LYNCH, his wife, Defendants IN ASSUMPSIT COMPLAINT AND NOW, comes the above mentioned Plaintiff, by its lawful counsel, John J. Krafsig, Jr., Esquire, who demands judg- ment against the said Defendants, pursuant to their contractual obligation to the above mentioned Plaintiff, in the present sum of Thirteen Thousand One Hundred Sixty-seven Dollars and 52/100 ($13,167.52), plus reasonable attorney's fees of $1,316.70 and all costs of suit; upon a certain cause of action, whereof the following is a statement: 1. The Plaintiff is a corporation duly qualified to do business within the Commonwealth of pennsylvania, with its office situate at 901 East Main Street, Palmyra, Pennsylvania 17078. 2. The Defendants are adult individuals resid- ing at 224 Pattison Drive, Shippensburg, Cumberland County, Pennsylvania 17257. - 1 - ~"~= J, 3. On or about July 22, 1999, the Defendants refinanced an existing obligation with the Plaintiff; in the then sum of $13,471.18, the terms of which are more particularly set forth in Plaintiff's Exhibit "A", a true and correct copy of which is attached hereto and made a part hereof. 4. That pursuant to Plaintiff's Exhibit "A", the Defendants were required inter alia, to make monthly pay- ments of $224.00 per month, commencing September 1, 1999 until the total obligation of $13,471.18 was paid in full. 5. The Defendants have defaulted and in breach of their agreement, have only made two (2) payments for a total of $305.18, leaving a present balance due of $13,167.52, due and payable on the said account. 6. That the Defendants further agreed, pursuant to Plaintiff's Exhibit "A", that in the event of default of the said obligation, of 10 days or more, in addition to all costs and expenses, they shall be subject for reasonable attorney fees. 7. That the Plaintiff has incurred reasonable attorney fees of $1,316.70 to John J. Krafsig, Jr., Esquire, counsel of record, involving the preparation and filing of suit on January 19, 2000; and the expenditure of time and effort to collect the said moneys by proceeding in the Court of Common Pleas of Cumberland County, Pennsylvania; and the matter of Compulsory Arbitration under the Rules of the Cumberland County - 2 - . Court; and that the reasonable and fair value of said services, relating to the amount of the indebtedness and the work involved a reasonable sum of $1,316.77, for which judgment is further demanded. WHEREFORE, the Plaintiff demands judgment against the Defendants in the present total sum of $14,484.52, together with all costs and interest as called for in said Plaintiff's Exhibit "A". On or about July 22, 1999, the Defendants refinanced an existing obligation with the Plaintiff; in the then sum of $13,471.18, the terms of which are more particularly set forth in Plaintiff's Exhibit "A", a true and correct copy of which is attached hereto and made a part hereof. 4. That pursuant to Plaintiff's Exhibit "A", the Defendants were required inter alia, to make monthly pay- ments of $224.00 per month, commencing September 1, 1999 until the total ,obligation of $13,471.18 was paid in full. 5. The Defendants have defaulted and in breach of their agreement, have only made two (2) payments for a total of $305.18, leaving a present balance due of $13,167.52, due and payable on the said account. 6. That the Defendants further agreed, pursuant to Plaintiff's Exhibit "A", that in the event of default of the said obligation, of 10 days or more, in addition to all costs and expenses, they shall be subject for reasonable attorney fees. 7. That the Plaintiff has incurred reasonable attorney fees of $1,316.70 to John J.
