HomeMy WebLinkAbout02-5127 STIPULATION AGAINST LIENS THIS AGREEMENT made this ~k~ day of~/~/-~, between DOLL'S HOMES, INC., a Pennsylvania hereinafter referred to as Contractor, 2002, by and Corporation, ERIC E. CRESSLER AND BONNIE S. CRESSLER, husband and wife, hereinafter referred to as Owners, whereby the contractor undertook and agreed to erected and construct a dwelling on the certain lot of ground situate in Cumberland County, Commonwealth of Pennsylvania, and more fully described in Exhibit "A" which is attached hereto and made a part hereof known as 26 Appalachian Trail, Gardners, PA 17324. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by Owner, the receipt whereof is hereby acknowledged, and the further '~6onsideration mentioned in the agreement aforesaid, for itself, himself or themselves and its, his or their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for itself, himself or thems~lves,-its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. Neal, et ux, dated April 4, 1980 and May 7, 1980, more particularly bounded and described as follows: BEGINNING at an iron pin set 25.77 feet South 27 degrees 07 minutes 36 seconds · East from an existing Triple Oak; thence across an existing 12 feet wide gravel road and along the lands now or formerly of Paul K. Millard North 68 degrees 10 minutes 14 seconds East 431.96 feet to an iron pin; thence along lands now or formerly of the Commonwealth of Pennsylvania South 13 degrees 17 minutes 34 seconds West 118.87 feet,to 'an iron pipe; thence along the lands now or formerly of B. David Betton and across an existing 12 feet wide gravel road, South 72 degrees 20 minutes 17 seconds West 357.92 feet to an iron pin set; thence along lands now or formerly of John S. Whitman North 27 degrees 07 minutes 36 seconds West 71.52 feet to an iron pin set, the place of BEGINNING.
