1. American General Finance is a business corporation having offices at 1764
East Third Street, Williams port, Lycoming County, Pennsylvania 17701.
2. Defendants, Harvey E. and Vickie L. Detwiler are adult individuals residing

at 101 Cottage Road, Shippensburg, Cumberland County, Pennsylvania 17257.
3. In January, 1999, the Defendants purchased certain furnishings through the

execution of a Retail Installment Sales Contract, Note, and Security Agreement, true and I'

correct copies of which are attached hereto and the contents incorporated herein by
reference.
4. The Defendants defaulted upon the repayment terms of the Retail Installment
Sales Contract by failure to make monthly payments when due.
5. Plaintiff believes that the Defendants obtained a discharge of the personal
obligation through personal Bankruptcy.

6. Pursuant to the terms of the documents attached hereto, the Defendants
gave the Plaintiff a security interest the furnishings purchased by the Defendants through
this financing.
7. The Plaintiff believes that the furnishings purchased the Defendants through
the financing which is the subject of this Complaint remain in the possession of the
Defendants, and that the furnishings have a current value less than the purchase prices
of $506.05.
8. There is currently due and owing to the Plaintiff from the Defendants on the
financing which is the subject of the attached loan documents the sum of One Thousand
Five Hundred Dollars and no/100 ($1,500.00).
WHEREFORE, Plaintiff demands judgment against the Defendants in Replevin
for possession and ownership of the furniture purchased by the Defendants pursuant to
the terms of the Retail Sales Installment Contract, a true and correct copy of which is
attached hereto.

no answer.
Paragraphs 3 and 6 allege that the Plaintiff has a security interest in the
furnishing which are listed in the Retail Installment Sales Contract attached to the
Complaint, and incorporated in the Complaint by reference. That allegation, if true, would
support the security interest.
3. The allegations set forth in this paragraph state a legal conclusion requiring
no answer. The purpose of the allegation in Paragraph 8 that there is a sum due and
owing is to satisfy the requirement that Plaintiff have a claim on the personal property
which Plaintiff seeks pursuant to the terms of the Replevin Complaint.

AND NOW, comes the defendants by their attorney, JAMES M. BACH, and files tbe within Answer to a
complaint:
1.-2. ADMITTED.
3. DENIED. The alleged sales contract is not attached to the complaint as alleged.
4. DENIED. Strict proof of default on repayment linder the terms of the retail installment sales
contract is demanded at time of trial. Furthermore, the parties herein, namely Detweilers, have
received a Bankruptcy discharge for this debt,
5. IT IS ADMITTED by way of further information that the Bankruptcy case number is 1-99-
03487and the court granted a discharge of debtor on November 29, 1999. The discharge was
signed by the Honorable Robert J. Woodside, Chief Bankruptcy Judge, See Exhibit "A",
6, DENIED. The defendants did not give a security interest for furnishings in this case, Strict proof
of this allegation is demanded at time of trial.
7. DENIED. The furnishings complained of have not been stated with specificity, therefore the
defendant does not know if they are in possession of defendant. Furthermore, any item in dispute
has a value of one hundred ($100.00) dollars or less and all money damages have been discharged
in Bankruptcy.
8. DENIED. The Bankruptcy discharge has been effectuated by the United States Middle District
Bankruptcy Court. The Honorable Robert J. Woodside granted a discharge of debt to the debtors
on the aforementioned date and therefore there cannot be any amounts due and owing in regard to
this account. .
WHEREFORE, in light of the Bankruptcy discharge, defendants respectfully pray that the complaint
against them be dismissed.

AND NOW come the Defendants, Harvey E. Detwiler and Vickie L. Detwiler, by their
attorney, JAMES M. BACH, ESQUIRE, and files the within PRELIMINARY
OBJECTIONS (set 1).
1. DEMURRER-
This complaint fails to state a cause of action upon which relief can be
granted.
2. MOTION TO STRIKE OFF COMPLAINT FOR FAILURE TO
CONFORM TO A PARTICULAR RULE OF LAW -
This particular complaint alleges a breach of contract and fails to establish
the basis for the breach. The contract does not establish as suggested in
the complaint that the plaintiff is holding a security interest in certain
furnishings purchased by the defendants through a financing period,
Apparently, there existed at the time of this loan a financing scheme
wherein the plaintiff finance company attempted to place a lien or liens on
items of property purchased by the defendant. This attempt to create a
security interest in future purchased goods is invalid, improper, if not
illegal.
3. MOTION TO STRIKE OFF COMPLAINT-
The complaint states that there is currently due and owing the sum of one
thousand five hundred dollars ($1,500), this is contained in paragraph
number 8. The complaint also states that the defendants obtained a
discharge of the personal obligation through personal bankruptcy in
Paragraph number 5.

The complaint is inconsistent to the extent to the extent that on one hand,
the complaint alleges a discharge of the personal obligation inbankrnptcy,
and on the other hand, there is an allegation of an amount due of one
thousand five hundred dollars ($1,500).
It is certainly not clear what the plaintiff is suggesting herein, and the
plaintiff should be made to strike and or state with specificity that which is
accurate, true, and correct.
