STIPULATION AGAINST LIENS

THIS AGREEMENT made the ~ day of January 2000, by and between
Farinelli Construction, Inc., hereinafter referred to as Contractor, and Scott A.
Heintzelman and Gaye Y. Heintzelman, husband and wife, hereinafter referred to as
Owners, whereby the former undertakes and agrees to erect and construct a single family
dwelling on:
ALL THAT CERTAIN piece or parcel of land situate in Upper Allen Township,
Cumberland County, Commonwealth of Pennsylvania, bounded and described as follows,
to wit:
BEGINNING at a point on the Western dedicated right-of-way line of Spring Willow
Drive, said point being on the dividing line between Lots Nos. 55 and 56 on the hereinafter
mentioned Plan of Lots; thence along the Western dedicated right-of-way line of Spring
Willow Drive, South 48 degrees 03 minutes 59 seconds East, 120.00 feet to a point on the
dividing line between Lots Nos. 54 and 55 on the hereinafter mentioned Plan of Lots;
thence continuing along said dividing line South 41 degrees 56 minutes 01 second West,
125.00 feet to a point; thence North 48 degrees 03 minutes 59 seconds West, 120.00 feet
to a point on the dividing line between Lots Nos. 55 and 56; thence along said dividing line,
North 41 degrees 56 minutes 01 second East, 125.00 feet to a point on the Western
dedicated right-of-way line of Spring Willow Drive, the Place of BEGINNING.
BEING Lot No. 55 on Phase VIII - Final Subdivision Plan of Meadowview Estates,
said Plan being recorded in the Office of the Recorder of Deeds in and for Cumberland
County, in Plan Book 74, Page 108.
BEING the same premises which John M. Knaub, single person, by his Deed dated
March 10, 1999, and recorded in the Office of the Recorder of Deeds in and for
Cumberland County, in Deed Book 195, Page 833, granted and conveyed unto Scott A.
Heintzelman and Gaye Y. Heintzelman, husband and wife.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor,
for and in consideration of the sum of One and 00/100 ($1.00) Dollar to it in hand paid by
Owners, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for itself and its subcontractors, and all parties
acting through or under them, covenant and agree that no mechanic's liens or claims
thereto for or on account of any work done or materials furnished by them or any of them
under said contract or otherwise, for, towards, in, or about the erection and construction of
the said buildings on the lot above described, and the said Contractor, for itself, its

subcontractors and others under them hereby expressly waive and relinquish the right to
have, file and maintain any mechanic's liens or claims against the said buildings or any of
them, and agree that this instrument, waiving the right of lien, shall be an independent
covenant.

appeared Don Farinelli, known to be the person whose name is subscribed as President,
and who acknowledges himself to be the President of Farinelli Construction, Inc.,
corporation, and that he as such President, being authorized to do so, executed the
foregoing instrument for the purposes therein contained by signing the name of the
corporation by himself as President.
