THIS AGREEMENT made the }.t ~day of October, 2002, by and between,
ROBERT L. COLDSMITIf, III, builder, of Pennsylvania, hereinat~;er referred to as Contractor,
AND
JOYCEA. STOUFFER, single woman, 52 West Main Street, Newville, Pennsylvania, hereinafter
referred tO as Owner,
WHEREAS, the said Contractor undertook and agreed to make certain improvements to
Own~s properS, situate in Cumberland County, Pennsylvania, known as 347 Limestone Road, Lot
No. 6, Cobblestone Estates. Carl[sic, South Middlzton Tewnship, Carlisle, Cumberland County,
Pennsylvania, more tully described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the s'am of One Dollar ($1.00) ~ said Contractor in hated paid by Owner, the
receipt whereof is hereby acknowledged, and thc further consideration mentioned in the agreement
atbresaid, for himself, and his subcontractors, and all parties acting through or under them, covenant
~d agree that no mechanic's liens or claims shall be filed or maintained by them or any of them
ag~insx the said buildings and improvements and the lot of ground appurtenam thervto for or on
account of any work done or materials furnished by ttm~ or any of them trader said contract or
otherwise, fbr, towards, in. or about the erection and construction of the ~id improvements on the
lot above described, and thc said Contractor, for himself, his subcontractors and others under him
hereby expressly waive and relinquish the right m have, file, and mainm/n any mechanic's liens or
claims against the said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenam.
