A Custody Conciliation Conference was held on August 12, 2003. Present for the conference were: the Mother, Lydia Drusilla Bastiany, and her counsel, Joan Carey, Esquire; the Father, John A. Bastiany-Gaumnitz, participated, pro se, via telephone from the SCI at Frackville, Pennsylvania. The Conference was scheduled following Father's June 3, 2003 of a Motion for a Master to be appointed in the divorce action for the purpose of determining partial custody. For purposes of the Custody Conciliation, Father's Motion is treated as a custody count which has been docketed to they divorce action. 3. Father's position on custodv is as follows: Father states that he filed the Motion because he wanted to know what was going on with his children and because he wants to establish a relationship with the children. He rf:cognizes that, due to their ages, they do not know him, as he has been incarcerated :since 1999. Father is presently incarcerated serving a sentence for involuntary deviate sexual intercourse with his now nine (9) year old stepdaughter. Father confessed to the crime, pled guilty, and, by his report, may serve up to a maximum of four (4) additional years. He met with the Parole Board in June 2003 and the results of his application for parole are pending. 4. Mother's position on custodv is as follows: Mother is not comfortable with supervised visitation after Father is released from his peruod of incarceration unless she has input from a professional to know whether it is appropriate for the children to have a relationship with him. She also stated that she would need more information about his treatment prior to making a decision about agreeing to supervised visitation. She is not NO. 02-5251 CIVIL TERM comfortable being in the role of being a supervising adult should she be required to cooperate with a supervised visitation plan. Mother did agree to provide Father with letters twice per month reporting how the children are doing. She is not agreeable to take the children to visit Father in Frackville. Mother reports that 1rather has a history of having assaulted her around the time that the charges were brought against him for the sexual assault against her daughter. Mother is presently the sole caregiver for five (5) children, ages nine, six, five, four, one. Two (2) children are of the marriage. She is not working outside the home but has plans to begin job training on August 18, 2003. Her only access to a vehicle is through her father's business. 5. Neither party requested a hearing. Both were satisfied with Mother's agreement to write to Father regarding the children twice pE;r month and confirming primary physical and legal custody in Mother at this time. Ir` + 1 ~ ~~ i~ ~ ~~~~. _ .. .. ~,. ~, l~ -.. .....___.. .-_ __. t - ... i L x,~~,r ~ Akira Bastiany CP-21-JV-197-2004 RECOMMENDATION OF MASTER Present at the hearing on October 31, 2005 were Lindsay Dare Baird, Esquire, for CCC&YS; Diane Nolan, Caseworker; Sandy Gibson, Caseworker Supervisor; Nicole Crisp, Caseworker Supervisor; Jacqueline Verney, Esquire, court appointed Guardian Ad Litem for the juvenile; Lydia Bastiany, mother; Galen Waltz, Esquire, court appointed counsel for the mother; Shaun Shultz, Esquire, court appointed counsel for the father; Kathleen Shaulis Esquire, court appointed counsel for the father Tito McGill (not present, father of Alexis Stauffer); and Linda Rosenberry, CASA. This hearing is for the benefit of three children of Lydia Bastiany, Alexis Stauffer age nine, Akira Bastiany age eight and Kylie Bastiany age seven. All the parties agree that the allegations are correct as stated. The children had been in foster care but Lydia Bastiany has made considerable progress, completing the TIPS Program, participating in reunification services and participating in individual and group counseling for drugs and alcohol at Gaudenzia. She has identified an extensive safety plan for the children in conjunction with. the Agency. She had made arrangements for the children to be enrolled in school. The Agency recommends that the children return to Lydia Bastiany's care and custody and remain dependent. All parties are in agreement with that recommendation. Counsel for John Bastiany argued far contact with the children or at least updates about their progress. The children's mother argues that he sexually abused one of her older daughters, and that there had been an earlier court order that he have no direct contact with the children. She also sustained considerable emotional damage as a result of these events and does not want to be in direct contact with him. It is recommended that the children's mother be directed to provide updates on the children to the caseworker and that the caseworker then communicate with Mr. Bastiany as to how the children are doing. It is recommended that the children be discharged from the care and custody of Cumberland County Children and Youth Services and from their present .foster care placements and be returned to the care and custody of their mother Lydia Bastiany. It is recommended that they continue to be dependent and subject to protective services. All reasonable efforts have been made to prevent any restrictive aspects of this recommendation. The prior Order of this Court dated August 25, 2003 is vacated and replaced with this Order. 2. The Mother, Lydia D. Bastiany, shall have legal custody and primary physical custody of Akira M. Bastiany, born September 1, 1997, and Kylie M. Bastiany, born September 12, 1998. 3. The Mother shall provide the Father with a letter once a month communicating information regarding the Children's general well being and educational progress. The Mother shall forward to the Father a picture of the Children once a year and copies of the Children's report cards on an ongoing basis. The Mother may provide the foregoing information to the Father either directly by mail or by mail through a third party. 4. This Order is entered pursuant to an agreement of the parties at a custody conciliation conference. The parties may modify the provisions of this Order by mutual consent.
