COMPLAINT
AND NOW, this 26TH day of JUNE, 2000, comes the Plaintiffs,
EUGENE R. GEORGE and GWENDOLYN GEORGE, his wife, by their
attorney, Francis M. Socha, Esquire, and files this complaint and
respectfully avers the following:
1. Plaintiff, EUGENE R. GEORGE, is an adult individual,
residing at 1606 Liberty Street, Harrisburg, Dauphin County,
Pennsylvania 17103.
2. Plaintiff, GWENDOLYN GEORGE, is an adult individual,
residing at 1606 Liberty Street, Harrisburg, Dauphin County,
Pennsylvania 17103.
3. Defendant, KEITH C. ANDERSON (~AndersonH), is an adult
individual who resides at 230 Spanglers Mill Road, York County,
New Cumberland, PA 17070.
4. The facts and events that this action is based on an
event that occurred on or about January 30, 1998, at
approximately 4:00 p.m.
5. On the above date and time, the Plaintiff, Eugene
George, was test driving a 1989 Saab 900 Turbo vehicle from
Brenner Nissan Motors. He was accompanied by Clayton Keefer, a
salesman with Brenner.
COUNT I

6. Plaintiff, Eugene George, incorporates by reference
Paragraph 1 through 5 as if set forth at length.
7. At the aforesaid time and place, while the Plaintiff,
Eugene George, was test driving the 1989 Saab 900 Turbo, the
vehicle stalled in the southbound lane of Route 15, just north of
the Route 581 overpass. Emergency flashers were operating on the
vehicle when the Saab was struck in the rear by a 1995 Jimmy 4x4
operated by Anderson. The force of the impact pushed the Saab
ninety-one (91) feet from the point of initial impact to its
final resting point.
8. The collision and all of the physical injuries and
damages hereinafter related are the direct and approximate result
of the careless, reckless, negligent, wanton and willful manner
in which the Anderson operated his 1995 Jimmy 4x4 (~vehicleff).
The negligence, carelessness, and recklessness of Anderson
consists of, but is not limited to, the following:
a. failing to have the vehicle under proper and
adequate control at the time and place of the accident;
b. operating the vehicle at a high and excessive rate

of speed under the circumstances;
c. failing to keep a proper look-out;
d. failing to use due-care and acting without regard
for the right, safety, and position of the vehicle in which the
Plaintiff Eugene George, was driving at the time and place of the
accident;
e. traveling too fast for conditions;
f. following too closely at an excessive rate of
speed;
g. failing to apply his brakes in time to avoid
striking the vehicle in which the Plaintiff, Eugene George was
operating; and
h. otherwise operating his vehicle in a manner
endangering persons and property, and with careless disregard for
the rights and safety of others, and in violation of the Motor
Vehicle Code of the Commonwealth of Pennsylvania.
9. As a direct and approximate result of the aforesaid
collision, the Plaintiff, Eugene George, suffered injuries which
are serious and permanent, including, but limited not to, the
following:
a. Cervical and Lumbar Strain w/Contusion of left
leg;
b. Significant internal derangement of the left knee
w/significant tear of the medial meniscus;
c. Disc Herniation at the L5/S1 Level w/nerve

displacement and impingement;
d. Pain of the left leg and lower back; and
e. periodic headaches.
10. As a result of the aforesaid injuries he received in
this accident, the Plaintiff, Eugene George, has undergone in the
past, is undergoing in the present, and will undergo in the
future great pain and suffering.
11. As a result of the aforesaid collision, the Plaintiff,
Eugene George, has suffered a severe loss of earnings and
impairment of his earning capacity and power.
12. As a result of this collision, the Plaintiff, Eugene
George, has suffered a permanent disability and permanent
diminution of his earning power and capacity.
13. As a result of the aforesaid collision, the Plaintiff,
Eugene George, has suffered permanent diminution of his ability
to enjoy life and life's pleasures.
14. As a result of this collision, the Plaintiff, Eugene
George, has incurred reasonable and necessary medical and
rehabilitative costs and expenses.
WHEREFORE, the Plaintiff, Eugene George, demands judgment
against the Defendant, Keith C. Anderson, in an amount in excess
of Twenty-five Thousand Dollars ($25,000.00), exclusive of
interest and costs and in excess of any jurisdiction amount
requiring compulsory arbitration.

COUNT II - LOSS OF CONSORTIUM
Gwendolyn George v. Keith Anderson
15. Plaintiffs, Eugene George and Gwendolyn George,
incorporate by reference Paragraphs 1 through 14 as if set forth
at length.
16. Plaintiffs, Eugene George and Gwendolyn George, are
husband and wife.
17. As a result of the Defendant's negligence as set forth
in Counts I, which resulted in injuries to the Plaintiff, Eugene
George, the Plaintiff, Gwendolyn, has been deprived of the
assistance and society of her husband, all of which have been to
her great damage, loss, and detriment.
WHEREFORE, the Plaintiff, Gwendolyn George, demands
judgment against the Defendant in an amount in excess of Twenty-
five Thousand Dollars ($25,000.00), exclusive of interest and
costs, and in excess of any jurisdictional amount requiring
compulsory arbitration.
