CIVIL ACTION -- EJECTMENT
1. The Plaintiff, Federal National Mortgage Association, is
a corporation organized and existing under the laws of The United
States of America, and having its principal place of businesS at
1900 Market Street, Suite 800, Philadelphia, PA 19103.
2. (a) The Defendant, Thomas G. Gilbert, is an individual
whom Plaintiff believes and therefore avers is residing at the
property address, that being 32 Millers Gap Road, within Silver
Spring Township, Cumberland County, Pennsylvania, hereinafter
referred to as the "Premises".
(b) The Defendant, Heidi L. Gilbert, is an individual
whom Plaintiff believes and therefore avers 'is residing at the
property address, that being 32 Millers Gap Road, within Silver
Spring Township, Cumberland County, Pennsylvania, hereinafter
referred to as .the "Premises".
(c) The Defendant Unknown Occupants are individuals whom
Plaintiff believes and therefore avers are residing at the
Premises.
3. The Premises which are described at E~hibit "A" attached
hereto and incorporated herein by reference, were sold at the
Cumberland County Sheriff's Sale conducted on tfeceinber 8, 1999,
after due advertisement and according to law, under and by virtue
of a Writ of Execution issued to satisfy a Judgment entered in the
Court of Common Pleas for Cumberland County at the suit of Columbia
National Incorporated v. Thomas G. Gilbert and HeidiL. Gilbert, as
Court Docket Number 99-945.
4. The Premises were purchased by the Plaintiff at the
Sheriff's Sale, said sale results being a matter of public record.
5. The Plaintiff acquired title to,the Premises on the date
of and by virtue 'of said Sheriff's Sale, and is the real and
current entitled owner of said Premises by virtue of a Cumberland
County Sheriff's Deed Poll, tobe recorded in the Cumberland County
Recorder of Deeds' Office at the earliest possible date.
6. The persDns in possession of the Premises are believed to
be the Defendants in this action and are occupying the Premises
without right and without claim to title.
7. The Defendants herein named were duly served with Notices
of the Sheriff's Sale held on December 8, T999.
8. Plaintiff has demanded possession or the Premises from
the Defendants who have refused to deliver up the possession
thereof.
WHEREFORE, the Plaintiff demands judgment for immediate
___possession of the Premises, issuance of a Writ of Possession and a
judgment of its cosl;:s and disbursements in this action.

AND NOW comes the Defendant, Heidi L. Gilbert, by and through her attorneys
KOLLAS AND KENNEDY, and respectfully answers the Plaintiff's Complaint as follows:
1. After reasonable investigation Defendant is without information sufficient to admit or
deny the averments contained in this paragraph. To the extent an answer is required, same is
denied. Strict proof demanded at trail.

trial. By way of further answer, Defendant has never received notice or service in any way related

Court Docket Number 99-945.
4. Defendant is without knowledge sufficient to admit or deny the averments contained in
this paragraph. To the extent an answer is required, same is denied. Strict proof demanded at
trial.
5. Defendant is without knowledge sufficient to admit or deny the averments contained in

6. It is admitted that Defendants are in possession of the Premises. It is denied that
Defendant Heidi L. Gilbert is without right and without claim to title. Strict proof demanded at
trial.
7. It is denied that Defendant Heidi L. Gilbert was ever served with a Notice of the
Sheriff's Sale held on December 8, 1999.
8. Defendant Heidi L. Gilbert is aware of no demand made by Plaintiff for possession of
the Premises. Accordingly, the averments of this paragraph are denied. Strict proof demanded at
trial.
NEW MATTER
9. The responses to Paragraphs 1-8 are incorporated herein by references as though set
forth in full below.
10. Thomas G. Gilbert and Heidi L. Gilbert are spouses having been married on
September 28, 1991.

11. The relationship of the parties is estranged. The parties have been living separate and
apart in the same home since September 1999.
12. Defendant Heidi L. Gilbert is entirely unaware of the action docketed in the Cowt of
Common Pleas of Cumberland County Number 99-945. Defendant Heidi L. Gilbert believes and
therefore avers that Defendant Thomas G. Gilbert received all notices and service relating to this
litigation and failed to share that information with Defendant Heidi L. Gilbert such that she could
effectively represent herself in the litigation docketed at the Court of Common Pleas of
Cumberland County Number 99-945~
13. Defendant Heidi L. Gilbert never received any notice of the Sheriff's Sale ofthe
property held on December 8, 1999. Defendant Heidi L. Gilbert believes and therefore avers that
any notices directed to her were intercepted by Defendant Thomas G. Gilbert who failed to notifY
Defendant Heidi L. Gilbert so that she could effectively represent herself incident to the Sheriff
Sale of December 8, 1999.
14. The first time Defendant Heidi L. Gilbert received any notice oflitigation concerning
her residence at 32 Millers Gap Road, Silver Spring Township, Cumberland County, Pennsylvania
was on January 10, 2000. On that date Defendant received a Complaint in Ejectment which is the
subject ofthis litigation.
15. Defendant Heidi L. Gilbert has been unemployed since June 18, 1999. Defendant
Heidi L. Gilbert has started a partnership business which is currently not making income sufficient
to support her and her minor daughter.

16. The residence at 32 Millers Gap Road, Silver Spring Township, Cumberland County,
Pennsylvania is the sole and primary residence of Defendant Heidi L. Gilbert and her daughter
Nicole Elizabeth Gilbert born July 26, 1993.
17. Defendant Heidi L. Gilbert has been deprived of any opportunity to be heard prior to
the taking of her property.
18. Defendant Heidi L. Gilbert has been deprived of the opportunity to cure any default
respecting the mortgage on her property.
19. Substantial hardship will result to Defendant Heidi L. Gilbert and her minor child if
she is ejected from the property located at 32 Millers Gap Road, Silver SpOOg Township,
Cumberland County, Pennsylvania.
WHEREFORE, Defendant Heidi L. Gilbert respectfully requests this Honorable Court
stay this action in ejectment and deny the issuance of a writ of possession until the Defendant has
had the opportunity to explore her rights relative to this suit and the suit docketed in the Court of
Common Pleas of Cumberland County Number 99-945.

PLAINTIFF'S MOTION FOR JUDGMENT ON THE PLEADINGS
Plaintiff, Federal National Mortgage Association, by and
through its undersigned counsel, and pursuant to PA R.C.P. Rule
1034, hereby moves this Honorable Court for an Order entering
Judgment for Possession in its favor and against the Defendant. In
support of this Motion, Plaintiff submits the accompanying
Memorandum of Law which is incorporated herein by reference. In
addition, Plaintiff relies upon the pleadings filed of record in
this matter which establish that there are no genuine issue as to
the right of possession.

CIVIL ACTION -- EJECTMENT
1. The Plaintiff, Federal National Mortgage Association, is
a corporation organized and existing under the laws of The United
States of America, and having its principal place of business at
1900 Market Street, Suite aoo, Philadelphia, PA 19103.
2. (a) The Defendant, Thomas G. Gilbert, is an individual
whom Plaintiff' believes and therefore avers is residing at the
property address, that being 32 Millers Gap Road, within Silver
Spring Township, Cumberland County, Penn~ylvania, hereinafter
referred to as the "Premises".
(b) The Defendant, Heidi L. Gilbert, is an individual
whom plaintiff believes and therefore avers is residing at the
property address, that being 32 Millers Gap Road, within Silver
Spring Township, Cumberland County, Pennsylvania, hereinafter
referred to as the "Premises".
(c) The Defendant Unknown Occupants are individuals whom
Plaintiff believes and therefore avers are residing at the
Premises.
3. The Premises which are described at Exhibit "A" attached
hereto and incorporated herein by reference, were sold at the
Cum~berland County Sheriff's Sale conducted on December a, 1999,
after due advertisement and according to law, under and by virtue

of a Writ of Execution issued to satisfy a Judgment entered in the
Court of Common Pleas for Cumberland County at the suit of Columbia
National IncorPorated v. Thomas G. Gilbert and Heidi L. Gilbert, as
Court Docket Number 99-945.
4. The Premises were purchased by the Plaintiff at the
Sheriff's Sale, said sale results being a matter of public record.
5. The Plaintiff acquired title to the Premises on the date
of and by virtue of' said Sheriff's Sale, and is the real and
current entitled owner of said Premises by virtue of a Cumberland
County Sheriff's Deed Poll, to be recorded in the Cumberland County
Recorder of Deeds' Office at the earliest possible date.
6. The persons in possession of the Premises are believed to
be the Defendants in this action and are occupying the Premises
without right and without claim to title.
7. The Defendants herein named were duly served with Notices
of the Sheriff's Sale held on December 8, 1999.
8. Plaintiff has demanded possession of the Premises from
the Defendants who have refused to deliver up the possession
thereof.

WHEREFORE, the Plaintiff demands judgment for immediate
possession of the Premises, issuance of a Writ of Possession and a
judgment of its costs and disbursements in this action.

deny the averments contained in this paragraph. To the' extent an answer is required, same is

8. Defendant Heidi L. Gilbert is aware of no demand made by Plaintiff for possession of
the Premises. Accordingly, the averments of this paragraph are denied. Strict proof demanded at
trial.

11. The relationship of the parties is estranged. The parties have been living separate and
apart in the same home since September 1999.
12. Defendant Heidi L. Gilbert is entirely unaware of the action docketed in the Court of
Common Pleas of Cumberland County Number 99-945. Defendant Heidi L. Gilbert believes and
therefore avers that Defendant Thomas G. Gilbert received alI notices and service relating to this
litigation and failed to share that information with Defendant Heidi L. Gilbert such that she could
effectively represent herself in the litigation docketed at the Court of Common Pleas of
Cumberland County Number 99-945.
13. Defendant Heidi L. Gilbert never received any notice otthe Sheriff's Sale of the
property held on December 8, 1999. Defendant Heidi L. Gilbert believes and therefore avers that
any notices directed to her were intercepted by Defendant Thomas G. Gilbert who failed to notify
Defendant Heidi L. Gilbert so that she could effectively represent herself incident to the Sheriff
Sale of December 8, 1999.
14. The first time Defendant Heidi L. Gilbert received any notice of litigation concerning
her residence at 32 Millers Gap Road, Silver Spring Township, Cumberland County, Pennsylvania
was on January 10, 2000. On that date Defendant received a Complaint in Ejectment which is the
subject of this litigation.
15. Defendant Heidi L. Gilbert has been unemployed since June 18, 1999. Defendant
Heidi L. Gilbert has started a partnership business which is currently not making income sufficient
to support. her and her minor daughter.
16. The residence at 32 Millers Gap Road, Silver Spring Township, Cumberland County,
Pennsylvania is the sole and primary residence ofDefendant--Heidi L. Gilbert and her daughter
1:f1cole Elizabeth Gilbert born July 26, 1993.
17. Defendant Heidi L. Gilbert has been deprived of any opportunity to be heard prior to
the taking of her property.
18. Defendant Heidi L. Gilbert has been deprived of the opportunity to cure any default
respecting the mortgage on her property.
19. Substantial hardship wiU result to Defendant Heidi L. Gilbert and her minor child if
she is ejected from the property located at 32 Millers Gap Road, Silver Spring Township,
Cumberland County, Pennsylvania.
WHEREFORE, Defendant Heidi L. Gilbert respectfulIy requests this Honorable Court
stay this action in ejectment and deny the issuance of a Writ of possession until the Defendant has
had the opportunity to explore her rights relative to this suit and the suit docketed in the Court of
Common Pleas of Cumberland County Number 99-945.

MEMORANDUM OF LAW
STATEMENT OF FACTS AND PROCEDURAL HISTORY
This is a Civil Action for Ejectment (Exhibit "A"; Ejectment
Complaint). On or about December 8, 1999, a Sheriff's Sale of the
premises situated at 32 Millers Gap Road in Enola, Silver Spring
Township, was conducted by the Cumberland County Sheriff's
Department.
The successful bidder at the Sheriff's Sale was the
foreclosing Mortgagee, this Plaintiff, Federal National Mortgage
Association.
The Sale was the enforcement of a Judgment in Rem
entered against this Defendant in a pending Mortgage Foreclosure
action, docketed in this Honorable Court as Case No. 1999-945-CIVIL
TERM, entitled Columbia National, Inc. v. Thomas G. Gilbert and
Heidi L. Gilbert.
A Sheriff's Deed Poll was subsequently recorded

now vested in Plaintiff

On or about February 11, 2000, the Answering Defendant, Heidi
L. Gilbert, filed her Contesting Answer containing New Matter
(Exhibit "C"; Defendant/Occupants' Answer).
Plaintiff now moves for Judgment on the Pleadings and this
Brief is respectfully submitted in support thereof.
LEGAL ARGUMENT
AFTER THE PLEADINGS ARE CLOSED, ANY PARTY MAY MOVE FOR A
JUDGMENT ON THE PLEADINGS.
The purpose of the Judgment on the Pleadings procedure under
the Pennsylvania Rules of Civil Procedure is to prevent vexation
and delay,
improve the machinery of justice, promote the
expeditious disposition of cases and avoid unnecessary trials when
no genuine issue of material fact is raised.
When the controlling
question raised by the motion is one of law which is conclusive of
the rights of the parties, the court may enter judgment for the
party making the motion.

There is only one basic issue in an ejectment action -- that
of the right of possession. Vlachos v. Witherow, 188 A.2d 174, 383
Pa. 174 (1955); Grossman v. Hill, 122 A.2d 69, 384 Pa. 590 (1956);
Brennan v. Shore Bras, 110 A.2d 401, 380 Pa. 283 (1955); Henrv v.
Huff, 22 A. 1046, 143 Pa. 548 (1891); Hallman v. Turns, 482 A.2d
1284, 334 Pa.Super. 184 (1984); Harbor Marine Companv v. Nolan,
366 A.2d 936, 244 Pa.Super. 102 (1976). The Plaintiff has the
obligation to prove its right to immediate exclusive possession,
and that the Defendant is in possession. Sautter v. Rowland, 131
A. 733, 285 Pa. 212 (1926); Rotunno v. Joseph, 53 A.2d 825, 161
Pa.Super. 57 (1947).
The Plaintiff hereunder has proven that it holds prima facie
good title. Perkiomen R. Co. v. Kremer, 67 A.913, 218 Pa. 641
(1907); Howell v. Mellon, 32 A. 450, 169 Pa. 138 (1895); Hallman
v. Turns, supra.. Once the Plaintiff has established, through
prima facie evidence, that such title exists, the burden of going
forward with the evidence shifts to the Defendant. The right to
possession of a premises is presumed in favor of the person in whom
the title is found or conceded. The Answering Defendant hereunder
has not raised a single shred of evidence to challenge the
Plaintiff's title claim. Nor did she file a Petition to Strike the
Judgment in Rem entered, nor did she file a Petition to Set Aside
the Sheriff's Sale after Sheriff's Sale was conducted. The
Sheriff's Deed Poll has already been recorded, and title clearly
vests with this Plaintiff.
Instead, the Defendant has raised, in her Answer and New
Matter to this Ejectment action, matters which are irrelevant and

immaterial to the issue of title. Moreover, her averments are
clearly disingenuous. Under her verified pleading, Heidi L.
Gilbert states that she "has never received notice or service" of
the Sheriff's Sale. To the contrary, appended hereto and
incorporated herein by reference as Exhibit "C" is a true and
correct copy of the Cumberland County Sheriff's Department's Return
of Service, attesting to its having effectuated personal service of
the Notice of Sheriff's Sale upon this Defendant on *. The Courts
of Pennsylvania have long held that a Sheriff's Return of Service,
showing personal service and which is full, regular and complete on
its face, is conclusive and immune from attack by extrinsic
evidence. [Hutchison Enterprises, Inc. v. Data Basics East, Inc.,
497 A.2d 659, 345 Pa.Super. 91 (1985); North Pittsburqh Telephone
Co. v. Klein, 32 D&C 3d 115 (Pa.Com.PI. 1984); Hollinqer v.
Hollinqer, 416 Pa. 473, 206 A.2d 1 (1969); Chieffo v. McKav, 105
P.L.J. 136 (Pa.Com.PI. 1957).J In the instant case, there has
been no fraud alleged and the face of the Sheriff's Return of
Service is clear and unambiguous.
Case law has long held that such alleged defenses to an
Ejectment action do not give rise to a viable defense. Hepler v.
Hosack, 47 A. 847, 197 Pa. 631 (1901); Moore v. Miller, 23 A. 601,
147 Pa. 378 (1892); Ireland v. Baqalev, 12 A. 321, 118 Pa. 148
(1888); Loqan v. Ouiqlev, 11 A. 92 (1887).

CONCLUSION
For all of the foregoing reasons, Plaintiff respectfully
requests that this Honorable Court that its Motion for Judgment on
the Pleadings be granted, that Judgment for Possession be entered
in its favor, and that a Writ of Possession be_ immediately issued.
In addition, Plaintiff respectfully requests that it be awarded the
costs of its reasonable attorneys' fees and costs in defending
Heidi G. Gilbert's contesting answer and new matter, given the
spurious and disingenuous nature of the allegations she has raised
thereunder.
