at said selllement were $12,420.78 as Indicated on line 603 of
Exhibit "0",
10. At the time of selllemcnt on December 2<l, 1996, the mortgage balance was
$28,069.10 as Indicated on line 504 of Exhibit "0:, which was paid at settlement
11, Defendunt has refused to divide Ihe selllement proceeds In accordance with the
Article 10 of the Maritul Settlement Agreement.

funds, plus accumulated interest propurtionate 10 her share;
b. The escrow agents shall pay Plaint ill' $3,840.75 from the escrowed

c. Defendant shall reimburse "Iaintill' for all counsel fees and other

A. Harital ae.idenoe. The parties are the own.~e, as
tenants by the enti~eties, ot a house and lot at 590 Qoxwood
Lane, South Middletom Tqwnship, Cumtlerland county, Pennsylvania
(hereinafter referred to as the "Marital Residenoe"), and have
stipulated the value ot same as of May 1994 and as of the date
hereof at $105,000.00. This prope/:'ty is subjeot to a flrst
mortgage in favor of Harris Savings and a home equity loan in
favor of Members First Federal credit Union. As of the date of
separation, May 1994, the balanoe owed on the mortgage was
$19,462.00 and Wite has made all payments on same from then to
the present, and the balanoe owe~ on the home equity loan was
$26,099.29, and Husband has made all payments on this loan from
then up to the present.

that the funds in all of these aqoounts have already been divided
and distributed to their mutual satisfaotion.
3. RETIREMENT ACCOUNTS. ,The parties agree that they eaoh

inolude but are not limited to Wife'~ PSERS aooount, her 403(b)
aooount, /Iusband'e CSRS aooount, and his TSA aooount. The parties
agree that each shall retain, as his/her sole and exolusive
property, all retirement aooounts ourrently owned by him/her.
They hereby relinquish any and all interest eaoh has or might
have in the future in the aooounts of the other. Eaoh is
permitted to take whatevl;lr steps are neoessary to ensure that no .
distribution of these aooounts wlll be made at any time to the
