Reddington, husband and wife, of 302 W 1st St., Boiling Springs, PA 17007 (Cumberland County) (hereinafter "Maternal Grandparents") are Plaintiffs. B. Jennifer L. Reddington-LePore, domiclled"at 302 W 1st St., Boilillg Springs, PA 17007 .(Cumberland County) (hereinsfter "Mother") and C. John LePore, domiciled at 302 W. 1st St., Boiling Springs, PA 17007 (Cumberland County) (hereinafter "Father") are De fend ant 15 . II. BACKGROUND A. Defendants are married to each other. They are the natural mo.bher and father}f Katelyn E. Reddington- LePore, born June 10, 1995' (li.ereinafter "Katelyn"). B. Katelyn has lived with natural parents from birth, and natural parents have predominately lived with Maternal Grandparents since 1995. C. Natural parents plan to separate about Jan. 10, 2000 and they desire to provide for Katelyn's welfare until such time that they are able to provide a stable home environinent for her. Defendants st,ipulate and agree that neither of them is in a position to care for Katelyn at the present time. D. Defendants desire to give maternal grandparents prifuary physical and legal custody of Katelyn, 50 that she can be properly cared for,'ertrolled in school, and covered by hospital and medical insurance~ E. Bafties desir~ to enb~r~ihto Sn agreement whereby Katelyn's needs can be provided for until such time that one or the other parent is able to provide a stable home environment for her. F. p*pties also desire to e~tablish liberal rights of visitation and partial custody among themselves 50 that Defendants can maintain contact with Katelyn from time to time as they may agree. III. AGREEMENT NOW THEREFORE, in consideration of the above recitals which are incorporated herein by reference and of the mutual promises and contained hereinafter, and intending to be legally bound, parties hereby agree as follows: A. Mother and Father agree that Maternal Grandparents, shall have primary physical and legal custody of Katelyn, with Mother and Father retaining partial physical custody and/or visitab&bn with her as mutually agreed among the pa2ties. B. Maternal Grandparents agree to enroll Katelyn in . , '. ... ~chool, and to maintain health andho5pital in5urance on her. C. Partie5 agree that thi5 cU5tody arrangement is in the child'~ be5t intere~ts. D. Thi~ cU5tody agreement shall be effective upon the 5eparation of the partie~, currently expected to be in January, 2000, and ~hall remain in effect until ~uch time a~ they can provide a ~table home environment for Katelyn. E. Partie5 agree that this ~tipulation may be made into an order of court, and ~ubmitted to the Court for 5ame. F. No modification or waiVer of the term~ of this agreelllent 5hall be valid unle~5 in writing signed by all partie5. G. If Father and Mother are de5irou~ of reestabli~hing their former cu~tody right5 with Katelyn, and partie~ cannot agree to 5ame, then ~artie~ agree that Mother or Father must fir~t petition the court and schedule a conciliation conference or file cu~tody proceeding5 as appropriate.
