COMPLAINT
AND NOW, comes the Plaintiff, Beverly A. Toner, by and through her
attorneys, HANDLER, HENNING & ROSENBERG, by David H Rosenberg, Esquire, and
makes the within Complaint against the Defendant, Jeffrey Kuhn, and avers as
follows:
1. Plaintiff, Beveriy A. Toner, is an adult individual currently residing at 85
Mountain Street, Mt. Holly Springs, Cumberland County, Pennsylvania, 17065.
2. Defendant, Jeffrey Kuhn, is an adult individual currently residing at 42
Mountain Street, Mt. Holly Springs, Cumberland County, Pennsylvania, 17065.
3. At all times material hereto, Plaintiff, Beverly A. Toner, was the owner
and operator of a 1988 Jeep Cherokee, bearing Pennsylvania Registration Number
M92175.
4. At all times material hereto, Defendant, Jeffrey Kuhn, was the owner and
operator of a 1997 Ford F150, bearing Pennsylvania Registration Number YX01316.
5. At all times material to this action, there were no adverse weather
conditions and the road surface was dry.
6. On or about January 27, 1998, at approximateiy 7:50 a.m., Plaintiff,
Beverly A. Toner, was traveling southbound on Mountain Street in Mt. Holly Springs,
Cumberland County, Pennsylvania, approaching the intersection of Mountain and
Franklin Streets.
7. On or about January 27, 1998, at approximately 7:50 a.m., Defendant,
Jeffrey Kuhn, was traveling northbound on Mountain Street in Mt. Holly Springs,
Cumberland County, Pennsylvania, approaching the intersection of Mountain and
Franklin Streets.
8. At approximately that same time and place, Defendant, Jeffrey Kuhn,
attempted to make a left turn onto Franklin Street and began to cross the southbound
land directly in the path of Plaintiff's vehicle. Suddenly and without warning,
Defendant violently struck Plaintiff's vehicle.
9. Prior to the aforementioned collision, Erie Insurance Group issued a
poliCY of automobile insurance to Plaintiff, Beverly A. Toner. Said policy was in full
force and effect on January 27, 1998, the date of the incident. Pursuant to said
policy, Plaintiff enjoyed the benefits of full-tort coverage.
10. The aforementioned collision and the resultant injuries to Plaintiff, Beveriy
A. Toner, were the direct and proximate result of the negligence of Defendant,
Jeffrey Kuhn, generally and more speCifically as set forth below:
(a) In failing to yield the right-of-way to oncoming traffic, when

intending to make a left turn within an intersection, in violation
of 75 Pa.C.S.A. ~3322;
(b) In failing to operate his vehicle under proper and adequate control
so that he couid have avoided striking Plaintiff's vehicle;
(c) In failing to maintain proper and adequate observation of the
existing traffic conditions, namely, oncoming traffic;
(d) In failing to keep a proper lookout for vehicles lawfully on the
highway;
(e) In failing to be reasonably vigilant to observe Plaintiff's vehicle;
(f) In failing to clean the windshield of his vehicle after it had been
frosted shut, so as to be able to see oncoming traffic, namely,
Plaintiff's vehicle;
(g) In failing to exercise reasonable care in the operation and control
of his vehicle, in violation of 75 Pa.C.S.A. ~ 3714; and
(h) In driving his vehicle upon the highway in a manner endangering
persons and property and in a manner with careless disregard to
the rights and safety of others in violation of the Motor Vehicle
Code of the Commonwealth of Pennsylvania.
11 . As a direct and proximate result of the negligence of the Defendant,
Jeffrey Kuhn, the Plaintiff, Beveriy A. Toner, sustained extensive personal injuries,
including, but not limited to, back and neck strain, numbness in her left leg and a left
knee contusion.

12. As a direct and proximate result of the negligence of the Defendant,
Jeffrey Kuhn, the Plaintiff, Beverly A. Toner, sustained serious personal injuries
requiring medical treatment and physical therapy.
13. As a direct and proximate result of the negligence of the Defendant,
Jeffrey Kuhn, the Plaintiff, Beverly A. Toner, has been, and will in the future be,
hindered from attending to her usual daily activities and duties, to her great detriment,
loss, humiliation, and embarrassment.
14. As a direct and proximate result of the negligence of the Defendant,
Jeffrey Kuhn, the Plaintiff, Beveriy A. Toner, has suffered great physical pain,
discomfort, humiliation and mental anguish, and will continue to endure the same for
an indefinite period of time in the future, to her physical, emotional and financial
detriment and loss.
15. As a direct and proximate result of the negligence of the Defendant,
Jeffrey Kuhn, the Plaintiff, Beverly A. Toner, has been compelled, in order to effect
a cure for aforesaid injuries, to expend money for medicai attention. Plaintiff
continues to receive treatment and incur expenses for said injuries, and will continue
to do so in the future, to her great detriment and loss.
16. As a direct and proximate result of the negligence of the Defendant,
Jeffrey Kuhn, the Plaintiff, Beverly A. Toner, has suffered a loss of life's pleasures
and she will continue to suffer the same in the future, to her great detriment and loss.
17. As a direct and proximate result of the negligence of the Defendant,
Jeffrey Kuhn, the Plaintiff, Beverly A. Toner, has sustained a ioss of wages, and may

continue to suffer the same in the future to her great detriment and loss.
18. As a direct and proximate result of the negligence of the Defendant,
Jeffrey Kuhn, the Plaintiff, Beverly A. Toner, has sustained a loss of earning capacity,
and may continue to do the same in the future to her great detriment and loss.
19. Plaintiff, Beverly A. Toner, believes, and therefore avers, that her injuries
are permanent in nature.
WHEREFORE, Plaintiff, Beverly A. Toner, seeks damages from the Defendant,
Jeffrey Kuhn, in an amount is excess of Twenty-Five Thousand Dollars {$25,000.00L
exclusive of interest and costs, and demands a trial by jury.
