Fees and forfeiture. § Z511. General authority. Thc department shall have authority to impose requirements anti tnethods for the klcntification of domestic atxirna/s owned, kept. possessed or transported witlfin this Commonwealth. Thc dqmmnent shall authorize and record thc adoption and e.xclusive use of unique identification marks, numbers or devices, including dlstincdve branding marks, tattoos, microctffps and other forms of identification that are affixed upon domestic animals, and shall maintain a registry of suds forms of idealtifkation. The dcpamnent may establish through regulations fees for the assignmcm, rcglslry and exclusive use of forms of identificatkm registered under this subchapter. Any regulations developed under tiffs section shall not con,ct with Federal regulations regarding the identification of dmnestic animals. § 2312, Adoption of form of identilicatton. (a) General anthority. -A domestic animal Owner may adopt a brand, tattoo or other form of identification with which m identify domestic animals owned by such person through tile pn~cedum ~¢t forth Jn this subchapter. A form of identification recorded in compli,'mcc with this suhchapter shall he considered the personal property of the person who records it. Such person shall have d~e exclusive right to use d,is fom~ of identification within this Commonwealth. (b) Application, facsimile and fee. - A person desiring to adopt a form of idenfificalion sh.41 submit an application form, a facsimile of the form of idenlificafion and a recording fee of $25 to the department. 'll~e department shall provide 'he application form upon request. TI'tis fee may be changed by the dcpartmcnt through regtdations, (c) Provisional filing. - It shall be the duty of the dcpamnent to file all forms of identification offered for recording, keeping account of the date and chronological ordc£ of receipt, pending thc rcvlew examination provided for in subsection (d). If the form of idemifica6on is subsequently accepted foe recording, ownership of the form of identification shall vest £rom the date of fihng. (d) Review, -The department shall have the power to examine, approve, accept or reject an appllcalion to record a brand, tattoo or other form of identification. Following receipt of th~ rcxlUircd apl~lication, facsimile and fee, the department shall, as promptly as possible, determine whether the form of identification is of record as that of some other person and whether the form of ident.ifieafion conf]ic[s with ox closely resembles that of allother person. If neither of these conditions ex[st, the department shall record tile form of identification. If tither or both of these conditions exist, thc dcpar~Jnent shall not record the form of identification, but shall instead return the recording fcc and facsimile to the applicant.
