PETITION TO REINSTATE NOTICE OF APPEAL
The Defendants, Yang and Young Min, through their attorney,
Matthew J. Eshelman, Esquire, make the following Petition to
Reinstate Notice of Appeal pursuant to Pennsylvania Rule of Civil
Procedure, Rule 206.6(a) and, in support thereof, respectfully aver
as follows:
1. On or about November 20, 1997, Plaintiff PA Gastro-
enterology Associates (along with the Digestive Disease Institute)
provided non-emergency, medical services to Defendant Yang C. Min.
2. There was considerable confusion as to which insurance
company the parties should submit bills for the services.
3. By September 1998, the parties had agreed that the Mins
would obtain the information necessary for Plaintiff to bill the
correct insurance company.
4. On or about November 6, 1998, Defendants provided
information to Plaintiff with which to submit claims to the
insurance carrier.
5. Without informing the Mins, the plaintiff failed to
resubmit the claims to the insurance carrier for payment.

6. On or about October 27, 1999, Plaintiff filed a civil
suit with District Justice Charles A. Clement, Jr., demanding
payment for medical services.
7. On or about December 22, 1999, a hearing was scheduled
before D.J. Clement, at which time an agreement was reached in open
court to resubmit the claim to the insurance carrier, rather than
proceding through a hearing.
8. The Mins stipulated that Mrs. Min had received the
medical services for which the Defendants demanded payment, and
judgment was to be entered by the District Justice accordingly.
9. Plaintiff, however, specifically agreed it would not
proceed to finalize the judgment until February 15, 2000.
10. In the meantime, the Mins were to resubmit claims to
their insurance carrier, with help from Plaintiff if needed.
11. The parties specifically expressed that judgment was
being entered by the District Justice "in the spirit of
compromise."
12. On or about December 30, 1999, the Mins resubmitted the
claim to their insurance company.
13. On January 21, 2000, not having heard from the insurance
carrier, the Defendants filed a Notice of Appeal.
14. A Rule to File Complaint was automatically issued.
15. It was the Min's intention not to enforce the Rule to
File Complaint pending response from the insurer.
16. Service of the Notice and Rule was made with ten (10)
days of filing by mailinq the documents on January 31, 2000.

17 . The return of service of the Notice and Rule was not
time-stamped as filed by the Prothonotary until February 3, 2000.
18. Despite the Plaintiffls agreement to allow the Mins to
proceed in the spirit of compromise at least through February 15th,
the Plaintiff directed the Prothonotary to strike the Notice of
Appeal for failure to file the Return of Service by the 31st,
rather than to mail the document by the 31st.
19. Concurrence of opposing counsel, Richard Guida, Esquire,
was sought by telephone. Opposing counsel objected to the relief
sought herein.
WHEREFORE, the Defendants petition the Court to reinstate the
,Notice of Appeal upon grounds of extrinsic fraud by issuing a Rule

granted.

because Defendants owe the debt to Plaintiff. The "spirit of
compromise" only referred to Plaintiff's forebearance on
executing the judgment until February 15, 2000.

13. Admitted that Defendants filed a Notice of Appeal
on January 21, 2000.

15. Denied. Defendants knew no later than January 24,
2000 that its insurance carrier would not pay the claim

dated January 31, 2000 indicating the Notice of Appeal, denial of
the claim by its insurance carrier, and the defenses Defendants
would employ at trial.
17. Admitted that Defendants failed to comply with
District Justice Rule 1005B in perfecting its Appeal.

18. Denied that there was any agreement allowing
Defendants to appeal the district justice judgment. Admitted
that Plaintiff filed a praecipe pursuant to District Justice Rule
1006 requesting the Prothonotary to strike Defendants appeal.
19. Admitted that Plaintiff's counsel refused to concur
with Defendants' Petition. Defendants, who are represented by
counsel, have demonstrated no good cause for failure to comply
with appellate procedural rules. See Howland, Hess, Guinan &
Torpey v Perzel, 667 A.2d 1163 (Pa. Super 1995).
WHEREFORE, Plaintiff/Respondent respectfully requests
that Defendants/Petitioners Petition to Reinstate Appeal be
denied.
